Report the start and end date of apprenticeship training on
portal -site .

Ensure not to engage any person as an apprentice, unless
he-
(a) is not less than fourteen years of age, and for
designated trades related to hazardous industries, not less
than eighteen years of age
Disclose the duration and syllabi of the optional trades on
the portal-site
Reserve training places for Other Backward Classes,
Scheduled Castes and Scheduled Tribes in every
designated trade in accordance with Schedule IIA
Ensure that a course of related instructions (which shall be
appropriate to the trade and approved by the Central
Govt.) is given to every Trade apprentice undergoing
practical training with a view to giving him such
theoretical knowledge as he needs in order to become
fully qualified as a skilled craftsman.
Maintain a record of Basic Training or Practical Training
and Related Instructions in Form Apprenticeship IA in
Schedule III.
Ensure to formulate a policy for recruiting any apprentice
who has completed the period of apprenticeship training
Pay the apprentice compensation of an amount equivalent
to 3 months of its last drawn stipend
Ensure to comply with the obligations as contained in
Schedule V in case of Trade apprentices. Also ensure that
the Terms and conditions in respect of graduate,
technician and technician(vocational) apprentices are as
specified in Schedule VI.
Ensure that -
(i) No trade apprentice is engaged on any training between
10.00 P.M to 6.00 A.M except with prior approval of
Apprenticeship Advisor (Graduate or technician or
technician (vocational) apprentice to work according to
the normal hours of the department to which they are
attached for training)
(ii) Apprentice is not involved in any overtime work
except with prior approval of Apprenticeship Advisor
Ensure to prepare an index card (envelope) in Form
Apprenticeship-I in Schedule III in duplicate and submit
one of the cards to the Regional director or State advisor
as the case may be within a period of 15 days from the
date of registration of the contract of Apprenticeship and
retain the other.
Ensure that the establishment engages apprentices in a
band of 2.5 percent to 10 percent of the total strength of
establishment including contractual staff in a financial
year. Further, in no month number of apprentice should be
less than 2 percent of the total strength of the
establishment and more than 15 percent of the total
strength.
Pay stipend to the apprentice by the 10 of the following
months at the minimum prescribed rate specified in the
Rule
Send a copy of the report relating to Basic Training or
Practical Training to the Regional Director or the State
Apprenticeship advisor at the end of every half-year.
Disclose the intention of engagement of apprentices (both
in designated and optional trades) on portal site as well as
establishment's portal site (if existing) as per the Quarters
given below:
i) 1st April to 30th June,
ii) 1st July to 30 September
iii) 1st October to 31st December
iv) 1st January to 31st March
Ensure to grant such leaves and holidays to the
apprentices as are observed in the establishment in which
he is undergoing training.

Contract Labour Abolition and Regulation Act, 1970 and Rules 1971
Obtain certificate of registration in Form I from the
Registering officer
Ensure that the health and hygiene facilities are
maintained in the institute.

Ensure that the health and hygiene are maintained in the


latrines/urinals and washing facilities.

Ensure that the first aid facilities are extended to contract


workers.
Ensure that the crèche facilities are extended to contract
workers.
Ensure that the charges for foodstuffs, beverages and any
other items served in the canteen conspicuously displayed
and which shall be based on no profit no loss

Inside walls of the canteen are lime-washed or colour-


washed at least once in each year

Inside walls of the kitchen shall be lime-washed every


four months
Ensure that the canteen facilities are extended to contract
workers.

