Statement of the grievance (include events/conditions of the grievance/persons responsible):


Per Executive Order 20-94, which states, “…. implement learning models that do not require
teachers to provide instruction simultaneously to students who are in-person and those that are
learning remotely.”, this implies that educators should be supplied distinct and separate planning
and preparation time in order to provide instruction to students working in “dual modalities”.
Special Education and ELL educators are being expected to service students both in-person and
who are working remotely and do so with the same schedule while being provided no extra time
to plan and deliver both sets of instruction to separate groups of students on their caseloads.

Per Executive Order 20-94, which states, “… must count 30 minutes per day for teacher
preparation… time is in addition to a school district’s…. teacher prep time established….”, this
directs districts to provide educators with an additional 30 minutes of prep-time above and
beyond what is already provided for the EML CBA. Prep-time in the EML CBA (Article 14,
Section 4) is defined as, “… a block of time during the student contact day for the teacher’s own
professional use. The teacher shall not be responsible for classroom supervision, building
activities, or other basic day duties during their preparation time.” At the Middle Level, a
distance learning model schedule has been implemented that does not meet the directive included
in EO 20-94, nor meets the EML CBA definition of prep-time. The job expectations the district
has placed on educators forces them to “multi-task” on other duties as required by the district
rather than being able to exercise “their own professional use” and use this time to plan and
prepare instruction. It is also problematic that in a review of the published Middle Level DL
schedule, one is unable to clearly identify where the extra 30 minutes of prep-time per day is
included.

1. The District will provide Special Education and ELL educators with schedules that
provide distinct and separate times during which to service in-person versus remote
learning students. This separation of time will also include use of additional prep-time
needed to service students in “dual modalities”. (Note: development of these schedules
should be an administrative duty and this task should not be placed as additional
workload upon these staff members.)

2. The District will implement the “suggested changes” provided by EML on 12.10.20 to
their distance learning model by January 4th, 2021.
