GS.R.1361(E)—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were
Published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide
notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 1112 (E). dated.
the 29% August, 2017 in the Gazette of India, Extraordinary, Par-lI, Section 3, Sub-section () inviting objections and
suggestions from affected persons before the expiry of the perie! of fifteen days from the date on which copies uf the
Gazette containing the said notification were made available to pl
‘Whereas, copies of the said Gazette notification were made available to the public on the 29" August, 2017;
‘And whereas, objections and suggestions received from the public in respect of the said draft rules were
considered.;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of
1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules,
1989, namely: —
1. (1) These rules may be called the Central Motor Vehicles (11 Amendment) Rules, 2017,
(2) They shall come into force from the date of their publication in the Oficial Gazette
2, In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the principal rules), in rule 47, in sub-rule
1, after clause (i), the Following clause shall be inserted, namely: -
Cia) proof of fiument of FASTag specified in rule 138A
3. Inthe principal rules, for the rule 138A, the folowing rue shall be substituted, namely: -
“138A, Fitment of FASTag.- Categories M and N motor vehicles sold on and after the I"" December, 2017, shall be fitted
with FASTag as may be specified by the Central Government, from time to time, by the manufacturer of the vehicle or
its authorised dealer, as the ease may be:
Provided that in case of any vehicle which is sold inthe form of drive-away-chassis without windscreen, FASTag shall
be fitted on the windsereen by the vehicle owner before the registration of such vehicles,
Explanation. ~ For the purposes of this rule, FASTag means an onboard unit (transponder) or any such device fitted on
the front windsereen of the vehicle,”
