Most Important Terms and Conditions

I/We agree and confirm:

(1) To the applicable schedule of charges, fees, commissions and interest rate mentioned in the “Schedule of Charges” of this Application.
(2) That no discount or free gift or any other commitment whatsoever is given to me/ us by the AU Small Finance Bank (“the Bank”) or any of its authorized
representative(s) other than what is not documented in this application form the Terms and Conditions/ Agreement pursuant to the loan.
(3) The Bank shall not process incomplete/ defective application form, for which if any loss or delay is caused to me/ us, I/we will not hold the Bank liable for such
loss or delay.
(4) That processing of loan and disbursement will take at least 10 working days post submission of all requisite documents and information as may be required by
the Bank as per Bank's criteria.
(5) That submission of loan application to the bank does not imply automatic approval by the Bank and the Bank will decide the quantum of the loan at its sole and
absolute discretion. The Bank in its sole and absolute discretion may either sanction or reject the application for granting the loan. In case of rejection, the Bank shall
not be required to give any reason.
(6) That the Bank may, as it deems appropriate and necessary disclose and furnish to Credit Information Bureau (India) Ltd., and any other agency authorized in this
behalf by RBI all or any of the following (a) information and data relating to the me/us (b) the information or data relating to the loan availed of/to be availed, by the
Borrower; and the information and details of the default, if any, committed by the Borrower, in discharge of the loan. The Credit Information Bureau (India) Ltd., and
any other agency so authorized may use, process the said information and data disclosed by the Bank in the manner as deemed fit by them; including publishing the
name as part of willful defaulter's list from time to time, and also use for KYC information verification, credit risk analysis, or for other related purposes and the 'Credit
Information Bureau (India) Ltd., and any other agency so authorized may furnish for consideration, the processed information and data or products thereof obtained
by them, to banks/ financial institutions and other credit
grantors or registered users, as may be specified by the RBI in this behalf.
(7) The Bank reserves its right to reject the loan application and retain the loan application form along with the photograph, information and documents.
(8) That I/ we shall furnish any additional documents as and when required by the Bank.
(9) That there is no impediment or restriction (whether legal or judicial) against me/ us from availing the loan from the Bank.
(10) I/ we do not have any existing customer ID or customer ID apart from the one mentioned above, and incase found otherwise, Bank reserves the right to
consolidate the customer IDs under a single customer ID as it may decide, without any prior notice to me/ us.
(11) That the information furnished by me/ us above is true and accurate.
(12) I/we shall advise the Bank in writing of any change in my/ our residential or employment address.
(13) I/we also hereby authorize and give consent to the Bank to disclose, without notice to me/ us, information furnished by me/ us in the application form(s)/ related
documents executed/ to be executed in relation to the facilities to be availed by me/ us from the Bank, to the Bank's other branches/ subsidiaries/ affiliates/ Credit
Bureaus/ Rating Agencies/Service Providers, banks/ financial institutions, governmental/ regulatory authorities or third parties for information verification, credit risk
analysis, or for other related purposes that the Bank may deem fit. I/ we waive the privilege of privacy and privity of contract.
(14) I/we hereby confirm having read and understood the terms and conditions applicable to this loan/credit facility including the application form and accept the
same.
(15) That I/we hereby unconditionally, agree that these terms may be changed by the Bank at any time and I / we will be bound by the amended terms and
conditions.
(16) That I/we confirm that I/ we are citizen of India.
(17) That Goods and Services Tax is applicable and will be charged in connection with the loan.
(18) In the case of loan cancellation, the applicable pro-rata interest charges on any outstanding loan amount will have to be borne by me/us. I understand that
Processing Fee, Stamp Duty are non-refundable charges and would not be waived/ refunded in case of loan cancellation or where the loan has not been disbursed.
(19) That loan related information like “welcome letter”, “repayment schedule”, “Terms and condition”, “disbursal advice (as applicable the loan )”, will be sent on the
e-mail id mentioned by me/ us in this loan application.
(20) The term and conditions of the Loan shall be governed by Indian law. The terms and conditions and the loan application and your activity on the website of
Snapmint and AU Bank are an “electronic record” in accordance with the (Indian) Information Technology Act, 2000. My/our confirmation/acceptance by way of
clicking on the ‘I agree’ button or by ticking ‘yes’ to any button on the website of Snapmint and/or AU Bank or uploading a document with my signature will amount to
the document being treated as evidence under Section 65B of the Evidence Act, 1872, to support the existence, authenticity and valid acceptance of a contract.
Further, authentication of a document using the Aadhar eKYC services will amount to a qualified electronic signature on the document and the document will be
legally binding upon me/us and its validity shall not be challenged before any court of law.
(21) Any dispute arising in connection with the loan shall be settled before the courts of Jaipur. The Parties agree and acknowledge that in case of any dispute or
difference arising out of or in connection with the loan whether during its subsistence or thereafter between the Bank and me/us including any dispute or difference
relating to the interpretation of the terms and conditions of the loan or any clause thereof shall be settled by arbitration in accordance with the provisions of the
Arbitration and Conciliation Act, 1996, or any statutory modifications thereof and shall be referred to a sole arbitrator, to be appointed by the Bank. Such claims
disputes and/ or differences shall be referred to arbitration by a sole arbitrator (“Arbitrator”) to be appointed by the Bank. Seat of arbitration shall be Jaipur and the
language of arbitration shall be in English.
(22) I/We, hereby secure in favor of the Bank the Loan Amount together with all interest, liquidated damages, costs, charges and expenses and all other moneys
whatsoever due and payable by me/us to the Bank by creating the securities in favor of the Bank by Hypothecating the product as mentioned in the loan application
form.
(23) I/we, further undertake and acknowledge that on demand I/we promise to pay severally or jointly to AU Small Finance Bank Limited or its assigns, a sum equal
to the finance amount for value received together with interest at the rate as mentioned in the ‘Product and Finance Details’ section of the loan application form duly
signed by me . The entire unpaid principal and any accrued interest amount shall be fully and immediately payable UPON DEMAND made by AU Small Finance
Bank Limited. I/ we hereby irrevocably and unconditionally agree, confirm and undertake that we shall remain liable to the extent of the outstanding loan
notwithstanding any payment to the account of AU Small Finance Bank Limited, from time to time, until the repayment of entire amount of the loan.
(24) I/we, further agree and undertake and also authorise AU Small Finance Bank or any of its authorized representatives including Snapmint CREDIT ADVISORY
PRIVATE LIMITED (also known as Snapmint). Snapmint is providing Tech platform for collection of KYC documents and also to follow up with me/us and take
necessary action for enforcement of security and securing repayment of the loan amount and also accept Snapmint CREDIT ADVISORY PRIVATE LIMITED to be

