What I Can Do

1. According to Richard Stim, Attorney (n.d.), when teachers photocopy limited portions of written
works for classroom use, it is normally acceptable. Moreover, he said that it is also fair and legal
if it is used for nonprofit educational purposes. Therefore, Marissa photocopying the newspaper
article is considered legally fair and reasonable.

2. The only fair and reasonable action in the situation is when the other teacher tells her students
that they must get permission to use the copyrighted images in their own work. If you want to
use an image that’s copyright protected, first get a license or permission to use it from the
creator (Pixsy n.d.).

3. It is not uncommon to receive no response to your request from a copyright owner. Copyright
owners do not have to respond a request for permission to use a copyright protected work, and
their failure to respond does not constitute permission (Washington University in St. Louis n.d.).
Therefore, using images from the Internet and samples of Magalona’s music in her project is not
fair because she did not get a response upon contacting the record company to request
permission.
