In this Bid Document and associated documentation, the following terms shall be
interpreted as indicated below:

SECTION- II: INVITATION FOR BIDS

1. Madhya Pradesh Laghu Udyog Nigam Limited (MPLUN) is a Govt. of Madhya Pradesh
undertaking engaged in the promotion and development of the Micro and Small Enterprises
of the State. Nigam invites and finalizes various Rate Contract of Items of common use for
govt. Departments and public sector units. Nigam also finalizes the quantity contracts, on the
specific requirement of the department.
2. For the requirement of Various Govt. Department of Madhya Pradesh, M.P. Laghu Udyog
Nigam Ltd., Bhopal invites bids of the items mentioned in Section-VI of the tender through
e-Tendering from eligible bidders for the supply under Annual Rate contract
3. In State level Bid only M.P. based MSE can participate.
4. The Business of above items (in INR) during last three financial years is as following:-
FY-2017-2018 - Rs. 843.82 Lac

FY-2018-2019 - Rs. 557.96 Lac
FY-2019-2020 - Rs. 164.21 Lac
The above detail is merely for the information of the bidder and the quantum of business for
forthcoming Rate Contract shall depend upon the actual requirement from Govt.
Departments.
5. Provision of the MP store purchase and procurement rules 2015 (as amended), will be
complied by the concerned.
6. Bidding documents may be Downloaded free of cost by any interested bidder from the web
site https://mptenders.gov.in/nicgep/app.
7. For e-tendering registration bidder will have to register their firm/company on M.P. e-tender
portal https://mptenders.gov.in/nicgep/app and required to pay registration fee as applicable
on portal.
8. Pre Bid Meeting shall be held on 02/02/2021 at 12.30 P.M. through Video Conferencing.
9. The bid is to be submitted electronically on the portal https://mptenders.gov.in/nicgep/app.

Manual submission of bid will not be accepted. No hard copy of any document will be
accepted by MPLUN.
10. All documents uploaded on portal should be clear and readable.
11. During preparation of Technical Bid and Price Bid, bidder must give particular attention to
the following:-

(i) The each page of the documents including specifications must be authenticated by using
digital signature of authorized signatory of the bidder.
(ii) Under this system of bidding, the bidder has to qualify all the stages.
12. The Bidder must furnish requisite Bid Security (EMD) as mentioned in Bid document online
through (https://mptenders.gov.in/nicgep/app) portal.
13. Bids will be opened on the specified date and time and same can be viewed on portal. Bidders
are allowed to attend the opening of the bid.
14. Technical Bid will be opened first and will be evaluated as per specification/QC and terms &
conditions. Thereafter, Price Bid will be opened only for those bidders whose bid is found
technically qualified.
15. In the event of the date specified for opening of bid being declared as a closed/holiday for
MPLUN office, in such case the due date for opening of bid will be next working day at the
appointed times.

SECTION- III: INFORMATION FOR BIDDERS
1. Scope of work
1.1 Compitent Authority required for various Govt. Departments of State. Bid is issued, for
procurement of RETRO REFLECTIVE INFORMATION & ROAD SIGN BOARD After
finalization of the bid, the Rate contract will be awarded to successful bidders for supply of
the above item, on annual rate contract basis. The RETRO REFLECTIVE
INFORMATION & ROAD SIGN BOARD have to be supplied to various designated
places as specified in supply order.
1.2 The scope of work includes following:-
1. The Bidders are required to supply the desired goods/products in prescribed manner to the
purchaser.
2. Transportation, installation onsite, post sales services upto prescribed period, operations
and maintenance (as per requirement) and providing complaint redressal mechanism.
2. Eligible Bidders
2.1 Bidders should not be associated, or have been associated in the past, directly or indirectly
with a firm or any of its affiliates which have been engaged by the MPLUN/Purchaser to
provide consulting service for the preparation of the design, specifications and other
documents to be used for the procurement of the goods to the purchaser under this Invitation
of Bids.
2.2 If Bidder has been debarred or black listed or their marketing assistance has been
stopped/withheld by any Government Deptt. or Government undertaking, such bidder will
not participate in the bid during the period of such penalty. In case, where no period of
penalty has been mentioned, in such cases, period of penalty will be treated as two years from
the date of such penalty/debarment.
2.3 Government owned enterprises are allowed to participate.
2.4 The bidder is legally bound to disclose about any type of litigation pending against him
before any court or legal forum in respect of purchase and/or supply of this type of goods.
3. Cost of Bidding
3.1 The Bidder shall bear all costs associated with the preparation and submission of his/her bid,
and MPLUN Ltd., BHOPAL will in no case be responsible or liable for these costs,
regardless of the conduct or outcome of the bidding process.
4. Contents of Bidding Document

4.2 The Bidder is expected to examine all instructions, forms, terms, specifications and annexure
in the Bidding Documents. Failure to furnish all information required by the Bidding
Documents or submission of a bid not substantially responsive to the Bidding Documents in
every respect will be at the Bidder's risk and may result in rejection of bid.
5. Clarification of Bidding Documents

5.1 A prospective Bidder requiring any clarification of the Bidding Documents shall submit
question/queries if any in writing at the mailing address indicated in the Bid document, not
later than three days before the Pre Bid meeting. Decision of the meeting if applicable, may
be notified on portal https://mptenders.gov.in/nicgep/app.
6. Amendment of Bidding Documents

6.1 At any time the MPLUN may, for any reason, whether at its own initiative or in response to a
clarification requested by a prospective bidder, modify the bidding documents by
amendment/corrigendum.
6.2 Any addendum/corrigendum issued shall be part of Bidding Document.

Addendum/corrigendum will be notified on portal https://mptenders.gov.in/nicgep/app and
will be binding on all the prospective bidders.

6.3 In order to allow prospective bidders reasonable time in which to take the amendment into
account in preparing their bids, the MPLUN, has full right to extend the last date and time for
the submission of bids.
7. Language of Bid
7.1 The bid prepared by the Bidder, as well as all correspondence and documents relating to the
bid exchanged by the Bidder and the MPLUN shall be written in English/Hindi language.
Supporting documents and printed literature furnished by the Bidder may be in another
language provided they are accompanied by an accurate translation of the relevant passages
in the English language in which case, for purposes of interpretation of the Bids, the
translation shall govern.
8. Documents Essential for the Bid

8.1 The bid prepared by the Bidder shall comprise the following components:
(a) Price Schedule (Rate Proforma) completed in accordance with relevant terms and
conditions of the Bid.
(b) Documentary evidence established in accordance with Qualification Criteria, that the
Bidder is eligible to bid and will be qualified to perform the rate contract if its bid is
accepted;
(c) Documentary evidence established in accordance with Qualification Criteria and

Specification, that the goods and ancillary services to be supplied by the Bidder are
suitable goods and services and conforming to the Bidding Document; and
(d) Bid Security have been furnished.
9. Bid Price (Rate)

9.1 Bid has been called for the item/s given in the bid document under Technical specification.
The bidder should quote the price as per technical specification.
9.2 Price {Rate} inclusive of transportation, packing, insurance, loading-unloading, installation,

2% MPLUN service charge & 0.5% inspection charges and GST on MPLUN service charges
& inspection charges and any incidental charges. Price {Rate} will be exclusive of GST
chargeable on goods /products to be supplied. In such case purchaser will pay the amount of
GST extra (other than supply order value) to the supplier. Rate should be quoted for each of
the required product on door delivery at consignee place basis.

with cross conditions like “AT CURRENT MARKET RATES” shall not be accepted.
9.3 Each bid must contain the unit price of each item.

9.4 To ensure regular and timely supply without any interruption, the purchaser reserves the right
to split orders for supplying the requirements among more than one bidder, provided the
prices and other conditions of supply are equal.
9.5 The price (Rate) quoted and accepted will be binding on the bidder for the stipulated period
and any increase in the price will not be entertained till the completion of this rate contract
period if not covered under price variation clause. Cross Conditions such as “SUBJECT TO
AVAILABILITY” “SUPPLIES WILL BE MADE AS AND WHEN SUPPLIES ARE
RECEIVED” etc., will not be considered under any circumstances and the bids of those who
have given such conditions shall be treated as incomplete and bid will be summarily rejected.
9.6 The price quoted should be inclusive of 2% MPLUN's service charges and 0.5% inspection
charges plus applicable GST on service charges and inspection charges, which will be
realized in advance from the bidders.
10. Documents for Bidder's Eligibility and Qualifications

10.1 The Bidder shall furnish, all required and necessary self certified documents
/papers/information's as part of its bid, documents establishing the bidder's eligibility to bid
and its qualification to perform the Rate Contract if its bid is accepted.
10.2 The documentary evidence of the Bidder's qualification to perform the Rate Contract if its bid
is accepted, shall establish to the MPLUN/Purchaser's satisfactions. The bidder should furnish
the required documents compulsorily as indicated in Qualification Criteria failing which their
bid shall not be accepted.
11. Bid Security/Earnest Money Deposit (EMD)

11.1 The Bidder shall furnish Rs. 25000/-, bid security online through
(https://mptenders.gov.in/nicgep/app) portal. No concession/exemption shall be allowed.
11.2 Micro & Small Enterprises of M.P. can participate in any bid issued by MPLUN by
depositing Rs. 25,000/- online on portal. The bidders who have already deposited
Rs. 25,000/- in MPLUN can upload the copy of M.R. on portal.
11.3 The bid security is required to protect the purchaser against risk of Bidder's conduct which
would warrant the security's forfeiture.
11.4 Any bid not secured in accordance with Clauses 11.1 or 11.2 above will be rejected.
11.5 Unsuccessful Bidder's bid security will be discharged/returned immediately.
11.6 The successful Bidder's bid security may be discharged upon the furnishing the performance
Bank Guarantee /expiry of Rate Contract period.

