Vide reference 3 & 4° cited, the commissioning activities for package 17-02 were completed by operating the system continuously for 72 hrs and established the guaranteed production of 100% ining with contact clause no. 25 of GCC. Referring clause No. 13.2.2 of GCC “The Bank Guarantee shall automatically become null and void after 12 months (ie., upto defect liabity period) after issue of ‘Commissioning Certificate’. Secondly, referring clause no. 30.2, “The Defect Liability shall be 12 months from the date of commissioning mentioned in the Commissioning Certificate or 18 months from the date of Preliminary Acceptance Certificate (PAC), which-ever is earlier, provided the delay in Commissioning after PAC is not due to the reasons attributable to the Contractor. It is known fact that, Clients have issued PAC on 2-3-2028, and the lock down due epidemic Covid 19 was declared by the Govemment in third week of March '2020. During that period, GO! has issued notification that, the ongoing projects shall be extended for a duration of 6 months. Then, step-by-step relaxation of lack down and the conveyance facities was made available to the public only from November 2020 only. After noticing the relaxation of lockdown by GOl, the vendors’ manufacturers desired to depute their manpower for completing the works assigned! awarded to them. Inspite of major hurdle of manpower availability and meager transportation facilities, within 3-4 months of lock down relaxation, the package 17-02 is commissioned, to the satisfaction of the Clients, ‘Therefore, MEIL-KCCL Consortium pleads to the Clients to consider for releasing the Bank Guarantees ‘within 18 months for the date of issuance of PAC referring clause 30.2 of GCC. In view of the above, and the reasons of “Catastrophic situation due to outbreak of Covid-19" itis requested to arrange for release of BGs by September 3° 2021, Le., 18 months from the date of Preliminary Acceptance Certificate (PAC) Thanking you and assuring the best of our services at all times.