(26) AU Small Finance Bank Limited will pay the insurance premium to Value added partners / general / life insurance partners, as premium towards issuance of
policy for Group Health & Accident Care and Secure Shield product offered by Value Added Partners / General insurance partners.
(27) Repayment instrument for EMI will be presented (as per registered repayment mode) on EMI Presentation Date as specified in the Schedule/Sanction Letter.
Please keep sufficient balance in your bank account to avoid any charges. However, the Borrower shall get 2 additional days to pay dues, which shall be considered
as due date of EMI for repayment of Loan.
(28) The Finance Amount shall only be used for the purpose of purchasing products mentioned in application form. In case of violation of the purpose, it can be
declared as event of default under the loan by the Bank..
(29) The customer shall not create any charge/lien/security interest (of whatsoever nature) on the Product or sell, gift or transfer the possession of the Product to
any third party.
(30) Non payment of dues on Due Date/EMI Presentation Date, dishonour of ECS/NACH or breach of any terms herein, shall constitute an event of default and the
Bank shall be entitled in such situation to take repossession of financed product, dispose/sell the same and adjust the proceeds against outstanding dues and/or
take legal action for recovery of the outstanding dues. The Customer undertakes to surrender to the Bank the financed product or any other asset of the customer if
the value sufficient to satisfy the outstanding dues to the Bank.
(31) The Customer confirms that the login credentials including login ID and PIN and/or any other password issued by Bank/Snapmint to the Customer, from time to
time, constitutes confidential information and the Customer agrees and undertakes to keep the same secure and confidential to prevent the same from any
unauthorized use.
(32) Bank may, but is not obliged to, exercise lien against any other account held with the Bank and/or adjust and set off any Outstandings due from the Customer
from any account with the Bank.. Bank may as soon as reasonably practicable after the exercise of such right of set off, notify the Customer of such exercise
(33) Bank shall at any time, be entitled to assign, sell securitize, discount or transfer all or any part of Bank’s rights and obligations herein to any person(s)/entity by
mere intimation/notice to the Customer and in such manner as the Bank may deem appropriate from time to time. The Customer shall not be entitled to assign or in
any manner transfer any rights or obligations herein.
(34) The terms and conditions herein is adhered with the terms and conditions of the Recovery Policy as per the RBI circular wherein parties will abide by provisions
regarding
(i) notice period before taking possession
(ii) circumstances under which the notice period can be waived
(iii) the procedure for taking possession of the security
(iv) a provision regarding final chance to be given to the Borrower for repayment of loan before the sale / auction of the property
(v) the procedure for giving repossession to the Borrower and
(vi) the procedure for sale / auction of the property.
(35) The Customer undertakes and acknowledges that it is the responsibility of the Customer to provide the Bank with the appropriate records/ communication
address to determine the relevant location of the recipient of service. In case of any tax or related demand due to failure of the Customer to provide the correct
address, the same will be borne by the Customer.The Customer undertakes and acknowledges that it is the responsibility of the Customer to communicate the
GSTIN number of particular state for the purpose of billing. In case of unregistered Customer, the address as given under Customer’s Details would be considered
for the purpose of computation of GST. In case of registered applicants, the address given under Customer’s Details shall be considered as the registered place of
business for the purpose of computation of GST. Please note that for the purpose of this agreement, registered applicant would mean a person registered under the
GST Act. For the purpose of this clause, the term 'GST' shall include the Central Goods and Services Tax ('CGST'), the State Goods and Services Tax ('SGST'),
Integrated Goods and Services Tax ('IGST'), Union Territory Goods and Services Tax ('UTGST') and any other taxes levied under the GST related.
(36) The Customer hereby gives specific consent to the Bank for disclosing / submitting the ‘financial information’ as defined in Section 3 (13 ) of the Insolvency and
Bankruptcy Code, 2016 ( “Code”) read with the relevant regulations/ rules framed under the Code, as amended and in force from time to time and as specified
thereunder from time to time, in respect of the Credit/ Financial facilities availed from the Bank, from time to time, to any ‘Information Utility’ ( “IU”) as defined in
Section 3(21) of the Code, in accordance with the relevant regulations framed under the Code, and directions issued by RBI to the banks from time to time and
hereby specifically agree to promptly authenticate the ‘financial information submitted by the Bank, as and when requested by the concerned ‘IU’.
(37) The Customer (where such Customer is an individual) or the director/ partner/member of such Customer (where such Customer is not an individual), is not a
director or specified near relation of a director of a banking company (including the Bank) (as specified by the RBI), including director of scheduled cooperative bank,
director of subsidiaries/trustees of mutual funds/venture capital funds set up by any banks (including The Bank)or a relative/near (as specified by the RBI) of a senior
officer of the Bank (as specified by RBI).
