4. That Ricardo H. Sumalinog has always been known officially and personally in the
community in Pangil, Amadeo, Cavite as Ricardo H. Sumalinog and not “Ricardo G. Sumalinog”
as contained in his Certificate of Birth;

5. That RICARDO H. SUMALINOG and RICARDO G. SUMALINOG refer to one and

the same person;

6. That we know that Ricardo H. Sumalinog never used the middle “G”;

7. That we are executing this affidavit to attest to the truth of the foregoing facts and for all
legal intents and purposes it may serve.

AFFIDAVIT OF DESISTANCE

I, MARICEL CALAGUI y BALITON, of legal age, Filipino citizen, and with residence
and postal address at Barangay Pangil, Amadeo, Cavite, after being duly sworn to in accordance
with law hereby freely state, THAT:

1. I am the complainant in case numberAC-14-1021 for Attempted Homicide, filed before

the office of the Provincial Prosecutor of Cavite, against accused RODRIGO LEGASPI y
FEDERICO , 57 years old, a resident of Barangay Pangil, Amadeo, Cavite.

2. After many confrontation I come to a conclusion that the above complaint was lodged due
to some misunderstanding and that said misunderstanding was already patched up[ between the
undersigned complainant and the respondent herein, and for this reason, I am no longer interested in
further prosecuting the above-mentioned case;

3. I executed this Affidavit of Desistance to attest the truthfulness of the foregoing statement
and to request the Office of the Provincial Prosecutor, Imus Cavite to dismiss the aforementioned
case against RODRIGO LEGASPI and for whatever legal purpose it may serve.
