Section 4.(c) of the Energy efficiency and Conservation Act and its Implementing Rules and
Regulations defines Designated Establishment (DE) to be a private or public entity in the
commercial, industrial, transport, power, agricultures, public works, and other sectors identify
by the department of Energy (DOE) as energy intensive industries based on their annual
energy consumption in the previous year or an equivalent annual index.

1. CLASSISIFICATION OF DESIGNATED ESTABLISHMENTS

Designated establishments shall be classified as follows:

Classification of Designated Annual Energy Consumption threshold


Establishments for the Previous Year
Other Designated Establishment 100,000 kWh but less than 500,000 kWh
Type 1 Designated Establishment 500,000 kWh to 4,000,000 kWh
Type 2 Designated Establishment More than 4,000,000 kWh

How to determine the Classification for designated establishment?

The Classification for designated establishment shall be based on the


annual energy consumption threshold express in kWh equivalent (for this
purpose DOE will use kWhE) as the standard unit of energy. During normal
business operation, industrial, commercial and transport establishments
may be using a mixed source of energy, and therefore all of these energy
sources will be converted and expressed into only one standard unit of
energy which is kWhE. Other countries are using Liters of Oil Equivalent
(LOE), Tons of Oil Equivalent (TOE), or Terra-Joule Equivalent (TJE).

Step 1: Fill-out Part A of the Annual Energy Utilization Consumption Report


(AEUR) according to the company’s nature of business.

a. For Commercial establishments, use the attached EEC Form 4A (AEUR


For Commercial DEs)

b. For Industrial establishments, use the attached EEC Form 4B (AEUR For
Industrial DEs)

c. For Transport establishments, use the attached EEC Form 4C (AEUR


For Transport DEs)

d. For Other establishments, use the attached EEC Form 4D (AEUR For
Other DEs)

The total energy consumption express in kWhE unit will determine the company’s
energy consumption threshold and classification.

Step 2: Proceed filling-out the other Parts of the AEUR Form according to the
company’s nature of business.

2. OBLIGATIONS OF THE DESIGNATED ESTABLISHMENTS

2.1 The Type 1 and Type 2 Designated establishments shall have the following
obligations:

a. Integrate an energy management policy into the business operation
based on ISO 50001 Energy management System or any similar
framework;
b. Set-up programs to develop and design measures that promote energy
efficiency, conservation, and sufficiency that may include installation of
renewable energy technologies;
c. Set up annual targets, plans, and methods of measurements and
verification for the implementation of energy efficiency and conservation
projects;
d. Keep records on monthly energy consumption data and other energy-
related data;
e. Improve average specific energy consumption in accordance with the
annual reduction targets to be established by the DOE in the National
Energy Efficiency and Conservation Plan;
f. Submit an annual energy consumption and conservation report to the
DOE by the 15th of April of every year;
g. Conduct an energy audit once every three (3) years;
h. Employ a Certified Energy Conservation Officer (CECO) for Type 1
designated establishments, and Certified Energy Manager (CEM) for
Type 2 designated establishments.

2.2 Other Designated establishments shall have the following obligations:

a. Submit an annual energy consumption report;


b. Integrate an energy management system policy into their business
operation based on ISO 50001 Energy management System or any
similar framework; and
c. On a voluntary basis, submit themselves to external energy audit or
quality control assessment to assist them in their energy planning and
management.

3. ONLINE REPORT SUBMISSION USING DOE WEB-BASED PLATFORM

The DOE will issue a separate Guidelines for the online report submission through
web-based platform not later than the 30 th December 2020.

4. REPORTORIAL COMPLIANCE WHILE IN-TRANSITION TO ONLINE SUBMISSION

The DOE offers an alternative method of reportorial compliance to all designated


establishments while awaiting the completion of the web-based platform. In this
regard, all designated establishments have to submit the following reports to the
DOE herein enumerated below:

4.1 ANNUAL ENERGY EFFICIENCY AND CONSERVATION REPORT (AEECR)

The Annual Energy Efficiency and Conservation Report (AEER) describes the
establishments’ energy efficiency and conservation plans, programs, activities and
projects implemented and on-going including the target value of investment and
savings or improvement in productivity in lieu of energy saving.

For this purpose, designated establishments shall have to submit their


Annual Energy Efficiency and Conservation Report using the attached
AEECR Form relative to the establishments’ nature of business for the Fiscal
Year 2019-2020 (covering the period 1 April 2019 to 31 March 2020).

In filling-out the AEECR Form, observe the following portions of the report:

a. Energy Conservation Projects and Measures - This part requires the


specification of projects undertaken by the company.

1. On-going Projects – These are projects that are already in-place


during the reported year but are not yet completed by the time the
report is submitted to DOE.

