Subject: Complaint against Mr. PV Sunil Kumar, IPS, Addl. Director General of
Police, Crime Investigation Department (CID), Government of Andhra Pradesh for
violation section 3 of The Police Forces (Restriction of Rights) Act, 1966 and Central
Civil Services (Conduct) Rules, 1964 by involving below activities:

1. Abusing Official Position for personal activities by running a Private


Organization named ‘Ambedkar’s India Mission’ thereby promoting himself as
celebrity by violating section 3 of The Police Forces (Restriction of Rights) Act,
1966.
2. Provoking people of Scheduled Castes and thereby expressing hatred
towards Hindu religion, Hindu Gods and Sacred Hindu Scriptures on Social
Media Platforms.
3. Criticizing Political ideologies openly and thereby creating political opinions
among the people.
4. Misquoting Dr. B.R. Ambedkar's views on Hindu Religion and portraying
him as anti-Hindu.
5. Promoting Separatist Ideology among the Scheduled Castes.
6. Creating Caste-based Divisions in Society.
7. Allegations against prominent Nationalist Organizations like Rashtriya
Swayamsevak Sangh and thereby creating negative impressions among
particular groups about such organizations.

We hereby making this complaint against Mr. PV Sunil Kumar IPS of Andhra Pradesh
Cadre for indulging in anti-Social activities by promoting anti Hindu ideology, creating
enmity between different sections of the society and corrupting the minds of people of
the Scheduled Caste Community with his speeches by forming a private organization
named “Ambedkar’s India Mission”.

Mr. PV Sunil Kumar is an IPS officer belonging to the 1993 batch of Andhra Pradesh
cadre now holding the office as Additional Director General of Police of the Andhra
Pradesh State’s Crime Investigation Department. Even while in police service, he
formed an organization named “Ambedkar’s India Mission” and conducting anti Hindu
propaganda creating animosity between different sections of the Hindu society,
especially the Scheduled Caste people of Andhra Pradesh.

In the year 2018 he organized a meeting in East Godavari District on the banner of
“Ambedkar’s India Mission”. In the video of the meeting shared in Youtube, he accused
Hindu religion of discriminating against Scheduled Castes, preventing Scheduled
Castes from wearing footwear, wearing proper clothes and forcing them to have the
name “Das” meaning slave of the other Hindu castes. This ideology was first countered
by Buddhism. Then this discriminatory ideology called Hinduism was countered by Dr.
Ambedkar. Hinduism treats human beings as of higher or lower dignity based on caste.
In the same video, RSS has adopted Hindu religious ideology. These people are now
ruling all over India. If we touch a cow, we will be killed.

In the same event, he criticized the ideology of ‘Rashtriya Swayamsevak Sangh’, a


highly reputed service organization of India. In Part 2 of the video of the same meeting,
he appealed to the SC community to vote on the basis of caste. He quoted the example
of Karnataka elections where Sri Yediyurappa won on the basis of caste consolidation.
He called upon the SC community to consolidate as a solid vote bank which can win
elections and sweep to power. He also appealed to the SC community to cultivate good
relations with few other castes to win elections. Such lectures divide the community on
caste lines, are a mockery of democracy and totally unbecoming of a senior officer of
the Indian Police Service. Instead of educating people on democratic process of
elections where progressive reforms, development should be the criteria for voting, Sri
Sunil Kumar has been strongly advocating regressive caste based voting.

In an interview given to the Times of India, he said he will represent only the SC Mala
community and will oppose inclusion of any other caste in SC category list. He also
demanded SC status for SCs who have converted to Christianity. This is shocking to
say the least. It is very clear that Sri P V Sunil Kumar, as an all India Civil Service
officer, instead of treating all sections of the society as equal, has made it very clear that
he will be favouring only one section of the SC society- Mala. This is a serious violation
of service conditions under which he is working.

On 26th November 2020, on the occasion of Constitutional Day, he appeared on
Facebook live through the official page of “Ambedkar’s India Mission” and
abused Hindu Religion and Hindu Sacred scriptures like Vedas and Puranas.

On the banner of “Ambedkar’s India Mission'' he is creating separatist ideology among


the weaker sections of the people by demanding separate Gram Panchayats for
Scheduled Caste people.

Being a bureaucrat of prestigious All India Civil Services, he is openly spreading hatred
against Hindu religion which is being followed by majority people of the Country
thereby hurting the sentiments and trying to incite communal tensions between different
religious groups in the state of Andhra Pradesh.