11.7 The bid security (EMD) may be forfeited:
(a) If a bidder
(i) withdraws its bid during the period of bid validity:
(b) In case of a successful Bidder, if the Bidder fails:
(i) to sign the Rate Contract: or
(ii) to furnish performance Bank Guarantee and MPLUN’s Service Charges & Inspection
Charges, within stipulated time limit.
12. Period of Validity of Bids

12.1 Bid shall remain valid for 120 (One hundred twenty) days after the date of bid opening
prescribed by the MPLUN. A bid valid for a shorter period shall be rejected by the MPLUN
12.2 In exceptional circumstances, MPLUN may solicit the Bidder's consent to an extension of the
period of validity. The request and the responses thereto shall be made in writing. A Bidder
may refuse the request without forfeiting its bid security. A bidder granting the request will
not be required nor permitted to modify his/her bid.
12.3 No Bid may be withdrawn in the interval between the last date and time for the submission of
Bids and expiration of the period of bid validity. Withdrawal of a bid during this interval
may result in forfeiture of bid security.
13. Bid Stages

13.1 Technical Bid
The bidder should upload the all necessary documents as required in Qualification Criteria
compulsorily on portal, failing which their bid shall be rejected.
13.2 Price Bid
The bidder should furnish the followings:-
(i) The rate quoted for each item on portal shall be inclusive of transportation, packing,
insurance, loading-unloading, installation, 2% MPLUN service charge & 0.5%
inspection charges and GST on MPLUN service charges & inspection charges and
any incidental charges. Price {Rate} will be exclusive of GST chargeable on goods
/products to be supplied.
(ii) The bidder's are instructed to fill the rates in prescribed price schedule (Rate
Proforma) available on Portal. Price schedule (Rate Proforma) should not be
submitted in Technical Bid, otherwise bid shall be rejected.

14. Last Date and Time for Bid Submission
14.1 MPLUN may, at its discretion, extend the last date and time for bid submission by amending
the Bid Documents, in which case all right and obligations of the Purchaser and Bidders
previously subject to the last date and time will thereafter be subject to the last date and time
as extended.
15. Late Bids

15.1 No Bid shall be considered after the last date and time of submission of bid.
16. Modification and Withdrawal of Bids

16.1 The Bidder may modify or withdraw their bid before Last Date and time of submission of
bids.
16.2 No bid may be modified subsequent to the Last Date and time for submission of bids.
17. Opening of Bids
Opening of Technical Bid and Price Bid:
17.1 Bids will be opened on the specified date and time and same can be viewed on portal.
17.2 Bidders who were found eligible in technical evaluation may be informed about the date and
time for opening of Price Bid.
18. Clarification of Bids

18.1 After bid submission any clarification/rectification submitted by a bidder in respect to his/her
bid shall not be considered.
19. Evaluation and Comparison of Bids

19.1 MPLUN will evaluate and compare the bids with reference to qualification criteria as
specified in bid document and one of such criteria is to ascertain lowest rate per unit for
determining the L1 rate (Lowest rate).
20. Post qualification

20.1 Based on the qualification criteria MPLUN will determine to its satisfaction whether the
Bidder selected as having submitted the lowest evaluated rate and eligible bid is qualified to
satisfactorily perform the Rate Contract.

20.2 The determination will take into account the Bidder's financial, technical and production
capabilities. It will be based upon an examination of the documentary evidence of the
Bidder's qualifications submitted by the Bidder. Pursuant to qualification criteria as well as
such other information as MPLUN/Purchaser deems necessary and appropriate.
20.3 An affirmative determination will be prerequisite for award of the Rate Contract to the
Bidder. A negative determination will result in rejection of the Bidder's bid in which event
MPLUN/Purchaser will proceed to the next bid to make a similar determination of that
Bidder's capabilities to perform the rate contract satisfactorily.
21. Award Criteria

21.1 MPLUN will award rate contract to the successful qualified bidders on lowest evaluated
prices or the price approved by the Marketing Committee. M.P. Store Purchase and Service
Procurement Rules 2015 (As amended) will be complied. However the approved price may
be offered to other bidders i.e. Micro and Small Enterprises of M.P., whose rates are within
the price band of L-1+15% will be allowed to execute rate contract with MPLUN. However
in exceptional cases, where there is sufficient justification, MD MPLUN has discretion to
allow execution of rate contract at approved rates with any other successful bidders.
21.2 In the tender, if the rates quoted by bidder is found L-1, then minimum 50% of order will be
given to L-1 bidder.
22. Disqualification of Bids
22.1 MPLUN may in its sole discretion and at any time during the processing of Bid, disqualify
any bidder from the Bidding process at any stage, if the bidder:-
22.1.1 Submits Bid document, which is not accompanied by required documents and Earnest
Money Deposit (EMD).
22.1.2 Has not submitted the bid in accordance with the bid document.
22.1.3 Dose not meet the qualification criteria as mentioned in the bid document.
22.1.4 Mislead or made false representations in the forms, statements and attachments
submitted in proof of the qualification criteria requirements.
22.1.5 Has imposed conditions in his bid, during validity of the bid or its extended period.
22.2 Bidder who is found to canvass, influence or attempt to influence in any manner the
qualification or selection process, including without limitation, by offering bribes or other
illegal gratification, shall be disqualified from the process at any stage.
22.3 A Bid not valid for 120 days shall not considered as non-responsive and would be
disqualified.
22.4 Bidder(s) should submit documentary evidence in support of fulfillment of all criteria's, while
submitting its bid(s). The scanned copy of these documents should be uploaded on the portal.
Failure to comply with these requirements may result in the bid being rejected. No hard copy
of the bid shall be accepted in the office of MPLUN.

23 MPLUN's right to accept any Bid and to reject any or all Bids
23.1 The MPLUN reserves the right to accept the bid or to reject the bid for the supply of all items
or for any one or more of the items bided for in a bid without assigning any reason, without
thereby incurring any liability to the affected Bidder or Bidders or any obligation to inform
the affected Bidder or Bidders of the grounds for the MPLUN action.
24. Execution of Rate Contract

24.1 Within 15 days of receipt of the offer to execute the rate contract, the successful Bidder shall
execute the Rate Contract at MPLUN’s office at Bhopal on a non-judicial stamp paper of value
of Rs.500/- (stamp duty to be paid by the bidder) and return it to the MPLUN. Bidder shall also
submit hard copy of documents as required by MPLUN.
24.2 The validity of rate contract will be one year and may be extended for further period as
agreed mutually unless revoked.
25. Performance Bank Guarantee, LUN Service Charges & Inspection

Charges
25.1 Within 07 days of the receipt of intimation of Supply Order, the successful Bidder shall
furnish the Performance Bank Guarantee (If any) in accordance with the General Conditions
of Bid. Bidder shall furnish within stipulated time limit LUN Service Charges & Inspection
Charges online through (https://eproclun.mpmsme.gov.in) portal.
25.2 Failure of the successful Bidder to comply with the requirement of the bid shall constitute
sufficient grounds for the annulment of the award and forfeiture of the bid security/previously
deposited performance Bank Guarantee and disqualify the firm to participate in the bid for
the next One Year.
26. Placement of Supply order

26.1 Purchaser reserves the right to distribute supply orders amongst the units under Rate Contract
considering the ranking, location, capacity of the unit, destination of supplies and
performance.
26.2 Purchaser reserves the right to place supply orders for full requirement with any bidder or
split the orders amongst more than one bidder. However it is strongly advised to the
purchaser to distribute the supply order among successful bidders equitably.
27. Corrupt and Fraudulent Practices

27.1 "Corrupt practice" means the offering, giving, receiving or soliciting of anything of value
to influence the action of a public official in the procurement process or in rate
contract executions, and

27.2 "Fraudulent practice" means a mis-presentation of facts in order to influence a procurement

process or the execution of a rate contract and includes collusive practice among Bidders
(prior to or after bid submission) designed to establish bid prices at artificial non-competitive
levels and to deprive the purchaser of the benefits of free and open competition;
27.3 will reject a proposal for award if it determines that the Bidder recommended for award has
engaged in corrupt or fraudulent practice in competing for the contract in question.
27.4 will declare a firm ineligible, either in indefinitely or for a stated period of time, to be
awarded a contract if it any time determines that the firm has engaged in corrupt or fraudulent
practice in competing for, or in executing, a rate contract.
27.5 No Bidder shall contact the MPLUN on any matter relating to its bid, from the time of the bid
opening to the time the Rate Contract is awarded.
27.6 Any effort by a Bidder to influence the MPLUN in its decisions on bid evaluation, bid
comparison or rate contract award may result in rejection of the Bidder's bid and forfeiture of
bid security.

