Records Retention Sample Clauses

● Records Retention. All accounting records and evidence pertaining to all costs of
Subrecipient and all documents related to this Contract shall be kept available at
Subrecipient’s office or place of business for the duration of this Contract and thereafter
for three (3) years after completion of an audit. Records which relate to:(1) complaints,
claims, administrative proceedings or litigation arising out of the performance of this
Contract; or (2) costs and expenses of this Contract to which County or any other
governmental department takes exception, shall be retained beyond the three (3) years
until final resolution or disposition of such appeals, litigation, claims, or exceptions.

● Records Retention. Contractors and Subcontractors must preserve such certified
transcripts for a period of three years from the date of completion of work on the awarded
contract. Day’s Labor Eight hours shall constitute a legal day's work for all classes of
employees in this state except those engaged in farm and domestic service unless
otherwise provided by law. No laborers, workmen or mechanics in the employ of the
Contractor, Subcontractor or other person doing or contracting to do all or part of the work
contemplated by the Contract shall be permitted or required to work more than eight
hours in any one calendar day or more than five calendar days in any one week except in
cases of extraordinary emergency including fire, flood or danger to life or property.
“Extraordinary emergency” shall be deemed to include situations in which sufficient
laborers, workers and mechanics cannot be employed to carry on public work
expeditiously as a result of such restrictions upon the number of hours and days of labor
and the immediate commencement or prosecution or completion without undue delay of
the public work is necessary in the judgment of the NYS Commissioner of Labor for the
preservation of the Contract site or for the protection of the life and limb of the persons
using the Contract site.

● Records Retention. The Asset Representations Reviewer will maintain copies of Review
Materials, Review Reports and internal work papers and correspondence (collectively the
“Client Records”) for a period of two years after the termination of this Agreement. At the
expiration of the retention period, the Asset Representations Reviewer shall return all
Client Records to the Servicer, in electronic format or, to the extent held in tangible form,
in that form. Upon the return of the Client Records, the Asset Representations Reviewer
shall have no obligation to retain such Client Records or to respond to inquiries
concerning any Asset Review.
