Justice Arun Mishra to be appointed as the

head of National human Rights Commission,


another step towards favouritism.
This appointment by the selection panel to appoint
Justice Arun Mishra over three other former chief justices
looks a lot like the controversies that came up after ADM
Jabalpur. Is the nation moving towards a priority driven
government and appoint system?
This appointment is a matter of serious debate as the Idea of Separation of
Power itself is being questioned by the recent appointments by the ruling government.
He would be the first ever non CJI to head the NHRC in 27 years. The latest
controversies regarding Justice Mishra’s statement on PM Modi during the
International Judicial Conference 2020, stating him as an “internationally acclaimed
visionary who could think globally and act locally”.
While this statement may look harmless, this statement strongly goes against
the idea of separation of powers in India. As this statement strongly suggests a close
proximity between the executive and the judiciary, it was condemned by the Supreme
Court Bar Association (SCBA). After this roller-coaster ride this appointment strongly
suggests a new era of Favouritism to act between the executive and the judiciary
which will in time subvert Democracy. The only short comings here is that these
appointments are done within the limits of Executive powers and Discretion.
There is no bar or limitation levied on the appointment of the NHRC head to be
from certain background or qualification has strongly limited the appointment of the
head to the discretion of the selection committee. Also, the strong presence of the
ruling party in the committee has made the words of the opposition party
representative, Mallikarjun Kharge fell in deaf ears. His objection to the lack of
consultation was referred still it was not given any weightage. He has suggested for
the panel meet again in a week’s time to consider some names from the SC, ST and
minority communities but hopes are not high that this will be heard.
Appointments of this kind are starting to strongly pop up in the recent times,
this seriously mark a dark time that is ahead of us where democracy itself is used to
subvert democracy. India as a nation is in a dire need for an ideological upheaval.
