ATC Resolution No. 16 (2021) Designation of Individuals Affiliated with the Local Terrorist Groups, which were Designated under Anti-Terrorism Council Resolution No. 13 (2020), as Terrorists Anti-Terrorism Council Resolution Number 16 (2021) DESIGNATION OF INDIVIDUALS AFFILIATED WITH THE LOCAL TERRORIST GROUPS, WHICH WERE DESIGNATED UNDER ANTI-TERRORISM COUNCIL RESOLUTION NO. 13 (2020), AS TERRORISTS: WHEREAS, it is declared a policy of the State to protect life, liberty, and property from acts of terrorism, to condemn terrorism as inimical and dangerous to the national security of the country and to the welfare of the people, and to make terrorism a crime against the Filipino people, against humanity, and against the law of nations; WHEREAS, Section 45 of Republic Act No. 11479, or the “Anti-Terrorism Act of 2020" (ATA), created the Anti-Terrorism Council (ATC) to implement the ATA and assume the responsibility for the proper and effective implementation of the policies of the country against terrorism: WHEREAS, Section 25 paragraph 3 of the ATA states that, “The ATC may designate an individual, groups of persons, organization, or association, whether domestic or foreign, upon a finding of probable cause that the individual, groups of persons, organization, or association commit, or attempt to commit, or conspire in the commission of the acts defined and penalized under Sections 4, 5, 6,7, 8, 9, 10, 11, and 12"; WHEREAS, on 09 December 2020, the ATC approved ATC Resolution No. 13 (2020) entitled “Designation of Islamic State East Asia, Maute Group, Certified True Copy Page | of 4 pages fo 2 aAIC Resolution No. 16 (2021) Designation of Individuals Affiliated with the Local Terrorist Groups, which were Designated under Anti-Terrorism Council Resolution No. 13 (2020). as Terrorists Daulah Islamiyah, and other Associated Groups as Terrorist Organizations, Associations, and/or Groups of Persons". WHEREAS, designation plays c critical role in the fight against terrorism and is an effective means to eliminate, prevent or suppress the financing of terrorist acts, the provision of support to entities and persons involved in terrorist acts, the supply of weapons to terrorists, the recruitment of members of terrorist groups, and the movement of terrorists; and WHEREAS, based on verified and validated information obtained and consolidated by the National Intelligence Committee which wos submitted to the ATC, there is a finding of probable cause, as defined in the ATA, warranting the designation of specific persons for violations of Sections 6. 7,.and 10 of the ATA and/or for being members of the Abu Sayyaf Group (ASG) which has been previously designated as a terrorist organization by the UN Security Council, and proscribed under Republic Act No. 9372 or the Human Security Act of 2007 in September 2015, and for conspiring, planning, and preparing for the commission of terrorism: 1. Kagui Karialan/Karialan affiliated with the BIFF: 5. Salahuddin Hassan a.k.c. Mundi Sawadjaan/Puruh Sawadjaan/ Puroh of the ASG and affiliated with the Dl; and 10.Almujer Yadah a.k.a. Mujer/Mujir of the ASG and affiliated with the DI NOW, THEREFORE, WE, the Council members, by virtue of the powers vested pursuant to Section 45 of the ATA, and after finding probable cause, hereby designate as terrorists the following personalities: Esmael Abdulmalik o.k.a.
