WTO is bunch of Agreements its around 30 agreements collectively is one

Copy Right is a Literary artistic and scientific Work
Copy Right’s scope and in generic it does not required registration as soon the work is done it law applies/ from
the instance of its creation. It enforce the moment the literary work done law apply but in some countries its
required by law and for evidence so we take Registration.
The Term of Copy Right It protect till 50 years from death of author and as per TRIPs should not be less then 50
years can be more but not less.
But Idea’s can't be protected, only the Expression can be protected under Copy Right.

. a) Intellectual property (IP) is a category of property that includes intangible
creations of the human intellect There are many types of intellectual
property, and some countries recognize more than others.
b) The most well-known types are copyrights, patents, trademarks, and trade
secrets
c) The main purpose of intellectual property law is to encourage the creation
of a wide variety of intellectual goods. To achieve this, the law gives people
and businesses property rights to the information and intellectual goods
they create, usually for a limited period of time.
d) This gives economic incentive for their creation, because it allows people to
profit from the information and intellectual goods they create. These
economic incentives are expected to stimulate innovation and contribute
to the technological progress of countries, which depends on the extent of
protection granted to innovators.
Intellectual Property Rights (IPR)

Intellectual Property is Intangible Wealth it’s the result of human Intellect e.g.
WhatsApp and Google etc.
 Can be copied easily but that may discourage the inventors and copying that will
cause monitory loss
 Intellectual Property Rights are Legal/ Commercial Rights it includes Patterned
(Inventions, discoveries), Trademarks (Design, Symbols eg Mercedes), Copyrights
(Artistic work, Words, Phrases), Geographical Indicators (Swiss watch)

IPR can be divided into Two Broad Groups


1. Industrial Intellectual Property: Patterned, Trademarks, Industrial Designs,
Geographical Indicators
2. Copyrights: Literally work, Publications, Novels, Poems, Play, Films, Music,
Drawings, Paintings, Sculpture, Architectural works
OBJECTIVE OF IPR

1) To motivate Inventors by protecting their rights and Inventions


2) Assure protection of their monitory and economical benefits
3) Motivate them to help the mankind in Technological and Intellectual Growth.

Patterned: Exclusive Rights to Inventions, Products, Processes That provides new ways of doing things or Offer new
Technology solution to Problem solving. Generally Patterned are protected for 20 Years and enforced through Courts
Trademark: a type of intellectual property consisting of a recognizable sign, design, or expression which identifies
products or services of a particular source
Copyright: The creative work may be in a literary, artistic, educational, or musical form. Copyright is intended to protect
the original expression of an idea in the form of a creative work, but not the idea itself. A copyright is subject
to limitations based on public interest considerations, such as the fair use doctrine
Geographical Indication (GI) is a name or sign used on products which corresponds to a specific geographical location or
origin (e.g., a town, region, or country). The use of a geographical indication, as an indication of the product's source, acts
as a certification that the product possesses certain qualities, is made according to traditional methods, or enjoys a good
reputation due to its geographical origin.

Intellectual Property Rights (IPR)
 Under Article 27 of The Universal Declaration Of Human Rights :
(1) Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts
and to share in scientific advancement and its benefits.

(2) Everyone has the right to the protection of the moral and material interests resulting from any
scientific, literary or artistic production of which he is the author.
 First Time IPR Need was felt, Convention in Berne was held in 1883 which was completed in 1886 in Paris.
 These Treaties were monitored by World Intellectual Property Organization (WIPO)
 WIPO is one of the 15 specialized agencies of the United Nations. WIPO was created to promote and
protect intellectual property (IP) across the world by cooperating with countries as well as international
organizations to promote countries socially, economically and culturally.
 WIPO’s Headquartered is in Geneva, Switzerland it has “External Offices" around the world
 World Intellectual Property Day is observed Annually on 26 April. The event was established by
the World Intellectual Property Organization (WIPO) in 2000 to raise awareness of
how patents, copyright, trademarks and designs impact on daily life and to celebrate creativity, and the
contribution made by creators and innovators to the development of societies across the globe

Trade Mark Ordinance 2001

The Trade Marks Ordinance, 2001 is the codified law dealing with law related to
registration of Trade Marks related to goods and services within Pakistan and extends
to the whole of Pakistan. It prescribes the registrar, Trade Mark Registry and procedure
of registration of trade marks. The registration and its effect. Use of trade mark and
licenses. Offences, penalties and procedure. Under the powers given in Section 132 of
the Trade Mark Ordinance, 2001 the Trade Mark Rules, 2004 were made.

WHEREAS it is expedient to amend and consolidate the law relating to trade marks and
unfair competition and to provide for registration and better protection of trade marks
and for the prevention of the use of fraudulent marks. and for matters ancillary thereto
or connected therewith.