SECTION- IV: GENERAL CONDITIONS OF BID
1. Use of Bid Documents and Information

1.1 The supplier shall not, without MPLUN's prior written consent, disclose the Rate Contract, or
any provision thereof, or any specification, plan, drawing, pattern, sample or information
furnished by or on behalf of MPLUN in connection therewith, to any person other than a
person employed by the supplier in performance of the Rate Contract. Disclosure to any such
employed person shall be made in confidence and shall extend only so far, as may be
necessary for purposes of such performance.
1.2 The Supplier shall not, without MPLUN's prior written consent, make use of any document
or information except for purposes of performing the Rate Contract.
1.3 Any document, other than the rate Contract itself, shall remain the property of MPLUN and
shall be returned (in all copies) to the MPLUN/Purchaser on completion of the Supplier's
performance under the Rate Contract if so required by MPLUN.
2. Patent Rights
2.1 The supplier shall indemnify MPLUN against all third-party claims of infringement of patent,
trademark or industrial design rights arising from use of the Goods or any part thereof in
India.
2.2 In the event of any claim asserted by a third party of infringement of copyright, patent,
trademark or industrial design rights arising from the use of the Goods or any part thereof in
the Purchaser's country, the supplier shall act expeditiously to extinguish such claim. If the
supplier fails to comply and the Purchaser/MPLUN is required to pay compensation to a third
party resulting from such infringement, the supplier shall be responsible for the compensation
including all expenses, court costs and lawyer fees. The purchaser/MPLUN will give notice
to the supplier of such claim, if it is made, without delay.
3. Performance Security (Not applicable for this tender)

3.1 The supplier shall be required to pay (5% to 10% as the case may be) Performance security
of the supply order value. The Performance security should be paid upfront in respect of each
supply order on or before the due date fixed by MPLUN/Purchaser, valid up to 60 days after
the date of completion of performance obligations including guarantee obligations.
3.2 The proceeds of the performance security shall be payable to the Purchaser/MPLUN as
compensation for any loss resulting from the supplier's failure to complete its obligations
under the Rate Contract.
3.3 The Performance Security shall be denominated in Indian Rupees and shall be in form of
Bank Guarantee of Nationalized Bank/Scheduled Bank in favour of MPLUN/Purchaser.

3.4 In the event of any amendment in supply order, the Supplier shall, within 15 days of receipt
of such amendment furnish the amendment to the Performance Security, rendering the same
valid up to 60 days after the date of completion of performance obligations including
guarantee obligations.
3.5 The Performance Security will be discharged and returned to the Supplier as early as
possible, following the date of completion of the Supplier's performance obligations
including the guarantee obligation, under the rate contract.
4. Inspections and Tests

4.1 The Purchaser/MPLUN or its representative shall have the right any time to inspect and / or
test the Goods to confirm their conformity to the rate contract:-
(i) The Supplier shall notify the designated Inspection Agency at least 10 days prior to
the time when Goods are available for inspection along with in house test report (If
any).
(ii) Inspection shall be carried out by the designated Inspection Agency at the premises of
the Supplier/at point of delivery.
(iii) The Supplier will provide to the designated Inspection Agency/Purchaser or its
representative all reasonable facilities for the conduct of such inspections and tests at
no additional cost to the Purchaser.
(iv) The inspection procedures are required to be followed by designated Inspection Agency
as per instruction for Pre Delivery Inspection.
(v) Sample inspection, if required as per bid condition will be carried out by committee
comprising of third party inspection agency, purchasing department and MPLUN
(vi) To ensure supply of standard and quality goods, a random post delivery inspection
will also be carried out.
(vii) Nothing in Clause 4 shall in any way release the supplier from any guarantee or other
obligations under this Rate Contract.
(viii) There will be a sample inspection (as and when required), followed by Pre Delivery
Inspection of supply order. The purchaser/MPLUN may also conduct Post Delivery
Inspection on random basis of the supply order.
(ix) The successful bidder should provide a clear and thorough mechanism to get the
feedback and grievance redressal system for post delivery and post sales complaints.
5. Packing
5.1 The supplier shall provide such packing of the Goods has required to prevent their damage or
deterioration during transit to their final destination.

6. Delivery
6.1 The supply should be completed within 45 days from the date of issue of supply order or as
specified in the supply order.
6.2 It shall be the responsibility of the supplier for any shortages/damage at the time of receipt at
designated place.
7. Insurance
7.1 The Goods supplied under the rate contract may be insured in Indian Rupees against the loss
or damage incidental to manufacture or acquisition, transportation, storage and delivery.
8. Transportation
8.1 Supplier is required to transport the Goods to a specified place of destination within Madhya
Pradesh (Door delivery basis) defined in the supply order shall be arranged by the Supplier,
and the related cost shall be included in the quoted Price.
9. Warranty
9.1 The bidder must submit a letter of consent to clearly agree on providing One (1) year
Warrantee/Guarantee (as the case may be) against Manufacturing defect, faulty raw
material/design and poor workmanship from the date of supply.
9.2 The Purchaser shall promptly notify the Supplier in writing of any claims arising under this
warranty.
9.3 Upon receipt of such notice, the Supplier shall, with all reasonable speed, replace/repair the
defective Goods without any cost to the Purchaser.
9.4 If the Supplier, having been notified, fails to remedy the defect(s) within seven days, the
Purchaser/MPLUN may proceed to take such remedial actions as may be necessary, at the
Supplier's risk and expense and without prejudice to any other rights which the
Purchaser/MPLUN may have against the Supplier under the Rate Contract.
9.5 At any time during/after the supply of goods the same is not found as per specification/sub
standard the supplier shall be replaced the defective goods at his own cost, immediately,
failing which amount is recoverable from him and unit should debarred for next one to five
years.
10. Payment
10.1 The Supplier's request(s) for payment shall be made to the Purchaser in writing accompanied
by an invoice describing, as appropriate, the Goods delivered and the service performed, and
by documents, submitted and upon fulfillment of other obligations stipulated in the rate
contract/supply order.

10.2 Payments shall be made promptly by the deptt. within forty five (45) days of submission of
the invoice or claim by the Supplier.
10.3 Payment for Goods and services shall be made in Indian Rupees.
10.4 No advance payments towards cost of goods will be made to the supplier.
10.5 Payments for supply will be considered only after completion of supply of goods and services
as per supply order and terms and conditions.
10.6 The supplier shall raise bills directly in the name of Indenting officer/purchasing officer
against the supplies made directly by them to the indentor's satisfaction in compliance with
the conditions contained in the supply order.
10.7 The supplier shall receive payment against its bills directly from the Indenting department/
Purchasing Department. In case of Non-Payment for the supplies made by supplier, they will
demand payment directly from the Department/Indentor concerned and in no case Madhya
Pradesh Laghu Udyog Nigam Limited shall be responsible for the consequences for delayed
payment or non -payment.
11. Prices
11.1 Prices payable to the supplier as stated in the rate contract shall not be subject to adjustment
(Increase/Decrease) if not covered under Price Variation clause during performance of the
rate contract.
12. Change Orders

12.1 The Purchaser may at any time, by written order given to the Supplier make changes within
the general scope of the Rate Contract in any one or more of the following:
(a) the method of shipping or packing;
(b) the place of delivery; and
(c) the services to be provided by the Supplier.
13. Assignment
13.1 The Supplier shall not assign, in whole or in part, its obligations to perform under the Rate
Contract, except with the MPLUN/Purchaser's prior written consent.
14. Delays in the Supplier's Performance

14.1 Delivery of the Goods and performance of the Services shall be made by the Supplier in
accordance with the time schedule specified in the Supply order. The time would be the
essence of the contract.

