Baguio Water District (BWD) v. Hon. Cresencio B. Trajano in his official capacity as the
Director of the Bureau of Labor Relations of the Ministry of Labor and Employment, and
Baguio Water District Employees Labor Union

Facts:
Baguio Water District is a quasi-public corporation performing public service and supplying
public wants. Its regular rank and file employees filed for certification election which was granted
by the Med-Arbiter. Hence, the appeal by BWD claiming that the rank and file employees are
not entitled to collective bargaining because they are covered under the Civil Service Laws,
being government employees.

Issue:
Whether or not the regular rank and file employees of BWD are entitled to collective bargaining.

Held:
No, the regular rank and file employees of BWD are not entitled to collective bargaining. The
amendatory law Presidential Decree 1479 of Section 25 of Presidential Decree 198, granting
these employees to collectively bargain, became silent as to such provision. The employees of
BWD, by virtue of the amendatory law, became government employees who shall be governed
by the Civil Service Law.
