L145 of June 13, 1977 Pacer nat COUNCIL DIRECTIVE of 17 May 1977 on the approximation of the laws of the Member States relating to motor-vehicle towing-devices (77/389/EEC) [As amended by Directive 96/64/EC ‘THE COUNCIL OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Economie Community, and in particular Anticle 100 thereof, Having regard to the proposal fiom the Commission, Having regard to the opinion of the European Parliament “!, Having regard to the opinion ofthe Economie and Social Committee ®, ‘Whereas the technical requirements which motor vehicles must satisfy pursuant to national laws relate inter alia to their towing-devices; Whereas those requirements differ from one Member State to another; whereas itis therefore necessary that all Member States adopt the same requirements either in addition to or in place of their existing rules, in order, in Particular, to allow the EEC type-approval procedure, which was the subject of Couneil Directive 70/156/EEC of 6 February 1970 on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers ®, to be introduced in respect of each type of vehicle; Whereas approximation of the national laws relating to motor vehicles entails mutual recognition by the Member States of the checks carried out by each of them on the basis of the common requirements, HAS ADOPTED THIS DIRECTIVE: ARTICLE 1 For the purposes of this Directive, ‘vehicle’ means any motor vehicle intended for use on the road, with or without bodywork, having at least four wheels and a maximum design speed exceeding 25 krv/h, with the exception of vehicles which run on rails and of agricultural and forestry tractors and all mobile machinery. 1 O1NoC76,74.1975,p 37 © OINoC 24a, 29:101998, © OINDL 42,332 1970,p t TITLE: Motor Vehicles ISSUE: 1 TTIS89IEEC Towing Devices Oct/1997 PAGE: 1 COUNTRY :E.6 © INTEREUROPE ORIGINAL :O.J. L145 of June 13, 1977 ees ARTICLE 2 ‘Member State may refuse to grant EEC type-approval national type-approval of a vehicle on grounds relating their towing-devices, if these satisfy the requirements out in the Annex Il. ARTICLE 3 No Member State may refuse registration or prohibit the sale, entry into service or use of a vehicle on grounds relating to their towing-devices if these satisfy the requirements set out in the Annex Il to this Directive. ARTICLE 4 ‘Any amendments necessary to adjust the requirements of the Annexes to take account of technical progress shall be adopted in accordance with the procedure laid down in Article 13 of Council Directive 70/1 56/EEC. ARTICLE 5 1, Member States shall put into force the provisions necessary to comply with this Directive within 18 months of its notification and shall immediately inform the Commission thereof. 2. Member States shall ensure that the texts of legislative provisions which they adopt in the area governed by this Directive are communicated to the Commission. Regulations Lid 1997 ANNEX I ADMINISTRATIVE PROVISIONS FOR TYPE-APPROVAL, APPLICATION FOR EC TYPE-APPROVAL OF A VEHICLE TYPE, ‘The application for EC type-approval pursuant to Article 3 (4) of Directive 70/156/EEC of a vehicle type with regard to its towing devices shall be submitted by the manufacturer, ‘A model forthe information document is given in Appendix 1 ‘The following must be submitted to the technical service responsible for conducting the type-approval tests 4 vehicle representative of the type to be approved. GRANTING OF EC TYPE-APPROVAL OF A VEHICLE TYPE If the relevant requirements are satisfied, EC type-approval pursuant to Article 4 (3) and, if applicable, 4 (4) of Directive 70/156/EEC shall be granted. A model for the EC type-approval certificate is given in Appendix 2. ‘An approval number in accordance with Annex VII to Directive 70/1S6/EEC shall be assigned to each type of vehicle approved. The same Member State shall not assign the same number to anather type of vehicle. MODIFICATIONS OF THE TYPE AND AMENDMENTS TO APPROVALS In the case of modifications of the type approved pursuant to this Directive, the provisions of Article 5 of | Directive 70/156/EEC shall apply CONFORMITY OF PRODUCTION Measures to ensure the conformity of production shall be taken in accordance with the provisions laid down in Article 10 of Directive 70/1 56/BEC. L 258 of October 11, 1996 eet COMMISSION DIRECTIVE 96/64/EC of 2 October 1996 adapting to technical progress Council Directive 77/389/EEC on the approximation of the laws of the Member States relating to motor vehicle towing devices (Text with EEA relevance) ‘THE COMMISSION OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Community, Having regard to Council Directive 77/389/EEC, of 17 May 1977 on the approximation of the laws of the Member States relating to motor vehicle towing devices , and in particular Article 4 thereof, Whereas Directive 77/389/EEC is one of the separate directives of the EC type-approval procedure which has been established by Directive 70/1S6/EEC “), as last amended by Directive 96/27/EC %); whereas, consequently, the provisions laid down in Directive 70/156/EEC relating to vehicle systems, components and separate technical units apply to this Directive; Whereas, in particular, Articles 3 (4) and 4 (3) of Directive 70/1 56/EEC necessitate that each separate Directive has attached to it an information document incorporating the relevant items of Annex I to that Directive and also a ‘ype-approval certificate based on Annex VI thereto in order that type-approval may be computerized; Whereas these amendments relate only to the administrative provisions contained in the Directive; whereas itis not necessary therefore to invalidate existing approvals to the Directive nor to prevent the registration, sale and entry into service of new vehicles covered by such approvals; Whereas the measures provided for in this Directive are in accordance with the opinion of the Committee for Adaption to Technical Progress established by Directive 70/1S6/EEC, HAS ADOPTED THIS DIRECTIVE: ARTICLE 1 1. ARTICLE 3 1, Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by | October 1997. They shall forthwith inform the Commission thereof. When Member States adopt these provisions, these shall contain a reference to this Directive or shall be accompanied by such reference atthe occasion of their official publication. The procedure for such reference shall be adopted by the Member States. 2, Member States shall communicate to the Commission the texts of the main procedure of the national law that they adopt in the field governed by this Directive. ARTICLE 4 ‘This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Communities ARTICLES This Directive is addressed to the Member States.