14.2 If at any time during execution of the Rate Contract/Supply Order, the Supplier should
encounter conditions impeding timely delivery of the Goods and performance of the Service,
the Supplier shall promptly notify MPLUN/Purchaser in writing of the fact of the delay, its
likely duration and its cause(s). As soon as practicable after receipt of the Supplier's notice,
MPLUN/purchaser shall evaluate the situation and may at its discretion extend the supplier's
time for performance.
14.3 Except a delay by the Supplier in the performance of its delivery obligations shall render the
Supplier liable to the imposition of liquidated damages (Penalty) pursuant to GCB Clause 16,
unless an extension of time is agreed upon pursuant to GCB Clause 14.2 without the
application of liquidated damages (Penalty).
15. Liquidated Damages (Penalty)
The supplier will be liable for penalties for delay (including phased delivery) and quality of
goods (violating the specifications of the goods).
If the Supplier fails to deliver any or all of the standard quality goods or execute the supply
order within time period(s) specified in supply order, the penalty may be imposed in
following three conditions:-
(A) Penalty for delay in supply:- In case where supplier fails to supply goods/products
completely or partially after the delivery period mentioned in the supply order
Supplies made in extended delivery period will be considered with penalty as
percentage of the value of delivered goods, factoring into the delay period, up to a
maximum deduction of 05 percent of the value of delayed Goods or Services. The
extension in delivery period will be prerogative of the purchaser department or
MPLUN as in case. Once the maximum penalty limit is reached, the purchaser
department/MPLUN will consider the termination/ modifying the supply order.
(B) Penalty for Non-Supply:- In case supplier has failed to supply any products/goods
after expiry of delivery period and is not allowed for extension, is liable for
cancellation of supply order (completely or partially), forfeiture of Service
Commission and any other penalty as suspending the marketing facility by MPLUN.
(C) Penalty for Supply of sub-standard goods/products:- In case if it is found by

consignee feedback, post delivery inspection or any other source that supplier has
supplied the sub-standard goods/products, is liable for replacement of the supplied
goods/products with standard goods, without any additional cost. The supplier may
also attract the penalty of cancellation of supply order, forfeiture of service
commission and suspending the marketing facilities of the supplier by MPLUN.
The purchaser/MPLUN shall, without prejudice to its other remedies under the Rate
Contract, deduct from amount payable to the supplier, as liquidated damages
(Penalty), of the delivered price of the delayed Goods and unperformed Services for
each week of delay or part thereof until actual delivery and performance up to a
maximum deduction of 5 percent of the delayed Goods or Services ordered price. The
detail penalty calculation is as shown in Annexure XIV. Once the maximum is
reached, the Purchaser/MPLUN may consider termination of the supply order. The
penalties for non supply, supply of substandard quality products and SLA violation
will be separate.

Further, during the above mentioned delayed period of supply and performance, the
supplier, shall not be entitled to any increase in price, whatsoever, which take place
during the period of delay. But, nevertheless, the purchaser shall be entitled to the
benefit any decrease in price and cost on any ground during that period of delay.
16. Termination for Default

16.1 The Purchaser may, without prejudice to any other remedy for breach of contract, by written
notice of default, sent to the Supplier, terminate the supply order in whole or part:
(a) If the Supplier fails to deliver any or all of the goods within period(s) specified in the
Supply Order, or within any extension thereof granted by the purchaser; or
(b) If the supplier fails to perform any other obligation(s) under the Rate Contract.
(c) If the supplier, in the judgment of MPLUN/purchaser has engaged in corrupt or

fraudulent practices in competing for or in executing the rate contract.
16.2 In the event the Purchaser terminates the supply order in whole or in part, shall constitute
sufficient grounds for the annulment of the award and forfeiture of the LUN Service Charges
& Inspection Charges/ bid security/ performance security and disqualify the firm to
participate in the bid for the next One to Five years.
16.3 Purchaser will be at liberty to terminate without assigning any reasons thereof the supply
order either wholly or in part on 15 days return notice. The supplier will not be entitled for
any compensation whatsoever in respect of such termination.
16.4 In all the above conditions, the decision of MPLUN/purchaser shall be final and binding.
17. Force Majeure

17.1 Notwithstanding the provision of GCB Clause 14, 15, 16, the Supplier shall not be liable for
forfeiture of its performance security, liquidated damages, penalty or termination for default,
if and to the extent that, its delay in performance or other failure to perform its obligations
under the Rate Contract is the result of an event of Force Majeure.
17.2 For purpose of this Clause, "Force Majeure" means an event beyond the control of the
supplier and not involving the Supplier's fault or negligence and not foreseeable. Such events
may include, but are not limited to acts of the Purchaser either in its sovereign or contractual
capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight
embargoes.
17.3 If a Force Majeure situation arises, the Supplier shall notify MPLUN/Purchaser within 10
days, in writing of such conditions and the cause thereof. Unless otherwise directed by
MPLUN/Purchaser in writing the Supplier continue to perform its obligations under the Rate
Contract as far as is reasonably practical, and shall seek all reasonable alternative means for
performance not prevented by Force Majeure event.

18. Termination for Insolvency
18.1 MPLUN/purchaser may at any time terminate the rate contract/supply order by giving written
notice to the Supplier, if the Supplier becomes bankrupt or otherwise insolvent. In this event,
termination will be without compensation to the Supplier, provided that such termination will
not prejudice or affect any right of action or remedy which has accrued or will accrue
thereafter to MPLUN/Purchaser.
19. Termination for Convenience

19.1 MPLUN/Purchaser, by written notice sent to the Supplier, may terminate the Rate
Contract/Supply Order, in whole or in part, at any time for its convenience. The notice of
termination shall specify that termination is for the Purchaser's convenience, the extent to
which performance of the Supplier under the Rate Contract/Supply Order is terminated, and
the date upon which such termination become effective.
19.2 The Goods those are complete and ready for shipment within 15 days after the Supplier's
receipt of notice of termination shall be accepted by the Purchaser at the Rate
Contract/Supply Order, terms and prices.
20. Resolution of Disputes

20.1 The Purchaser and the supplier shall make every effort to resolve amicably by direct informal
negotiation any disagreement or dispute arising between them under or in connection with the
Rate Contract.
20.2 If, after thirty (30) days from the commencement of such informal negotiations, the Purchaser
and the Supplier have been unable to resolve, amicably, either party may require that the
dispute be referred for resolution to the formal mechanisms and arbitration.
20.2.1 Any dispute or difference in respect of which a notice of intention to commence arbitration
has been given accordance with this clause shall be finally settled by arbitration. Arbitration
may be commenced prior to or after delivery of the goods under the rate contract.
20.3 Notwithstanding any reference to arbitration herein:
the parties shall continue to perform their respective obligations under the rate
contract unless they otherwise agree.
20.4 The dispute resolution mechanism to be applied shall be as follows:-
In case of Dispute or difference arising between the Purchaser and a supplier relating to any
matter arising out of or connected with this agreement, such disputes or difference shall be
settled in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The sole
arbitrator can be appointed with mutual consent.
20.5 The venue of arbitration shall be at Bhopal.
21. Limitation of Liability

21.1 Except in cases of criminal negligence or willful misconduct, and in the case of infringement
pursuant to GCB Clause 2:-
(a) the supplier shall not be liable to the purchaser, whether in rate contract, tort, of
otherwise, for any indirect or consequential clause or damage, loss of use, loss
of production, or loss of profits or interest costs, provided that this exclusion shall
not apply to any obligation of the suppliers to pay liquidated damages to the
purchaser; and
(b) the aggregate liability of the supplier to the purchaser, whether under the rate
contract, in tort or otherwise, shall not exceed the total ordered price, provided that
this limitation shall not apply to the cost of replacing defective goods.
22. Governing Language

22.1 The rate contract shall be written in English language. Subject to GCB Clause 23, English
language version of the Rate Contract shall govern its interpretation. All correspondence and
other documents pertaining to the rate Contract which are exchanged by the parties shall be
written in the same language.
23. Applicable Law

23.1 The Rate Contract shall be interpreted in accordance with the laws of the Union of India.
24. Notices
24.1 Any notice given by one party to the other pursuant to this Rate Contract shall be sent to
other party in writing.
24.2 A notice shall be effective when delivered or on the notice's effective date, whichever is later.
25. Taxes and Duties

25.1 Suppliers shall be entirely responsible for all taxes, duties, license fees, octroi, road permits,
etc. incurred until delivery of the contracted Goods to the Purchaser. However, GST in
respect of the transaction between the Purchaser and the Supplier shall be payable extra.
26. Supplier's Obligations

26.1 The Supplier is obliged to work closely with MPLUN/Purchasers staff, act within its own
authority and abide by directives issued by MPLUN/Purchaser and implementation activities.
26.2 The supplier will abide by the job safety measures prevalent in India and will free
MPLUN/Purchaser from all demands or responsibilities arising from accidents or loss of life
the cause of which is the Supplier's negligence. The supplier will pay all indemnities arising
from such incidents and will not hold MPLUN/Purchaser responsible or obligated.