Employees Provident Fund and Rules, 1952


Obtain declaration in Form 11 from all employees joining
the establishment eligible to become member of the Fund
and upload the same in Universal Account Number
(UAN) portal within 25 days of close of each month.
Ensure to seed KYC details of the members (such as bank
account details, PAN, AADHAAR) within one month of
the receipt of UAN so as to enable them to avail the
services of EPFO.
Disseminate the UAN generated by EPFO to all existing
employees who are members of the fund with 15 days of
the receipt of UAN and get acknowledgement from them.
The employer is further required to get the UAN activated
by the employees within 15 days of such dissemination.
Do we furnish details in Form 5A to the commissioner,
particulars of all the branches, and departments, owners,
occupiers, directors, partners, managers or any other
person controlling its affairs?
Employees Compensation Act,1923 and Rules
Where the amount of any lump sum payable as
compensation has been settled by agreement, then an
employer is required to submit a Memorandum of
settlement agreement to the Commission after entering
into such agreement in Form M or Form N or Form O

Send a report in Form G, to the Commissioner giving the


circumstances attending the death or serious bodily injury,
within 7 days

Furnish a statement in Form A (Fatal Accident), where the


workman's injury results in death.Obtain receipt in Form
B

Pay compensation to a workman suffering from personal


injury, caused by an accident and for disease arising out of
and in the course of his employment.Compensation
amount shall be as per the attachment. Pay compensation
to the workman who contracts any occupational disease as
specified in Schedule III

Deposit funeral expenses amounting to at least Rs 5000


with the Commissioner

migrant workers.

Inside walls of the kitchen shall be lime-washed every

certificate of registration to the registering officer within
thirty days from the date when such change takes place

Payment of Bonus Act, 1965


Prepare and maintain a register in Form C showing the
details of bonus due to each employee along with and
deductions or adjustments, if any

Pay the bonus in cash within 8 months from the close of


the accounting year

File annual return in Form D by uploading the same on


the web portal of Ministry of Labour and Employment on

(v) notice showing the name and complete address of the
Inspector who exercises jurisdiction under the Act over
the mine
(vi) Notice showing approved list of acts and omissions
for which fines can be imposed
(v) Abstracts of the Act and of the rules .

Maintain the :-
(a) Register of Fines .
(b) Register of deductions for damage or loss. (c )
Register of Wages.
(d) Register of advances.
Send all the copies of notices and alterations to the
Inspector relating to:

(i) the wages period for which the wages are payable;
(ii) for not less than two weeks in advance the days on
which wages are to be paid
(iii) the rates of wages and scales of allowances payable to
persons employed in the mines concerned; and
(iv) the day or days on which unpaid wages are to be paid,
indicating the relevant wage period

Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 and Rules, 2013

1. Ensure that the complaint redressal mechanism


stipulated under the act (mentioned in the
attachment) are complied with.
2. Treat sexual harassment as a misconduct under
the service rules and initiate action against such
misconduct
Submit an annual report to the employer and district
officer, which shall have the following details:-
(a) number of complaints of sexual harassment received in
the year;
(b) number of complaints disposed off during the year;
(c) number of cases pending for more than ninety days;
(d) number of workshops or awareness programme
against sexual harassment carried out;
(e) nature of action taken by the employer or District
Officer.
Formulate and disseminate an internal policy (or
charter/resolution/declaration) for prohibition, prevention
and redressal of sexual harassment at the workplace
intended to promote gender sensitive safe spaces and
remove underlying factors that contribute towards a
hostile work environment against women.
Ensure that the member of ICC appointed from amongst
nongovernment organisations shall be paid an allowance
of Rs. 200 per day for holding the proceedings of the
Internal Committee and also the reimbursement of travel
cost incurred in travelling by train in three tier air
condition or air conditioned bus and auto rickshaw or taxi,
or the actual amount spent by him on travel, whichever is
less.
Formulate and disseminate an internal policy (or
charter/resolution/declaration) for prohibition, prevention
and redressal of sexual harassment at the workplace
intended to promote gender sensitive safe spaces and
remove underlying factors that contribute towards a
hostile work environment against women.
Display penal consequences of sexual harassment and the
order constituting the Internal Complaints Committee
(composition of the ICC)) at a conspicuous place at the
workplace.
1. Include the number of cases filed (if any) in the annual
report of the organisation.
2. Where no such report (annual report) is required to be
prepared, intimate such number of cases, if any, to the
District Officer.

