Legal Documents refers to a deed, agreement, title, paper, receipt, or other written instrument used to

prove a fact.

Affidavit- a formal sworn statement of fact, signed by an affiant and witnessed by a notary public.

Judicial Affidavit- Affidavits submitted by the parties which shall take place of their witnesses’ direct
testimonies.

CONTENTS OF JUDICIAL AFFIDAVIT

(WiLS-QSJS)

1. The name, age, residence or business address, and occupation of the witness.
2. The name and address of the Lawyer who conducts or supervises the examination of the witness
and the place where the examination is being held;
3. A statement that the witness is answering the questions asked of him, fully conscious that he
does so under oath, and that he may face criminal liability for false testimony or perjury;
4. Questions asked of the witness and his corresponding answers, consecutively numbered, that:
a. Show the circumstances under which he testifies,
b. Elicit from him those facts which are relevant to the issues that the case presents; and
c. Identify the attached documentary and object evidence and establish their authenticity in
accordance with the Rules of Court;
5. The signature of the witness over his printed name;
6. A Jurat with the signature of the notary public who administers the oath or an officer who is
authorized by law to administer the same; and
7. Sworn attestation of the lawyer.

Jurat- part of an affidavit where the officer certifies that the same was sworn before him.

5. Description of Property: specify the technical description that appeared in the TCT or OCT;
6. Fact of ownership; and

CONTRACT OF LEASE OF REAL PROPERTY (VAP

1. Venue and title;


2. Announcement;
3. Personal Circumstance of the Lessor and the Lessee
4. Ownership of Property
5. Agreement to lease the property;
6. Conditions: considerations, term of lease exclusive of property, repairs, taxes, utilities, deposit,
right of first refusal, venue of action (optional), arbitration clause; and
7. Joint acknowledgment.