26.3 The supplier is responsible for managing the activities of its personnel or sub contracted
personnel and will hold itself responsible for any misdemeanors.
26.4 The supplier will treat as confidential all data and information about MPLUN/Purchaser,
obtained in the execution of his responsibilities, in strict confidence and will not reveal such
information to any other party without the prior written approval of MPLUN/purchaser.
26.5 The supplier will be required to execute Service Level Agreement (SLA) with
Indenter/Purchaser as and when required for specific product/goods as per bid conditions.
27. Fall Clause

27.1 Prices charged for supplies under rate contract by the supplier should in no event exceed the
lowest prices at which he offers to sell or sells the stores of identical description and similar
terms and condition to any other Government and Public Undertaking during the period of
the rate contract.
27.2 If at any time during the period of rate contract, the price of bided item is reduced or brought
down by any law or Act of the Central or State Government, the supplier shall be bound to
inform MPLUN/purchaser immediately about such reduction in the contracted prices.
MPLUN is empowered to unilaterally effect such reduction as is necessary in rates in case the
supplier fails to notify or fails to agree for such reduction of rates.
27.3 If at any time during the said period, the supplier reduces the sale price of such item sells
such item to any other Govt. and Public Undertakings at a price lower than the price
chargeable under the rate contract he shall forthwith notify such reduction to MPLUN and the
prices payable under the rate contract for the items supplied from the date of coming into
force of such price stand correspondingly reduced. The above stipulation shall however for
reduction shall not apply to:-
(a) Export by the supplier
(b) For all contracts entered into prior to the date of the bid or for any backlog of
pending orders.
28. Jurisdiction
28.1 In respect of all disputes or claims out of or under this rate contract, principal civil Court at
Bhopal alone shall have jurisdiction to entertain the same.
28.2 All disputes and differences of any kind, arising out of or in connection with the AGREEMENT, shall
be resolved by ARBITRATION only in accordance with and subject to the Indian Arbitration Act.
Each party shall appoint an arbitration and jurisdiction of all such work will be Bhopal.
29 Confidentiality
The bidder acknowledge that all material and information which has or will come into its possession
or knowledge in connection with this AGREEMENT or the performance hereof, whether consisting
of confidential and proprietary data or not whose disclosure to or use by the third parties may be
damaging or cause loss to the Department, will at all time be held by it in the strictest confidence and
it shall not make use thereof other than for the performance of its obligations described in this
document.
30. Sub Contracting

The bidder will not sub contract or permit any one other than the COMPANY personnel to perform
any of the work, services or other performance required from the bidder under this AGREEMENT.
31. Bank Guarantee

31.1 The Party No. 2 should furnish an irrevocable Bank Guarantee in favour of Party No.1 for 10% of
the total value of the supplied item/product valid for a period of 37 months from the date of
supply/successful installation (if applicable) of all ordered item/product.
31.2 The Bank Guarantee will be released by the Party No. 1 to the Party No. 2 after successful
performance of the item/product supplied under the Warrantee period (36 months) and OK report for
complete functionality of the item/product duly signed by the Party No. 1. In case the party no. 2 fails
to provide proper services as per terms and conditions, the Party No.1 will have the right to forfeit the
Bank Guarantees.
31.3 The Bank Guarantee should be of a Scheduled Bank situated in Madhya Pradesh.
31.4 If the party no. 2 violates any of the conditions as above, the Party no.1 may forfeit the Bank
Guarantee and or also write to MPLUN for taking disciplinary action against the vendor.
32 Declaration
32.1 All Information filled in the bid is correct and true and are filled by authorized signatory, having
lawful digital signature and access to use of e-bidding. For any fraudulent, incorrect, misleading,
false or fabricated information, the unauthorized user is liable to be prosecuted and punished
under I.T. Act 2000 (As amended).

i) Board: Boards shall be made of 2.0 mm thick. Aluminium alloy sheet/Aluminium composite
material (ACM) 4mm thick conform to clause 6.5 of IRC 67-2012 and shall be rivetted on
25x50x1.25mm tubular frame with the help of suitable sizes pop rivettes of 6mm or by the
help of G I / Nickle Chome plated nut & bolts to be hammered after tightening.
ii) Tubular Frame:
The frame shall be made from tube 25x50x1.25mm of the approximate size of the board, the
frame shall be tightened on two nos. of mounting post at suitable distance with the help of 4
Nos. clamps welded to the frame and tightened by GI/Nickle Chome plated hexagonal nut
and bolts. All welded tube shall be free from burr, voids and shall be derusted. The frame
shall be cross cut welded.
iii) Post: Two Nos of mounting post shall be of Sqaure tube (Conforming to I.S. 3589- with up
to date ammendments) to hold the board.
iv) Cross bar: For grouting purpose 12mm bar of size 300mm shall be welded at suitable height

SIGN BOARD
Information Board for Gokul Gram ( Made out of type IV & XI sheets)
1. Board: Boards shall be made of size 1200x2400 mm of 2.0 mm thick. Aluminium sheet /
4.0mm thick Aluminium composite material shall be rivetted on angle frame with the help of
suitable, sizes pop revitts of 6mm size or by the help of G I / Nickle Chome plated nut &
bolts to be hammered after tightening.
2. Angle Frame:
The frame shall be made from angle iron 50x50x4.5/5mm of the approximate size of the
board, the frame shall be tightened on three nos. of mounting post at suitable distance with
the help of 6 Nos. of angle clamps welded to the frame and tightened by GI/Nickle Chome
plated hexagonal nut and bolts. All welded angle shall be free from burr, voids and shall be
derusted.
3. Channel post: Three Nos. of mounting post made of channel 100x50x4.7 mm to hold the
Board of size 3.2 mtrs.
4. Cross bar: For grouting purpose 12mm bar of size 300mm shall be welded at suitable height
from bottom end.
5. The reverse side of all aluminium Sign boards shall be painted grey epoxy paint.
6. The fabrication board shall be as per standard practice.
7. High Intensity Micro-prismatic type (Type IV & XI ) as per IRC 67-2012 Standards
Sheeting shall be used.
8. M 20 Type concrete shall be used for erection.
9. All sharp edges are to be grinded.
10. All Sign Boards are to be date stamped etched/embossed on their rear face with the date of
manufacture and name of fabricator/manufacture.
(B) RETRO-REFLECTIVE ROAD SIGN BOARDS TYPE -I:

2. Construction:
i) Board: Boards shall be made of 2.0 mm thick. Aluminium alloy sheet/Aluminium composite
material (ACM) 4mm thick in single piece conform to clause 6.5 of IRC 67-2012 and shall be
rivetted on 25x50x1.25mm tubular frame with the help of suitable, sizes pop rivetts of 6mm
or by the help of G I / Nickle Chrome plated nut & bolts to be hammered after tightening.
ii) Tubular Frame:
The frame shall be made from tube 25x50x1.25mm of the approximate size of the board, the
frame shall be tightened on two nos. of mounting post at suitable distance with the help of 4
Nos. clamps welded to the frame and tightened by GI/Nickle Chrome plated hexagonal nut
and bolts. All welded tube shall be free from burr, voids and shall be derusted. The frame
shall be cross cut welded.

iii) Post:
Single mounting post made of Sqaure tube (Conforming to I.S.- 3589 with up to date
ammendments) shall be used to hold the sign boards in such a way that the top end of the
tube shall not be visible from the front side.
iv) Cross Bar:
For grouting purpose 12mm bar of size 300mm shall be welded at suitable height from
bottom end.
v) Danger plate shall be made of 2mm aluminium sheet or 4mm thick Aluminium composite
material (ACM) of high intensity micro prismatic retro reflective sheeting Type IV.
Sign Board with Definition Plate -Type II (Made of type IV & XI sheet) :-
The sign posts shall be 90cm Triangular, 90cm Octagonal, 90cm Circular, 1500 x 250mm(4
nos.) shoulder mounted board, 600 x 200mm board (type-I) and 600x800mm & 600x200mm
board(type-II), as per LUN 'Typical drawings'.

General requirements:
1. For detailed specifications please refer relevant Drawings
2. All G.I. pipes are of Class B Type.
3. The reverse side of all aluminium Sign boards and pipes shall be painted grey epoxy paint.
4. All Sign Boards shall be date stamped etched/embossed on their rear face with the date of
manufacture and name of fabricator/manufacture.
5. Prime quality 2 mm thick aluminium sheets/ 4 mm thick aluminium composite material and
G.I. pipes medium grade shall be used for fabrication.
6. M 20 Type concrete shall be used for erection.
7. All sharp edges shall be grinded.
8. Fabrication is to be done as per standard practice.
9. High intensity prismatic type sheet type IV or Micro prismatic type sheeting XI as per IRC
67-2012 Standards Sheeting shall be used.
(C) CAUTIONARY SIGN BOARDS (RETRO REFLECTORISED HAZARD MARKER
SIGN):
1. Retro Reflectorised Hazard marker sign as per IRC 67-2012 made of retro reflective sheeting
of High intensity prismatic type sheet type IV or Micro prismatic type sheeting XI fixed on 2
mm thick and 300W x 900H mm aluminium sheet or 4mm thick ACM having frame of 25 x
50 x 1.25mm.tube. The board shall be supported on a 50 x 90 x 3.2 mm M.S. pipe 2 mtr.
long.