Organise workshops and awareness programs at regular


intervals for sensitising the employees with the provisions
of the Act.

Employees' State Insurance Act, 1948, Regulations, 1950 and Rules, 1950

Report the death immediately to the nearest Branch Office


and to the nearest dispensary, hospital, clinic or other
institution where medical benefit is available
Intimate within two weeks, to the appropriate Regional
Office, Sub-Regional Office, Divisional Office or Branch
Office, about any change in the particulars furnished in
Form 01 at the time of registration of the factory/
establishment
Pay both employer's contribution and employee's
contribution to the ESI Corporation in respect of every
employee who earns wages of Rs. 21,000 or less
Maintain the following registers:
1. Accident Book in Form 11
2. Inspection Book which is to be preserved for 5 years
from the date of last entry made
Make a declaration of registration (online with necessary
digital signatures) in Form 01 with all the information
correctly filled and submit it to the Regional Office,
within 15 days of Act becoming applicable

ENVIRONMENT PROTECTION ACT


- Bio Medical Waste Rules
Ensure adequate steps are taken to handle bio-medical
waste without any adverse effect to human health and
environment and comply with the requirements referred in
the additional information for safely handling and
disposal of biomedical wastes

Submit Annual Report in Form II to the State Pollution


Control Board by 31st January every year
Maintain records related to the generation, collection,
reception, storage, transportation, treatment, disposal and
handling of bio-medical waste..

Such records shall be maintained for a period of five years


Submit an application in Form I to the State Pollution
Control Board to obtain authorization to generate, collect,
receive, store, transport, treat, dispose and handle bio-
medical waste
Ensure to set up requisite biomedical waste treatment
equipment like:
1. Incinerator;
2. Autoclave or Microwave;
3. Shredder
prior to commencement of the operation, as per the
authorisation given by the prescribed authority
Take the following health and safety measures to ensure
occupational safety of the employee:
1. Immunise all the health care workers and others,
involved in handling of bio-medical waste for protection
against diseases including Hepatitis B and Tetanus that
are likely to be transmitted by handling of bio-medical
waste, in the manner as prescribed in the National
Immunisation Policy or the guidelines of the Ministry of
Health and Family Welfare issued from time to time; and
2. Provide appropriate and adequate personal protective
equipment.
Intimate the authority immediately on the occurrence of
any major accident about such accident and forward a
report within twenty-four hours in writing regarding the
remedial steps taken in Form I
Ensure to comply with all the duties prescribed in Rule 4
of Bio Medical Waste Management Rules- Duties of
Occupier.

Make an application in Form II, to the State Pollution


Control Board (SPCB) for grant of authorization
The Authority shall grant authorization Form III
The validity of such authorization, for non-bedded health
care facility shall be one time
Intimate to the prescribed authority, in case of any change
in the bio-medical waste generation, handling, treatment
and disposal for which authorisation was earlier granted
and submit a fresh application in Form II for modification
of the conditions of authorisation
Submit an Annual Report to the prescribed authority in
Form-IV, on or before the 30th June of every year

Submit report of accident in Form III to State Pollution


control Board.
Apply in Form 1 and Supplementary Form 1A, if
applicable, after the identification of prospective site(s)
for the project and/or activities to which the application
relates and Obtain prior environmental clearance before
any construction work, or expansion and modernization of
existing projects or activities and change in product mix,
or preparation of land except for securing the land, from
the Central Government in the Ministry of Environment
and Forests (MoEF) on the recommendations of an Expert
Appraisal Committee (EAC).
Apply in Form 1 and Supplementary Form 1A, if
applicable, along with a copy of the pre-feasibility project
report and Obtain prior environmental clearance for
expansion and modernization of existing projects or
activities and change in product mix, all activities or
projects in Category-B, but excluding those which fulfil
the General Conditions (GC) stipulated in the Schedule,
from the State/Union territory Environment Impact
Assessment Authority (SEIAA).
Make public the environmental clearance granted for the
project along with the environmental conditions and
safeguards at their costs by prominently advertising it at
least in two local newspapers of the district or State where
the project is located and in addition, this shall also be
displayed in their website permanently.

