Rebuttal

Violation of Art 14

In the case of Budhan Choudhury v State of Bihar, it was specified that two classifications must be
fulfilled namely

I. Classification must be founders on an intelligible differentia which distinguishes persons


group together from others left out of the group.
II. Differentia must have a rational relation to the object sough to be achieved by the statute in
question

In the present case, the opposing counsel has mentioned for differentiation to be against all theocratic
states religiously persecuted minorities but the statement of objects makes a series of assumptions that
tend legitimacy of its specified purpose. If one assumes that the objective is to protect only minorities
from neighboring countries
