AGREEMENT FOR LEAVE AND LICENCE

THIS AGREEMENT OF LEAVE AND LICENCE is made this on the.........................


2018 (Two Thousand Seventeen) BETWEEN SRI DEBOJYOTI CHOUDHURY son of Late
DIBESH CHOUDHURY and PAPIYA CHOUDHURY wife of DEBOJYOTI CHOUDHURY, and
hereinafter referred to as the “Licensors” (which expression shall unless excluded by
or repugnant or contrary to the context be deemed to include their heirs, executors,
administrators, and legal representatives) of the ONE PART

AND
Mr. Aritra Kabiraj ,Son of Mr Tapash Kabiraj, residing at 1/B Jatin Chandra Road ,
Lalpur , Ranchi - 834001, working at Cognizant Technology Solutions  at Malancha
Road, Malancha Main Nagar, Bantala, Kolkata, West Bengal – 743502,
AND
Mr. Anurag Sarkar, son of Mr. Shekhar Chandra Sarkar, residing at house no.28,
sector2 street3, professor colony, Raipur, Chhattisgarh-492001 , working at HILTI India
Private Limited, at DA-77, sector1, Salt Lake, Kolkata – 700 064, hereinafter called the
“LICENSEE” (which expression shall unless excluded by or repugnant or contrary to
the context be deemed to include their heirs, executors, administrators and legal
representatives of the OTHER PART.
WHEREAS the Licensors are lawful Owners of and otherwise well sufficiently
entitled to and seized and possessed of Flat No.105 comprising of Three Bed Rooms,
Two Bathrooms, One Drawing-cum-Dining, One Kitchen and three Balconies on the
1st floor of TOWER 4 , VISTAS , UNIWORLD CITY, NEWTOWN, KOLKATA- 700 156
,with One Car Parking.
AND WHEREAS the Licensee being in need of premises for residential
accommodation approached the Licensor to give on license basis the above
mentioned Flat for occupation and use by the Licensee, which the Licensor has
agreed to do for the period of 11 (Eleven) Months commencing from the 1 st day of
July 2018 at a Monthly Licence Fee on the terms and conditions hereinafter
mentioned.
NOW THIS AGREEMENT WITNESS AND IT IS HEREBY AGREED BY AND
BETWEEN THE PARTIES HERETO as follows:-
1) The Licensors hereby agrees to give on agreed compensation to the Licensee
and the Licensee hereby accepts from the Licensor the Licensed Premises
being Flat No.105 , TOWER 4 ,VISTAS , UNIWORLD CITY,NEWTOWN, KOLKATA-
700 156 .
2) That the Licence hereby granted shall unless withdrawn, cancelled or revoked
earlier under any provision of this agreement shall remain in force for the
period of 11 (Eleven) months only.
3) The period of Licence will be for 11 (Eleven) months commencing from 1 st day
of July 2018 being renewable for further of 11 (Eleven) Months.
4) The Monthly Licence Fee for occupation and use of the Licenced premises
shall be Rs.23,000/- (Rupees Twenty Three Thousand ) only per month
including the Maintenance charge. The said Monthly Licence Fee shall be paid
in advance by the Licensee on or before the 7 th day of each Calendar Month
(English Calendar).
5) The Security Deposit of Rs. 44,000/- (Rupees Forty Four Thousand) only paid
by Licensee to Licensor at the commencement of the Leave and Licence
Agreement for the period of 1st July 2018 to 30th May 2019 shall continue to be
held by the Licensor as and by way of Security Deposit, which will be refunded
without any interest thereon by the Licensor to the Licensee on the expiry or
sooner termination/expiry of this Agreement after adjusting the dues and
damages, if any.
6) In addition to the Monthly Licence Fee stipulated above the Licensee shall pay
all charges for Electricity, Gas, Telephone or other amenities used in the
Licenced premises as shown by separate Meter and/Billed separately by the
Competent Authorities. The Building/Complex Maintenance charges alone will
be paid by the Licensors.
7) The Licensors shall pay all dues and all existing and future rates & taxes levied
by or payable to the Municipality or government or any other Local or Public
Body or Authority in respect of the Licenced Premises.
8) The Licensee shall use the Licenced Premises only for residential purpose and
that too with taking due care and caution and shall keep and maintain the
same in good order and condition.
9) The Licensee shall neither do any act or deed which may cause nuisance and
annoyance or cause injury to the Licensor or to the other occupants of the
Licenced Premises in the building wherein the Flats are situated, nor to carry
on any activity in the Licenced Premises of an unlawful or immoral or illegal
nature or constituting an offence or being in contravention of any statute or
law of Country.
10)The Licensee shall not assign, transfer or part with the possession of the
Licenced Premises or any portion thereof to any other person or party.
11)On termination/expiry of this Agreement the Licensee shall remove all his
belongings from the Licenced Premises and handover peaceful vacant
possession to the Licensor in the original condition.
12)The Licensor herein will refund the Security Deposit as mentioned in the
clause 5 to the Licensee after the termination/expiry of this Agreement.
13)That both the Licensor and Licensee shall during the subsistence of this
Agreement have the option to terminate this Agreement by giving 2 (Two)
Months’ Notice to the other party in writing and this Agreement will
accordingly stand terminated on the expiry of the said period of Notice.
14)The Licensee shall abide the Rules and Regulations, if any, of the Society of
“UNIWORLD CITY” Complex.
15) The house and the furniture need to be handled and maintained properly.

4) 1 Washing machine.
5) 1Sofa Set
6) 1Centre Table
7) 1 Standing Fan
IN WITNESS WHEREOFTHE Licensor and the Licensee hereunto set and subscribed
respective hands and seals the day, month and year first mentioned above.
