No person shall be deprived of life liberty and property without due process of law.

Judicial power shall be vested in one Supreme Court and in such lower courts as may be
established by law.
Judicial power includes the court of justice to settle actual controversies involving rights which
are legally demandable and enforceable and to determine whether or not there has been grave
abuse of discretion amounting to lack or excess of jurisdiction on the part or instrumentality of
the Government.

Under the Rules on Civil Procedure as Amended, the grounds for a motion to dismiss are the
following:

1. Lack of jurisdiction over the subject matter;

2. Res Judicata;
3. Prescription or Statute of Limitations;
4. Litis Pendentia.

Under the Rules on Civil Procedure as Amended, any action involving property, rights or any
interest therein which amounts to not exceeding 20,000php outside Metro Manila and 50,000php
within Metro Manila are within the jurisdiction of the Municipal Trial Court where the property is
situated or any portion thereof; exceeding the said amount lies in the jurisdiction of Regional Trial
Court.

Under the jurisprudence, VAWC is a transitory crime. Hence, the jurisdiction thereof is where
the crime or any element of the crime is committed.

Here, AAA committed the offense in Bataan, Quezon and Manila. Hence, the action may be
brought to any of the places where AAA committed VAWC.