2. Retro Reflectorised Chevron Signs made of retro reflective sheeting of High intensity
prismatic type sheet type IV or Micro prismatic type sheeting XI fixed on 2 mm thick and
1500 x 300 mm aluminum sheet or 4mm thick ACM having proper framing. The board shall
be supported on 3 Nos. of 50 x 90 x 3.2 mm M.S. pipe 1.8 mtr. long.
3. Retro Reflectorised Directional arrow sign made of retro reflective sheeting of High intensity
prismatic type sheet type IV or Micro prismatic type sheeting XI fixed on a 2 mm thick and
600H x 400W mm aluminum sheet or 4mm thick ACM having frame of 25 x 50 x
1.25mm.tube. The board shall have screen printed black colour arrow/strip of 200 mm width.
The back ground shall be of yellow colour. The board shall be supported on 50 x 90 x 3.2
mm tube 3 mtr. long.
4. Reflector cluster reflector of Red reflector made of Triangular 300mm size made of 2mm
thick aluminum sheet or 4mm thick ACM having four circular Red Reflector of High
intensity prismatic type sheet type IV or Micro prismatic type sheeting XI retro reflective
sheeting having back ground white and border red reflective supported on 48 mm M.S. pipe 1
mtr. long and 1.6 mm thick.
5. Delinator made of 48mm M.S. pipe 1200 mm long and 1.6 mm thick duly powder coated
with black or white colour having Retro Reflective band of 50 mm of Red colour and two
bands of 25 mm white colour upper part duly covered with jali. Sheeting shall be of type
IV/type-XI.
(D) RETRO REFLECTIVE CANTILEVER SIGN BOARDS(WITH ERECTION):

Construction:
(The board shall be for one/two side massage. The board width shall be either 1.5 or 1.8
mtr. The board shall be made of 2mm thick aluminium sheet/or Aluminium Composite
material 4mm thick conform to clause 6.5 of IRC 67-2012. The board shall be riveted
on M S angle frame 40x40x4mm and clamped by flats as required to hold them rigidly
in position).
i) For details refer Typical Drg. Nos. LUN/Tech/TS-2/PF-19/01 dt. 25-10-10 & LUN/Tech/TS-
2/PF-19/ 02 dt. 25-10-10.
ii) The message, symbol, signs shall be cut out from High intensity prismatic type sheet type IV
or Micro prismatic type sheeting XI retro-reflective sheeting as per requirement of the
consignee in desired colour.
iii) The post frame and other steel parts shall be painted by one coat of steel primer and two
coats of epoxy paint as per IRC 67 -2010. Aluminium sheet shall also be epoxy painted.
iv) Complete erection work of the boards shall be carried out by tenderer at the site as instructed
by consignee.

v) The foundation details shall be as per Typical Drg. LUN/Tech/TS-2/PF-19/05 dt. 25-10-10.
(E) RETRO REFLECTIVE OVERHEAD SIGN BOARDS (WITH ERECTION):
(The board shall be for one side massage. The board width shall be either 1.5 or 1.8
mtr. The board shall be made of 2mm thick aluminium sheet/or Aluminium Composite
material 4mm thick conform to clause 6.5 of IRC 67-2012. The board shall be riveted on M S
angle frame 40x40x4mm and clamped by flats as required to hold them rigidly in position).
1. OHSB - Type -I
a. Vertical posts of single pipe of 300mm NB x 4mm thick pipe and overhead
structure made of 32mm & 25mm NB pipes, Medium class.
b. The fabrication of the posts and overhead structure shall be as per Typical Drg.
No. LUN/Tech/TS-2/PF-19/03 dt. 25-10-10.
c. The span of overhead boards shall be 10 (upto 14) Mtr. or as per consignee's
requirement.
d. The foundation details shall be as per Typical Drg. No. LUN/Tech/TS-2/PF-19/05 dt.
25-10-10
2. OHSB - Type -II
a. Vertical posts of single pipe of 300mm NB x 4mm thick pipe medium class and
overhead structure made of 150mm dia x 4mm thick pipes.
b. The fabrication of the posts and overhead structure shall be as per Typical Drg. No.
LUN/Tech/TS-2/PF-19/04 dt. 25-10-10.
c. The span of overhead boards shall be 10 (upto 14) Mtr. or as per consignee's
requirement.
d. The foundation details shall be as per Typical Drg. No. LUN/Tech/TS-2/PF-19/05 dt.
25-10-10.
3. OHSB - Type -III(16.0 meter Span)
a. The structural details shall be as per Typical Drg.NO.LUN/Tech/TS-2/PF-19/06 dt. 25-10-10
b. The foundation details shall be as per Typical Drg. NO. LUN/Tech/TS-2/PF-19/07 dt. 25-10-

Construction:
i) The board shall be for One side message made of 2mm aluminium sheet/4mm thick
Aluminium Composit material(conform to clause 6.5 of IRC 67-2012) of 1.5mtr. or 1.8 mtr.
width.
ii) The message, symbol & sign shall be cut out from type IV & XI retro-reflective sheeting.
iii) The post frame & other steel parts shall be painted by one coat of steel primer & two coats of
epoxy paint Aluminium sheet shall also be epoxy painted on reverse side.

Note:
Complete erection work of the cantilever and OHSB board shall be carried out by tenderer
unit at the site as instructed by consignee. Sign posts their foundation & sign mountings shall be so
constructed as to hold them in proper and permanent position against the normal storm, wind load or
displacement by vandalism.
For overhead cantilever signs, the support system should be properly designed based on
sound engineering principles, to safely sustain the dead load, live load and wind load on the
completed sign system. For this purpose, the overhead signs shall be designed to withstand a wind
loading of 150 kg/m² normal to the face of the sign and 30 kg/ m² transverse to the face of the sign.
In addition to the dead load of the structure, walkway loading of 250 kg concentrated live load shall
also be considered for the design of the overhead sign structure. Foundation/structural design shall be
get approval from consignee.
All the boards shall be fabricated from medium class M.S. Pipe of desired N.B.
OTHER DETAILS:
1) Retro-reflective sheeting:
The retro reflective sheeting used on the signs shall consist of white or red sheeting having a
smooth outer surface which has the property of uniform retro reflection over its entire
surface. It shall be weather resistant and exhibit fastness. It shall be new and unused and
show no evidence of cracking, scaling and pitting, blistering, edge lifting or curling and shall
have negligible shrinkage or expansion. A certificate of having the sheeting tested for
coefficient of retro reflection, daytime colour and luminance, shrinkage, flexibility, liner
removal, adhesion, impact resistance, secular gloss and fungus resistance, three years outdoor
weathering and its having passed these tests shall be obtained from International/Government
Laboratory/Institute by the manufacturer of the sheeting and shall be provided along with
tender/supplies.
These reflective sheeting shall be either of Super Engineering Type material (Type-II) or
High Intensity Prismatic type IV or micro prismatic type XI. The type of sheeting to be used
would depend upon the type, functional hierarchy and importance of the road and shall be
decided by the user deptt.
Classification of sheets
i) Type II Super Engineering Type Sheeting: This sheeting shall be of enclosed lens glass
bead type consisting of microscopic lens elements embedded beneath the surface of a smooth,
flexible, transparent, water-proof plastic, resulting in a non-exposed lens optical reflecting
system. The retro-reflective surface after cleaning with soap and water and in dry condition
shall have the minimum coefficient of retro-reflection (determined in accordance with ASTM
D 4956 - 09) as indicated in Table 6.4 of IRC 67-2012. When totally wet, the sheeting shall
not show less than 90% of the values, of retro reflectance indicated in table 6.3 of IRC 67-
2012. At the end of 5 years, the sheeting shall retain at least 50% of its original retro-
reflectance. When totally wet, the sheeting shall not show less than 90 percent of the values,
of retro-reflection indicated in above Table. At the end of 5 years, the sheeting shall retain at
least 50 per cent of its original retro-reflectance.