In this connection, it is worth mentioning of the Central Civil Services (Conduct) Rules,
1964 GENERAL 3(1) (xviii) which says: "Every Government servant shall at all times
refrain from doing anything which is or may be contrary to any law, rules, regulations
and established practices;"

The activities of Mr. PV Sunil Kumar, IPS in forming a separate organisation named
"Ambedkar India Mission" and carrying on the hate and divisive propaganda among the
different sections of the society is not only a serious crime but a clear contravention of
Rule No. 4 (2)(3) of Central Civil Service (Conduct) Rules 1964 which clearly states as
below:

“-- 2. The Constitution of India is based on the principle of secular state and expressly
prohibits any discrimination in favour of or against any person or classes of persons
on religious grounds. It follows, that, though servants of the State are entitled in their
private lives freely to profess, practise or propagate any religion, they should so
conduct themselves in public as to leave no room for an impression to arise that they
are likely, in their official dealings, to favour persons belonging to any particular
religion. Such an impression is bound to arise in respect of a Government who
participates in bringing about or organizing conversions from one religion to another
and such conduct would be even more reprehensible if, in the process, he makes use,
directly or indirectly, of his official position or influence.

3. As such cases are not likely to be very frequent, it has been decided that no specific
provision need be added to the existing Conduct Rules. Nevertheless participation in
proselytizing activities or the direct or indirect use of official position and influence in
such activities on the part of a Government servant may be treated as good and
sufficient reasons for taking disciplinary action against him under the Central Civil
Services (Classification, Control and Appeal) Rules. [MHA OM No. 25/50/57-Ests.(A),
dated 15.01.1958]"

Mr. PV Sunil Kumar is indulging in highly inflammatory speeches, anti-social and anti
Hindu activities by poisoning the minds of people of the society at large in the disguise
of their upliftment.

Activities of Mr. PV Sunil Kumar, IPS on behalf of “Ambedkar’s India Mission” is a


clear violation of The Police Forces (Restrictions of Rights) Act, 1966, which explains
in its Rule no. 3 & 4 that..

3. Restrictions respecting right to form association, freedom of speech, etc.—


(1) No member of a police-force shall, without the express sanction of the Central
Government or of the prescribed authority,—
(a) be a member of, or be associated in any way with, any trade union, labour union,
political association or with any class of trade unions, labour unions or political
associations; or
(b) be a member of, or be associated in any way with, any other society, institution,
association or organisation that is not
recognised as part of the force of which he is a member or is not of a
purely social, recreational or religious nature; or
(c) communicate with the press or publish or cause to be published any book, letter or
other document except where such communication or publication is in the bona fide
discharge of his duties or is of a purely literary, artistic or scientific character or is of
a prescribed nature.
Explanation.—If any question arises as to whether any society, institution, association
or organisation is of a purely social,
recreational or religious nature under clause (b) of this sub-section, the decision of the
Central Government thereon shall be final.
(2) No member of a police-force shall participate in, or address, any meeting or take
part in any demonstration organised by any body of persons for any political purposes
or for such other purposes as may be prescribed.

4. Penalty.—Any person who contravenes the provisions of section 3shall, without


prejudice to any other action that may be taken against him, be punishable with
imprisonment for a term which may extend to two years, or with fine which may extend
to two thousand rupees, or with both.

The dangerous nature of these activities has become even more frightening considering
that Mr. PV Sunil Kumar is in a key position of a state-run institution. For the vulnerable
society and general public, it may seem that his actions are backed by the state but in
lawful terms his venomous actions could be deemed as institutionalized subversion of
little children to serve his personal mala fide intents.
We further submit that Mr. PV Sunil Kumar has not only brought disrepute for himself
with his suspicious conduct but also to the Crime Investigation Department which is a
premier investigation agency of the State Government.

In the view of above serious circumstances and reasons we kindly request your good
office to:

1. Issue directions to concerned Police Department of Andhra Pradesh to


lodge a FIR against Mr PV Sunil Kumar under the sections 153A, 295A of
Indian Penal Code, under the sections of Information Technology Act and
under the sections of Unlawful Activities (Prevention) Act, 1967 for creating
enmity between different religions, misusing Social Media Platforms and
performing suspicious activities under the banner of “Ambedkar’s India
Mission”.

2. Conduct a detailed investigation into the finances, his links with


national and international donors and sponsors for the activities of
“Ambedkar’s India Mission” organisation that enables him to conduct these
anti- social activities and freeze all bank accounts / any other means of funds
transfer. All bank accounts / payment wallet accounts to be probed for any
suspicious or dubious financial transaction has happened.

3. Immediately initiate a departmental enquiry into his prolonged stint in


one single assignment which is not a regular assignment for an IPS officer and
initiate stringent administrative action against him, including withholding of
employee/terminal benefits if charges are proved against him and
“Ambedkar’s India Mission”, an organisation set up by him.

4. He is also on record saying that Britishers gave them “God” meaning


Christianity and Jesus Christ. Thus, it is very clear that, given his anti-Hindu
speeches, support for SC status to Christians, Mr. PV Sunil Kumar has
converted to Christianity and is a practising Christian. Last week, Madras
High Court gave a ruling that those who avail reservation benefit, join
government service and then change their religion, should be removed from
service. In view of the above, we request you to order removal of service of
Mr. PV Sunil Kumar. In line with the Constitutional Provisions and recent
Hon’ble Madras High Court’s orders.