2. Completed Projects – These are projects that has already ended


by the time that the report is submitted. This shall also establish
the baseline investment cost on EEC projects, including
technology used, or process improvement done. The designated
establishment are encouraged to attach a separate documents to
discuss this.

3. Recommended Energy Conservation Measures – These are


specific energy efficiency and conservation measures that may be
carried out or implemented in the company/establishment.

b. Target and Actual Energy Consumption

1. Actual Energy Consumption for the last Five (5) years – For each
reported year (Year – 5, Year – 4, etc), the ACTUAL CONSUMED
ENERGY should be provided by the establishment starting in 01
April 2015 to 31 March 2020 (or FY 2016 to FY 2020). If there
are other Fuel Type used outside of those identified, just indicate
it in Items 13 – 15.

2. Energy Consumption for the Current Year – The designated


establishment shall provide the target energy consumption vis-à-
vis its actual consumption. This shall be computed on a yearly
basis starting from 01 April of the previous year to 31 March of the
current year (FY 2020). If there are other Fuel Type used outside
of those identified, kindly indicate it in Items 13 – 15.

c. Target Energy Consumption in Production or Activity Area – This section


shall define the amount of required energy per activity of an
establishment.

d. Specific Energy Consumption (SEC) – The SEC of a product, or activity


area, is the ratio of the actual energy consumption per unit product or
activity. This is the specific energy consumption which is to be filled out by
DOE.

4.2 ANNUAL ENERGY UTILIZATION REPORT (AEUR)

All designated establishments shall submit their Annual Energy Utilization Report
(AEUR) which covers the report of utilized energy for the fiscal year (FY) starting
from 01 April of the previous year to 31 March of the current year. AEUR will
establish the baseline average energy consumption of the company as an entity
and as part of the sector where it belongs.

Since there is a need to establish the baseline average energy consumption of the
company, all designated establishments are required to submit their AEUR for the
last five years or from FY 2016 to FY 2020 , as applicable. ONE FILE FOR EACH
YEAR. Where:

• FY 2016 (1st of April 2015 to 31st of March 2016)


• FY 2017 (1st of April 2016 to 31st of March 2017)
• FY 2018 (1st of April 2017 to 31st of March 2018)
• FY 2019 (1st of April 2018 to 31st of March 2019)
• FY 2020 (1st of April 2019 to 31st of March 2020)

In filling-out the report form, observe of the following portions of the report:

A. COMMERCIAL AND TRANSPORTATION DESIGNATED


ESTABLISHMENTS

1. Energy Consumption in Product Line, Business, or Activity Area

This part gives an overview of the energy consumption of the whole facility.
The quantities reported in this section should be the total energy consumption
for all activities and services in the industrial sector including generation of
electricity and others.

a. Energy Source - Items listed under this column are electricity,


steam and other energy sources consumed as fuel.

b. Unit - The column specifies the units of measurement which should


be used when reporting the consumption of the various energy
sources.

c. Quantity - This is the company’s overall consumption of a particular


energy source.

d. Conversion Factor - This refers to column 4 of Part A for the


conversion factor to Liters of Oil Equivalent (LOE). Values under
this column are specified by DOE - Energy Efficiency and
Conservation Division.

e. Liters oil Equivalent (LOE) - The number of LOE (standard gross


heating value: 41,800 KJ/l) that will liberate an amount of heat equal
to the amount generated from the actual energy source used. The
source may be liquid, solid or gaseous fuels and/or electricity

2. Electricity Generation

This part consists of generating units, their capacity and fuel type, as well as
the consumption, and hours of operation and maintenance runs of
generators.

a. Generating Units - This column identifies the electricity generators in


the facility. The brand of the generator may be specified.

b. Capacity - This is the capacity of a generating unit in Kw.

c. Fuel Type - This pertains to the classification of fuel used by different
generating units.

d. Consumption Quantity - This is the amount of fuel used by different


generating units.

e. Hours of Operation - These are the numbers of hours in which the


generators were operated. This should include the time spent in
operating the unit even for maintenance/test run purposes only.

3. Electricity Utilization at Auxiliary Service Area

This refers to an area inside the building or outside but within the perimeter
of the main building such as utility area (electrical/mechanical room,
generator set room, carpentry room, stockroom, etc.), motor pool,
perimeter lighting area, etc. This area of the building provide operational
support to the core business function of the building or establishment.

4. Purchased Electricity - The total quantity of electricity purchased by the


establishment from the distribution utility.