ii) Type IV High Intensity Micro-Prismatic Type Sheeting (HIP): This sheeting shall be of
high intensity retro-reflective sheeting made of micro-prismatic retro-reflective element
material coated with pressure sensitive adhesive. The retro-reflective surface after cleaning
with soap and water and in dry condition shall have the minimum co-efficient of retro-
reflection (determined in accordance with ASTM D 4956-09) as indicated in Table 6.6 of
IRC 67-2012. When totally wet, the sheeting shall show not less than 90 percent of the values
of retro reflection indicated in above Table. At the end of 7 years, the sheeting shall retain at
least 80 percent of its original retro-reflectance.
iii) Type XI Micro Prismatic Type Sheeting: Retro reflective sheeting typically manufactured
as a cube corner. The reflective sheeting shall be retro reflective sheeting made of micro
prismatic retro reflective material. The retro reflective surface, after cleaning with soap and
water and in dry condition shall have the minimum co-efficient of retro reflection
(determined in accordance with ASTM D 4956-09) as indicated in Table 6.9 of IRC 67-2012.
When totally wet, the sheeting shall show not less than 90 percent of the values, of retro
reflection indicated in above Table. At the end of 10 years, the sheeting shall retain at least 80
percent of its original retro-reflectance.
2) Adhesive: The sheeting shall have a pressure-sensitive adhesive of the aggressive-tack type
requiring no heat, solvent or other preparation for adhesion to a smooth clean surface, in a
manner recommended by the sheeting manufacturer. The adhesive shall be protected by an
easily removable liner (removable by peeling without soaking in water or other solvent) and
shall be suitable for the type of material of the base plate used for the sign. The adhesive shall
form a durable bond to smooth, corrosion and weather resistant surface of the base plate such
that it shall not be possible to remove the sheeting from the sign base in one piece by use of
sharp instrument. The sheeting shall be applied in accordance with the manufacturer’s
specifications.
3) Messages/ Borders: The messages (legends, letters, numerals, etc.) and borders shall either
be screen-printed or of cut out from durable transparent overlay or cut out from the same type
of reflective sheeting for the cautionary/mandatory sign boards. Screen printing shall be
processed and finished with materials and in a manner specified by the sheeting
manufacturer. For the informatory and other sign boards, the messages (legends, letters,
numerals etc.) and borders shall be cut out from durable transparent overlay film or cut-out
from the same reflective sheeting only. Cut-outs shall be from durable transparent overlay
materials as specified by the sheeting manufacturer and shall be bonded with the sheeting in
the manner specified by the manufacturer. For screen-printed transparent coloured areas on
white sheeting, the co-efficient of retro-reflection shall not be less than 50 per cent of the
corresponding values in Tables 6.3 to 6.9 of IRC 67-2012as applicable. Cut-out messages and
borders, wherever used, shall be either made out of retro-reflective sheeting or made out of
durable transparent overlay except those in black which shall be of non-reflective sheeting or
opaque in case of durable transparent overlay.
4) Warranty and Durability: Both the screen printed areas and cut-out sheeting and cut out
durable transparent overlay film shall be covered under the 7-year warranty issued by the
sheeting manufacturer.
For each lot of sheeting procured, the supplier shall obtain from the manufacturer a 10/7/5
years warranty of satisfactory field performance including stipulated retro reflectance of the
sheeting of type XI / IV/II respectively and shall submit the same to the Engineer Concerned

In addition, a 10/7/5 years in field performance of the finished sign-board with retro-
reflective sheeting of Micro-prismatic high intensity type/ engineering type respectively,
inclusive of the screen printed or cut out letters/legends and their bonding to the retro-
reflective sheeting shall be submitted by the supplier to the consignee deptt. The supplier
shall also furnish a certificate that the supplied material supplied against the assigned S.O.
meet all the stipulated requirements and carry the stipulated warranty. All Sign boards shall
be dated during fabrication with indelible markings to indicate the start of warranty. The
warranty shall also cover the replacement obligation by the sheeting manufacturer as well as
supplier for replacement/repair restoration of the retro-reflective efficiency. The supplier
shall also provide warranty/guarantee for Erection work for the duration similar to warranty
of finished sign board.
5) Paint: Posts shall be painted with one coat of red oxide primer and then two coats of Black
and white synthetic enamel paint as per IRC-67-2012.
The aluminium board shall be painted with two coats of epoxy paint of TA grey shade.
6) The design, colour, shade size of signs letters visibility and all other details not mentioned in
these specifications shall be applicable as per IRC-67 2012 (with upto date amendments).

SECTION- VII: QUALIFICATION CRITERIA FOR BIDDER
The bidder should upload the all necessary documents compulsorily on portal, failing which
their bid shall be rejected:-

SECTION - VIII: INSTRUCTION FOR PRE-DELIVERY
INSPECTION OF ITEMS
(I) PRE DELIVERY INSPECTION

The pre delivery inspection of products/goods is mandatory and pre requisite of supply. Pre
delivery inspection will be carried out by designated agency preferably at supplier's work place. The
inspection will be as per SOP for pre delivery inspection.
(I) Pre-delivery Inspection of the offered Material at manufacturer’s/ tenderer Premises shall be
carried out prior to dispatch by the third party inspection agency. The material shall be
dispatched only on acceptance and inspection certificate issued by the Inspecting officers.
(II) Facilities for Test and Examination: The manufacturer shall provide all reasonable space and
facilities to the Inspecting officer’s at his own expense. Regarding above the Inspecting
officer shall have full and free access at any time during the inspection.
(III) In case of sample sent to laboratories for testing purpose, time duration of testing of samples
will not be included in delivery period & testing charges shall be borne by the unit/tenderer.
(IV) The manufacturer should ensure that the Tendered item inspected, approved and sealed by
authorized inspection agency nominated by the indenter in supply order are delivered to the
consignee.
(V) Any discrepancies observed in the specification than prevailing standard practice and norms,
or suggestions to improve the quality, strength and life of Tendered item economically, must
be brought into the notice of MPLUN In Pre-bid Meeting, else it will be assumed that
specifications are in tune to the prevailing standard and norms.
(ii) POST DELIVERY INSPECTION
To ensure standard and quality products/goods supply random post delivery inspection may
also be carried out by MPLUN and purchaser.

hereinafter mentioned, the Supplier hereby covenants with the Purchaser to provide the

Demand Draft/FDR/Bank Guarantee, against the value of particular supply order for a period of

9. The Party No. 2 are not authorized to supply material directly to any State Government/ Semi
Government organization on the rate contract rate, directly.

11. The supplier shall raise bills directly in the name of Indenting /purchasing deptt. against the
supplies made directly by them to the indentor's/purchaser’s satisfaction in compliance with the

12. The Party No. 2 shall receive payment against its bills directly from the Indenting department/
Purchasing Department or as directed by Indenter/purchasing department. In case of Non-
Payment for the supplies made by Party No. 2, they will demand payment directly from the
Department/Indentor concerned and in no case Madhya Pradesh Laghu Udyog Nigam Limited
shall be responsible for the consequences for delayed payment or non -payment.
13. Each Party warrants and guarantees that it has full power and authority to ensure into and
performing this AGREEMENT and the person signing the AGREEMENT on behalf of each
party has been properly authorized and empowered to enter into this AGREEMENT. Each party
acknowledges that it has read this AGREEMENT understands it and agrees to be bound by it.

SERVICE LEVEL AGREEMENT (SLA)

Objective of the agreement
The objectives of the Service Levels are to:

1. Ensure that the Services are of a consistently high quality and meet the requirements of the Customer;
2. Provide a mechanism whereby the Customer can attain meaningful recognition of the Supplier’s
failure to deliver the level of service for which it has contracted to deliver; and
3. Incentivise the Supplier to comply with and to expeditiously remedy any failure to comply with the
Service Levels.
The purpose of this Support Service Level Agreement (SLA) is to formalize an arrangement between
MPLUN/Purchaser (hereinafter, the Organization) and ……..(NAME OF VENDOR) (hereinafter, the
Vendor) to deliver equipment and support services, at specific levels of support, and at an agreed-upon cost.
A) COMMENCEMENT: The AGREEMENT is effective after successful installation of all the

equipment purchased and will remained valid for a period of .................. years thereafter.
B) Upon Completion of this AGREEMENT PARTY NO. 2 will return all the paper, materials and
other properties of the AGREEMENT to the PARTY NO.1 (Department) along with a certificate of fully
functional status of the supplied equipment.
C) No charges will be payable by the party No.1 to the party no.2 for the replacement of any item
which is under warranty.
1. Terms of Service
1.1 for providing after sell services during warranty period, party no.2 will intimate name, address, email
Id and contact no. of qualified service engineer who will be responsible for service support at the
district/ Block head quarter and report to party no. 1
1.2 Services and Requests Covered Under This Agreement
The following services are provided by the Vendor to the Organization:
1. NAME AND DESCRIPTION OF PRIMARY SERVICE.: This is all-inclusive of equipment,

maintenance, parts, travel, and all consumable supplies.
2. STATEMENT OF VENDOR RESPONSE TIME. The guaranteed in-person response time
following any service call shall be normal business hours (10.00 a.m. - 5:30 p.m., Monday –
Saturday) excluding state holidays. The response time begins when the request is logged with the
Vendor’s problem-ticketing system and is stopped when the technician logs the arrival at the
equipment site and meets with the Key Operator.]
3. STATEMENT OF SERVICE AVAILABILITY. [Example: Device Uptime Levels: The
guaranteed in-person response time following any service call is four (6) business hours or less.
The Vendor will respond1 to any service call within four (6) hours from the time the call was
placed to maintain that 95% calls are responded in time with a clear timeline. The calculation will
be done on quarterly basis.
In-Time Response Percentage = (Number of Total tickets raised- Number of Tickets responded in
prescribed time)/Number of Total tickets raised x 100%

If the call can be satisfactorily resolved via telephone support, it shall be deemed an acceptable vendor response.