Prominently advertise in the newspapers indicating that


the project has been accorded environment clearance and
the details of MoEF website where it is displayed.

Submit half-yearly compliance reports


in respect of the stipulated prior environmental clearance
terms and conditions in hard and soft
copies to the regulatory authority concerned, on 1st June
and 1st December of each calendar year.
Pay water cess on the basis of water consumed, for any of
the purposes specified in column (1) of Schedule II, at
such rate, not exceeding the rate specified in the
corresponding entry in column (2) thereof
Affix water meters, venturi meters or Orifice meters with
integrators and recorders in conformity with the standards
laid down by the Indian Standards Institution

If meter are not available, install Vee notches or


rectangular, notches with indicators and records or
pressure gauges and pumping installations, after obtaining
the permission of the assessing authority.

Ensure that meter is affixed at the entrance of the water


supply connections within the premises of the consumer
or at any other place to be approved by the assessing
authority

Provide a separate meter for assessing the quantity of


water used for each of the four purpose mentioned in
column (1) of Schedule II
Furnish by 5th of every calendar month, to the assessing
authority, a return in Form 1 showing water consumption.

Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016

Sell hazardous waste generated in the establishment only


to the recycler having a valid registration from the Central
Pollution Control Board for recycling or recovery and
ensure that the waste is not stored more than 90 days.
Take all adequate steps while handling hazardous wastes
to:
(i) contain contaminants and prevent accidents and limit
their consequences on human beings and the environment;
and
(ii) provide persons working on the site with the training,
equipment and the information necessary to ensure their
safety.
(iii) reduce and prevent the waste generated or recycle or
reuse the same and comply the conditions specified in the
authorization.
Apply for authorization in Form 1 to generate, process,
packaging, store, transport, use, collect, convert or
transfer, etc.., the hazardous wastes.

Obtain authorization in Form 2 from the State Pollution


Control Board, which shall be valid for a period of five
years.

Maintain, records of hazardous wastes handled in Form 3.

Apply for renewal of authorization in Form 1 before its


expiry.
File an annual return in Form 6.

Ensure to comply with the responsibilities of the occupier


for management of hazardous and other wastes.

Submit details of such import and particulars of the actual


users along with quantities to the concerned State
Pollution Control Board or Pollution Control Committees
on a quarterly basis.

Obtain approval from the Central Pollution Control Board


for the utilisation of hazardous wastes as a supplementary
resource or for energy recovery, or after processing

Obtain approval from the State pollution Control Board


for design and layout of Treatment, Storage and Disposal
Facility.

Send annual returns to the State Pollution Control Board


in Form 4.

Report an accident report in Format 11.

Ensure that the hazardous and other wastes are packaged


in a manner suitable for safe handling, storage and
transport as per the guidelines issued by the Central
Pollution Control Board from time to time. The labelling
shall be done as per Form 8.
The label shall be of non-washable material, weather
proof and easily visible.
Ensure that hazardous waste shall be packed and labelled
visibly based on the composition in a manner suitable for
safe handling, storage and transport.

Provide the transporter with the relevant information


regarding the hazardous nature of the wastes and
measures to be taken in case of emergency in Form 11.

Prepare six copies of the manifest in Form 13 comprising


of colour code and forward it to the concerned person or
authority.
Batteries (Management and Handling) Rules, 2001

Dispose of the batteries to dealer/manufacturer/registered


recycler/importer/ re-conditioner or at the designated
collection centers.

File a half yearly return in Form VIII to the State


Pollution Control Board
Ensure that the e-waste generated is channelized to
authorized collection centre's or registered dismantlers

Maintain records in Form 2 of the e-waste handled.

