Republic Act 11032 Ease of Doing Business

1. Section. 7. Zero-Contact Policy- I think it would be better if the estimated date or year the software to
be used will be launched and available by the DICT , because it has been three years since the enactment
of the law, but I did not notice any software that was used.

2. Section 9b. If the application or request for license, clearance, permit, certification or authorization
shall require the approval of Sangguniang Bayan, Sangguniang Panglungsod or the Sangguniang
Panglalawigan- shall be given 45 working days to act on a request, which can be extended for another 20
working days

 To really expedite the action on requests, the following are my suggestions;

Sangguniang Bayan- shall be given 15 working days, which can be extended for another 5 days
Sangguniang Panglungsod - shall be given 25 working days which can be extended for 10 days
Sangguniang Panlalawigan- shall be given 30 working days which can be extended for 15 days

3. Sec. 9b. In the cases where the cause of the delay is due to force majeure or natural or man-made
disasters which result to damage of documents and or system failure of the computerized or automatic
processing, the prescribed processing time mandated in this Act shall be suspended and appropriate
adjustments shall be made

 I would suggest that though the prescribed processing time is suspended and appropriate
adjustments should be made, I think it would be better if a particular number of working days
must be specified that the request may be attained to. In this case, I suggest that the request
shall be acted upon within and not later than 60 working days so the corresponding government
agencies shall find a way to solve the cause of delay

4. Written notice on a disapproval of requests. I would suggest that the prescribed time for disapproval of
request be it complex or simple shall be uniformed for three working days. This because upon the receipt
of the agency of the request, I think they could already identify if they can commit to cater or accept the
request of the concerned, so they have the capacity to decide immediately and inform the requesting
party.

Ra. 1178 of 2002 Barangay Micro Business Enterprise (BMBE)

1. Section 4. Registration of BMBEs. The LGUs shall issue the certificate promptly and free of charge.
However to defray the administrative cost of registering and monitoring the BMBEs, the LGUs may charge
a fee not exceeding 1000 pesos only

 Under this Section, I would suggest that for payments, it should be proportional to the current
capitalization of the BMBE. Thus the ff. fees would be my suggestion

1 Million pesos and Below Capitalization -- .05 % (.0005)


Above 1 Million-3 Million Pesos Capitalization -- 1,000.00

2. Section 4. As much as possible, BMBES shall be subject to minimal bureaucratic requirements and
reasonable fees and charges

 I would suggest that those bureaucratic requirements and reasonable fees and charges should be
indicated in the law to prevent the LGUs from imposing unnecessary requirements and charges.

3. Section7. Exemptions from taxes and Fees. The LGUs are either to reduce the amount of local taxes,
fees and charges imposed or to exempt the BMBES from local taxes, fees and charges

 I would suggest in this Section, it would be better if the law only stated that the LGU shall only
allowed to reduce the amount of local taxes, fees and charges to be imposed to the BMBE
because exempting them from taxes would also be of disadvantage at the side of the LGUs

4. I would also suggest that it would be better if there is a provision for Easy credit for the registered
BMBEs from government banks, the standard procedure and requirement should be stated in order for
them to discourage loaning to bombays or illegal lenders who offers high interest rate.