 Response Percentage <80% - Penalty of Rs. 2000 for every 1% lower than the benchmark
 80%<Response Percentage <90% - Penalty of Rs. 1000 for every 1% lower than the benchmark
 90%<Response Percentage <95%- Penalty of Rs. 500 for every 1% lower than the benchmark
 The vendor shall satisfactorily repair or replace the defected goods within one working week.
4. SUBSTANCE AND FREQUENCY OF VENDOR REPORTS TO ORGANIZATION. [Example:

Status Reporting: Reporting shall be presented quarterly to encompass all service activity. Reporting
content shall be responsive to the Organization’s requirements.]
5. REPLACEMENT POLICY. [Example: Machine Replacement: If an item cannot be repaired on-site,

a replacement of equal capability may be introduced. Regular reporting will be provided quarterly by
the Vendor to the Organization on available metrics as related to target performance. These reports
are expected to be produced by the Vendor’s problem-ticket system, which will detail ticket
management performance against SLA targets in the Vendor’s case management process.
6. For service during warranty period party no.2 must rectify all complaints related to equipment within
three working days after the complaints is being registered through telephone no as provided by the
party no. 2 or on the online portal. For each complaint received either by telephone or online portal
will be given a complaint reference no. which will include the date of complaints and this will be
taken as start of three days time for fault rectification. The party no. 2 will update the call/complain
status on the portal or manually within three days of rectifying the problem stated in complaint.
1.3 During the warranty period any defective part/s should be repaired/ replace free of cost.
1.5 During the installation the Party No. 2 shall provide on site operational training to at least two persons
of the Party No. 1 in order to educate user, the Party No. 2 may provide a flex poster regarding major
do's and don'ts of the equipment. This will minimize elementary complaints.
1.6 The Party No. 2 must provide at least one preventive maintenance service at all locations every three
month and submit details of all the visit at the end of each quarter to Party No.1.
1.7 The service support of the Party No. 2 will be reviewed at every quarter, if Party No. 2 fails to provide
service support/preventive maintenance service to the Party No. 1.
1.8 During service support in case of any dispute the decision of Party No. 1 will be final and binding on
Party No. 2.
Support Request
For the purposes of this agreement, a Support Request is generally defined as a request for support to fix a
defect in existing device or a request for support that involves functionality of the stated device.
Term of Agreement
This agreement is in effect upon the date of acceptance of this agreement and ends on the latest date specified
in any terms of the Statement(s) of Work submitted by the Vendor and agreed to by the Organization.
Termination of Agreement
The Organization may terminate this agreement without penalty if the Vendor repeatedly violates the terms of
this agreement. In such an event the Organization shall give the Vendor 30 days written notice of intent to
terminate, delivered to the Vendor.

The Vendor’s problem-ticket system will be used by all support team levels (where approval and technical
access has been granted) to record and track all problem reports, inquiries, or other types of calls received by
support. This provides the Vendor with the ability to provide metrics with regard to this SLA.

The Vendor has the following general responsibilities under this agreement:
 The Vendor will conduct business in a courteous and professional manner with the Organization.
 The Vendor will use its own appropriate help desk to provide Level-1 support, including creating
problem tickets and work orders and assigning responsibility to the appropriate Level-2 Vendor resource.
 The Vendor will use its own appropriate internal group, and infrastructure support services.
 The Vendor will obtain the Organization’s approval before ticket closure.
 Once a support request has been submitted, the Vendor will make itself available to work with the
Organization support resource assigned to the support request.
 The Vendor will attempt to resolve problems over the phone on first call.
 The Organization’s end-users will not contact the Vendor’s support resources directly to report a
problem. All problem calls must be logged through the appropriate help desk.
 The Vendor will provide all necessary and requested documentation, information, and knowledge capital
to the Organization prior to the start of support of a new device or functionality.
Role and Responsibilities of The Organization

The Organization has the following general responsibilities under this agreement:
 The Organization will conduct business in a courteous and professional manner with the Vendor.
 The Organization will provide all information required to open a support request.
 The Organization will log all information from the Vendor required to establish contact information,
document the nature of the problem and the Vendor’s hardware/network environment (as applicable).

CHECK LIST FOR THE BIDDER

The bidder should upload the all necessary documents compulsorily on portal, failing which
their bid shall be rejected:-
(1) Bid Security Rs. 25,000/- as mentioned in Bid Document. For Micro & Small
Enterprises of M.P.
(2) The bidder shall furnish Bid Form in the format given in Annexure-I.
(3) The bidder shall furnish a declaration/undertaking in the format given in Annexure-II
declaring that the bidder accept all the terms & conditions of the bid.
(4) The bidder's Annual turnover in the last three financial years shall be submitted in the
format given in Annexure-III certified by the Chartered Accountant.
(5) The bidder shall submit Bidders General Information in the format given in
Annexure-IV.
(6) The bidder must submit Details of Product Sub Item in the format given in
Annexure-V.
(7) The instruments such as power of attorney, resolution of board etc., authorizing an
officer of the bidder should be submitted with the bid and such Authorized officer of
the bidder should sign the bidding document.
(8) Authorization letter nominating a responsible person of the bidder to transact the
business with the MPLUN.
(9) The bidder shall submit GST registration certificate.
(10) The bidder shall submit PAN registration certificate.
(11) Bidder should upload Udyog Aadhar Memorandum or EM Part-II or Udyam

Registration along with copy of annexures for bided item or similar item as mentioned
in NIC 2008.
(12) The bidder shall submit the specification's compliance/deviation report in the format
given in Annexure-VI duly filled & signed by the bidder which clearly bring out the
deviation from the specification if any. Deviation in negative side will result in
rejection of bid.
(13) The Bidder must submit declaration for Capacity in the format given in
Annexure-VIII.
(14) The bidder must submit the grievance redressal and ticket raising mechanism.

(16) The tenderer shall be Authorized Converter of Retro-Reflective Sheeting

manufacturer meeting the conditions laid down by M.O.R.T. & H. Certificate issued
by sheet manufacturer/their authorized National distributor (Except Chinese
Company) should be uploaded.
(17) Manufacturing Facilities:

A certificate from the sheeting manufacturing /their authorized National distributor
stating that tenderer is a qualified convertor and possesses the requisite infrastructure
(Such computerized plotter and hand squeeze roller applicator etc), shall be uploaded.
Proof of having above machineries should be uploaded compulsorily
(18) Experience: In order to ensure that the bidder can supply the product of tendered
specification and specified quality, they must upload :-
(i) For Retro reflective Sign Boards
Certificate issued by Central / State Govt. Deptt. / PSU of satisfactory supply of retro
reflective sign board works OR ''copies of S.O. & Inspection certificate of Third Party
Inspection Agency'' of at least 20 lacs value in one financial year executed during past
three financial years.
(ii) For Retro reflective Cantilever / Over head sign board
Certificate issued by Central / State Govt. Deptt./ PSU of satisfactory supply and
erection of retro reflective Cantilever / Over head sign board OR ''copies of S.O. &
Inspection certificate of Third Party Inspection Agency'' of retro reflective Cantilever/
Over head sign board with erection work of at least 20 lacs value in one financial
year executed during past three financial years.
(19) Warrantee/Guarantee: Tenderer shall upload the declaration regarding 10/7/5 years
warranty for satisfactory field performance including stipulated- reflectance of
the Types XI/IV/II respectively issued by the sheet manufacturer / their National
Authorized dealer.
In addition a 10/7/5 years warranty respectively for satisfaction in-field performance
of the complete finished sign board (made out of type XI/IV/II sheeting) including
steel structure and erection shall be uploaded by the suppliers/tenderer against the
supplies made by them.
(20) A latest test certificate of type XI, IV and II of having tested the sheeting for the
properties (Coefficient of Retro reflection over entire surface of all coloured sheets,
daytime colour and luminance, shrinkage, flexibility, linear removal, adhesion,
impact resistance, specular gloss and fungus resistance, 3 years outdoor weathering
and its having passed these tests shall be obtained from International / Government
Laboratory/ Institute by the manufacturer of the sheeting and in case the certificate is
obtained from international agency , it should also be obtained from Indian agency
with in three years of launching of product by the manufacturer in abroad.
Alternatively, a certificate conforming to ASTM Specification (D 4956-09) on

artificial accelerated weathering requirements from a reputed laboratory in India can
be accepted provisionally.

(21) A test certificate in this regard shall be uploaded When Totally wet the sheeting shall
not show less than 90% of the values of retro reflectance indicated. in concerned
tables of IRC/67-2012. At the end of 10/7 years the sheeting shall retain at least 80%
of its original retro-reflectance for type XI & IV respectably. In case of type - II sheet,
when totally wet the values shall be 90%, table - 6.4 of IRC/67-2012. At the end of 5
years, the sheeting shall retain at least 50 percent of its original retro reflectance.
(In case the above test certificate is not possible the undertaking in this regard issued
by the sheet manufacturer indicating the reason for non availability of the desired test
certificate shall be uploaded).