5. Electricity and Steam/Hot Water Utilization

a. Production - Refers to the amount of electricity or steam directly


used for production operations.

b. Auxiliary Services - The portion of the electricity and steam


consumption that went into offsite services such as maintenance
shops, laboratories, perimeter lighting, administrative offices,
canteens and staff houses. The consumption for production should
not be included.

c. Losses - This is the amount of energy source losses in the Energy


Consumption

6. Business/Activity Area – Refers to the total area of congruent floors of a


building.

For example, in the case of an Office Building, Electricity Consumption


would have to be recorded based on the following:

a. Area 1 – May refer to the floor area of the entire 10 floors of the
building that are occupied by various offices.

b. Area 2 – May refer to the floor area of the basements.

c. Area 3 – May refer to the floor area of the parking floors.

7. Steam/Hot Water Generation

The information in this portion is the facility’s total production of steam,


whether for commercial operation or any other purpose.

a. Boiler Units - This column identifies the different boilers in the
facility. Brand and model name may be given.

b. Capacity - This is the capacity rating of the different boiler units, in


kg/hr.

c. Fuel Type - This pertains to the classification of fuel used by each


boiler unit of the facility.

d. Consumption Quantity - This is the amount of fuel used by different


boiler units. Any convenient unit of measurement may be used
provided the said unit is specified.

e. Hours of Operation - The number of hours in which the boilers are


operated.

f. Steam Generated - This is the generated steam in metric tons


corresponding to the reported energy consumption. This should be
expressed in terms of equivalent evaporation from and to 100 oC at
1 atm.

8. Energy Consumption in Transportation – This refers to the energy


consumed by vehicles owned by the company for various activities such as
hauling, delivery, etc.

9. Waste Oil Utilization – This refers to used oil which deteriorates after being
used for a specific period of time in a machine.

B. INDUSTRIAL DESIGNATED ESTABLISHMENTS

1. Energy Consumption in Product Line, Business, or Activity Area

This part gives an overview of the energy consumption of the whole facility.
The quantities reported in this section should be the total energy consumption
for all activities and services in the industrial sector including generation of
electricity and others.

a. Energy Source - Items listed under this column are electricity,


steam and other energy sources consumed as fuel.

b. Unit - The column specifies the units of measurement which should


be used when reporting the consumption of the various energy
sources.

c. Quantity - This is the company’s overall consumption of a particular


energy source.

d. Conversion Factor - This refers to column 4 of Part A for the


conversion factor to Liters of Oil Equivalent (LOE). Values under
this column are specified by DOE - Energy Efficiency and
Conservation Division.

e. Liters oil Equivalent (LOE) - The number of LOE (standard gross

3. Electricity Utilization at Auxiliary Service Area

This refers to an area outside of the Production Process Area where


electricity was used such as utility area, motor pool, staff/guests house,
etc. whose function is to provide technical or administrative support to the
main business core of operation of the facilities.

4. Purchased Electricity - The total quantity of electricity purchased by the


establishment from the distribution utility.

5. Electricity and Steam/Hot Water Utilization

a. Production - Refers to the amount of electricity or steam directly


used for production operations.

b. Auxiliary Services - The portion of the electricity and steam


consumption that went into offsite services such as maintenance

8. Energy Consumption in Transportation – This refers to the energy


consumed by vehicles owned by the company for various activities such as
hauling, delivery, etc.

9. Waste Oil Utilization – This refers to used oil which deteriorates after being
used for a specific period of time in a machine.

10. Production per Product Line or Activity

Refers to the product being produce from single to multiple products. For
example, raw sugar, refined sugar, and distillery (alcohol products) in one
integrated processing plant facilities. However, in the case of integrated-
mining for the production of various cement products, the initial production
starts with an activity such as: ore extraction, grinding, drying, clinkering,
cement grinding, and packing (final product of 50 kg per bag of cement).

5. REGISTRATION OF DESIGNATED ENERGY CONSERVATION OFFICER (ECO)
AND DESIGNATED ENERGY MANAGER (EM)

All identified and designated Energy Conservation Officer (ECO) and Energy Manager
(EM) should be endorsed by their office through a letter including the submission of all
the required documents by DOE.

6. SUBMISSION OF REPORTS AND OTHER DOCUMENTS

All reports and its attachments should be submitted to DOE - Energy Utilization
Management Bureau (EUMB) through an endorsement letter. The addressee shall be:

7. SIGNATORY

All documents (letter, forms, and supporting documents) shall be preferably prepared
by a competent individual who has knowledge in energy management or in assessing
energy efficiency and conservation projects.

All the documents shall be approved and signed by the head of the company or anyone
with equivalent authority on the matter.

8. CONFIDENTIALITY

All submitted data and information to the DOE will be treated with utmost confidentiality
and will only be used for the purpose stipulated under the EEC Act. No portion of the
reports or any documents under the submission shall be shared to any person, entity,
or organization unless prior approval was provided by the concerned company.
