WHEREAS, on November 25, 2020, the undersigned Labor Arbiter
tendered a Decision in the above-entitled case, the dispositive portion of
which reads:
“WHEREFORE, premises considered, complainant Chariyn B.
Gaylawan was illegally suspended and illegally dismissed from her

Herein respondent 3C Industrial Staffing Solutions, Inc. liable
to pay the complainant the following:
13” month pay;
Backwages;
Separation pay;
Moral damages — P50,000.00;
Exemplary damages — P50,000.00; and
Attomey’s fees of 10% of the judgment award to be
deposited fo the National Treasury in accordance with the
provision of R.A. No. 9406.
PAROS
Attached is a computation of the monetary judgment award in
favor of the complainant and the same forms an integral part of this
Decision.

WHEREAS, no appeal was made by either party;
WHEREAS, on April 12, 2021, a Certificate of Finality? was issued for
the instant case certifying that the November 25, 2020 Decision had become
final and executory on January 8, 2021.
WHEREAS, on April 21, 2021, complainants through counsel filed their
Motion for Issuance of Writ of Execution.*
WHEREAS, since there is no restraining order or preliminary mandatory
injunction issued by any Court or Tribunal enjoining the execution of this case,
the execution proceedings shall proceed as a matter of course: Ww

NOW THEREFORE, you are hereby commanded to collect, in
accordance with Section 9, Rule XI of the 2011 NLRC Rules of Procedure, as
amended, the amount of TWO HUNDRED FIFTY TWO THOUSAND NINE
HUNDRED FORTY FOUR PESOS & 70/100 (Php 252,944.70) from the
respondent 3C Industrial Staffing Solutions, Inc., at Global Wide Realty
Building, Block 4 Lot 2 6" St, Balibago Angeles City, Pampanga or
wherever they may be found in the Philippines, representing the
complainant's judgment award pursuant to the Decision dated November 25,
2021;
Further, collect from respondents the execution fee in the amount of
TWO THOUSAND TWENTY NINE PESOS & 45/100 (Php2,029.45) and
deposit fee of ONE THOUSAND TWO HUNDRED EIGHTY FOUR PESOS &
72/100 (Php1,284.72), pursuant to the Manual of Execution.
In case you fail to collect the amounts above-mentioned from the
respondents, or the amount collected is insufficient to satisfy the judgment
award, you are hereby ordered to cause the satisfaction of judgment in
accordance with the order of enforcement stated in Section 9(a), Rule XI of
the 2011 NLRC Rules of Procedure, as amended, to wit: (a) Cash bond; (b)
Bank deposit; (c) Surety bond; (d) personal property of the losing party not
exempt from execution; and (e) real property of the losing party not exempt
from execution, sufficient to cover the judgment award, which may be
disposed of for value at a public auction to the highest bidder.
If the losing party has no properties or the same is insufficient, and the
bonding company refuses to comply with the writ of execution, you may
proceed to levy on the personal property, and if insufficient, the real property
of the bonding company, without prejudice to contempt proceedings against
its officers or authorized representatives.