Ensure that the standards for emission or discharge of


environmental pollutants from the industries, operations
or processes shall be as specified in Schedule I to IV

Ensure not to exceed the relevant concentration in


ambient air as specified against each pollutant in columns
(3) to (5) of Schedule VII provided in the additional
information column
Ensure that:-
(i) the exhaust muffler with an insertion loss of 25 dB(A)
to the Diesel Generator (DG) is provided by the
manufacturer
(ii) Acoustic enclosure is provided by the manufacturer
with an insertion loss of minimum 25 dB(A) in an
acoustic room before operation of the Diesel Generator
(DG) sets and thereafter
(iii) Ensure that the stack height above the roof of the
building in which DG set is installed is as per the formula
mentioned
Submit an environmental statement for the financial year
ending on the 31st March in Form V to the concerned
State Pollution Control Board on or before the thirtieth
day of September every year, beginning 1993

Maintain noise levels as per the standards specified in the


Schedule, provided in the additional information column

TAXATION-
Goods and Services Tax (Compensation to States) Act, 2017 and Cess Rules, 2017

Submit an application for claiming refund of the cess


paid, on the Common Portal, either directly or through a
Facilitation Centre, in the prescribed manner, before the
expiry of 2 years from the relevant date along with any of
the documentary evidence as specified in the attached log
sheet 'Refund_documents'.
In relation to the inward supplies, furnishing details in
Form 3 B and 1.

Submit an application for registration within 90 days from


the date of the grant of temporary registration.

1. File the return, in FORM GSTR-7 on the Common


Portal, either directly or through a Facilitation Centre, for
the month in which such deductions have been made, by
10th of next month.

2. The details shall be made available to each of the


suppliers in Part C of FORM GSTR-2A/FORM GSTR -
4A on the Common Portal.

File electronically on common portal, along with the


annual return: -
1. A copy of the audited annual accounts; and
2. A reconciliation statement, duly certified, in FORM
GSTR-9C.
1. Submit the following application for registration in
each State/ Union territory on the Common Portal, either
directly or through a Facilitation Centre within 30 days of
becoming liable for registration: -
(i) Part A of FORM GST REG-01; and
(ii) After verification of Part A: Part B of FORM GST
REG-01, duly signed, or verified through electronic
verification code (EVC).

2. Obtain the acknowledgement in FORM GST REG-02.


Income Tax Act, 1961 and Income Tax Rules, 1962

Submit the tax amount before April 30 of the year,


immediately following the financial year in which tax was
deducted.
Ensure to keep & maintain such books of accounts &
other documents as may enable the Assessing Officer to
compute his total income in accordance with the
provisions of Income Tax Act,1961.
Submit Quarterly Return for deductions made in respect
of the third quarter of the financial year by 31st January
in Form 24Q to the Income Tax authorities.
Issue certificate in Form 27D to the collectee within 15
days from the due date for furnishing the statement of tax
collected at source for the quarter ending September.
Issue Certificate in Form 16 and Form 12BA before June
15 of the year, immediately following the financial year in
which tax was deducted and deposited.
Issue certificate in Form 27D to the collectee within 15
days from the due date for furnishing the statement of tax
collected at source for the quarter ending March.
Submit Quarterly Return for collections made in respect
of the third quarter of the financial year on or before 15th
January in Form 27 EQ to the Income Tax authorities, and
of other quarters as well.
Issue Certificate in Form 16A within 15 days from the due
date of filing the quarterly return for the quarter ending
December
1. Ensure to submit Form 26A, digitally signed after
certification from a CA, electronically (on the TRACES
Portal), to the CPC-TDS.

2. After submission of Form 26A, view the modified


default status generated on the Traces Portal

3. Make the payment of modified late deduction interest


(modified default status) as appearing on the TRACES
Portal.
In relation to Tax collection at source, collect & pay to the
government, within 1 week from the last day of the month
in which tax is collected at the prescribed rate from the
buyer engaged in business
RAJASTHAN MUNICIPALITY ACT, 2009 AND BYE LAWS
