SOLAR WATER HEATER SCHEME PHASE 5 (SWH5)

PARTICULARS AND CRITERIA OF SWH5, AND TERMS AND CONDITIONS OF THE GRANT

1 SWH5 - the Scheme


1. The scheme is operated by the Development Bank of Mauritius Ltd (DBM) under the Economic Recovery Scheme.
2. The scheme provides for a grant of up to
i. Rs15,000 to those applicants who draw monthly income of up to Rs 50,000.,
ii. Rs 10,000 to those applicants who draw monthly income of more than Rs 50,000. and up to Rs 100,000.
for purchase of a Solar Water Heater (SWH), to be installed and commissioned at the principal residence of eligible applicants.
3. The grant is meant only for purchase of a new SWH from a supplier of SWH registered under the SWH5 with DBM (Registered Supplier).
4. The new SWH shall have a minimum tank capacity of 150 litres and shall bear a unique serial no; its main structures and supporting frames shall be
made of materials which are corrosion-proof and meet requirements as follows: Inner tank – stainless steel of minimum grade 304 and minimum
thickness 0.5mm; Outer tank – stainless steel of minimum grade 304 and minimum thickness 0.4mm; Frame – stainless steel or aluminium alloy
or galvanised steel or coated mild steel.
5. The scheme may involve disclosure of applicant information to other Ministries/Bodies of the Government of Mauritius, and in the public domain.

2 Eligibility of Applicant
To be eligible for the grant, the applicant must have submitted an application under SWH5 to DBM and
1. The applicant must be aged 18 years or over.
2. The applicant or spouse (if applicable) must be (a) the owner of the residence where the SWH will be installed and (b) the official CWA or CEB
customer of the said residence.
3. The applicant can also be a tenant of the residence where the SWH will be installed.
4. The applicant or spouse (if applicable) or any other occupant of the residence where the SWH will be installed must not have already benefited of
a grant under any Solar Water Heater Grant schemes funded by DBM.
5. The applicant’s or spouse’s (if applicable) name should not be included and/or mentioned in the notice sent to all financial institutions, banking and
non-banking, by Bank of Mauritius, ICAC, Drug Commission and any other regulatory bodies.

3 Application under the Scheme


1. The DBM has received an application under SWH5 from you (also referred to as the applicant herein under).
2. The applicant or spouse (if applicable) is now required to call in person at DBM’s Head Office, Chaussee, Port Louis on the date and time
indicated in the present letter with all required supporting documents listed in the present letter to complete the application formalities, so that
DBM may proceed with the processing of the application. If you or spouse (if applicable) are unable to do so on the said date, you or spouse (if
applicable) may call at the Bank after the said date during normal working hours but before the expiry date mentioned in the present letter. The
application will be treated as cancelled on and after the expiry date.
3. If the applicant is found to be eligible for the grant under SWH5 upon processing of the application, the applicant or spouse (if applicable) will have
to confirm acceptance of and agreement to the particulars and criteria of SWH5 and the terms and conditions of the grant by signing the
“Agreement between DBM and Householders under SWH5”.
4. A payment of Rs 600 representing the Processing Fee shall be deducted from disbursement of grant.
4. Grant Coupon

1. Upon signature of the “Agreement between DBM and Householders under SWH5”, DBM shall issue a grant coupon to the applicant. The DBM
shall also provide a list of Registered Suppliers under SWH5 to the applicant.
The publication of a Supplier’s name in this list of Registered Suppliers under SWH5 shall under no circumstances be construed as an
endorsement and/or a warranty given by DBM as to the quality of the services and/or the SWHs provided by the Supplier. It is only for the purpose
of having a list of Registered Suppliers under SWH5 in order to facilitate the applicant in identifying a Supplier.
2. The applicant shall thereafter select a SWH from a Registered Supplier. The SWH shall meet the set criteria under SWH5 and the applicant’s
requirements of hot water and be within the applicant’s budget.
Prior to making the selection, the applicant shall:
(a) visit the showrooms of and seek counsel/advise from the Registered Supplier/s on the appropriate SWH system (e.g. high pressure/low
pressure) which shall meet his/her requirements of hot water and which shall ensure optimum performance; and
(b) seek all necessary information from the Registered Supplier/s on its/their SWHs, including SWHs’ specifications and availability for delivery
within the validity period of the grant coupon, and on the expected delivery and installation date upon confirmation of order and finalization of
the deal/agreement in respect of the SWH; and
(c) shall ensure that the Registered Supplier has the SWH in stock or will make provision for same so that delivery and installation of the SWH is
effected within the validity period of the grant coupon.
3. Upon selection of a SWH from a Registered Supplier, the applicant shall request for and obtain a quotation in respect of the SWH which shall
encompass among others the relevant technical specifications of the SWH, including tank capacity, details of materials used for the main
structures and supporting frames, and warranty period and which shall indicate the expected delivery and installation date upon confirmation of
order and finalisation of the deal/agreement in respect of the SWH. The quotation shall be duly signed and dated by the Supplier’s authorized
representative/s and shall have all details required by DBM.
4. Upon receipt of a quotation in respect of the selected SWH from a Registered Supplier (as per 3 above), the applicant may proceed with
confirmation of order and finalisation of the deal/agreement in respect of the SWH with the Registered Supplier. The applicant shall however not
effect any part or full payment of the grant as this amount shall be paid directly by DBM to the Registered Supplier upon return of the grant coupon
by the Registered Supplier to DBM.
5. Upon confirmation of order and finalisation of the deal/agreement in respect of the SWH, the Supplier shall (a) proceed with delivery and
installation of the SWH at the applicant’s principal residence within the validity period of the grant coupon, (b) provide the applicant with an
“Agreement between Supplier and Householders” entered into between the Supplier and the applicant, and (c) provide the applicant with
documentary evidence of warranty provided for a period of at least seven (7) years for the SWH equipment as a whole.
Where the applicant has already made provision for the required water piping system which shall allow commissioning of the SWH immediately
upon its delivery and installation, the Supplier shall also have the SWH commissioned to the satisfaction of the applicant. Commissioning of the
SWH shall imply at least connection of the SWH to the cold water piping system and outflow of hot water from the SWH.
6. Upon delivery and installation of the SWH, and receipt of the “Agreement between Supplier and Householders” and documentary evidence of
warranty provided (as per 5 above), the applicant and spouse (if applicable) shall fill in and sign the grant coupon and hand over same to the
Registered Supplier. The Registered Supplier shall then duly fill in, sign and return the grant coupon within its validity date and together with a
duplicate copy of the quotation provided to the applicant and receipt/s evidencing part-payment by the applicant of any amount over and above
the net grant to be disbursed, to DBM to claim the grant.
7. The grant coupon shall be valid for a maximum period of 2 months as from its date of issue or up to the date of closure of disbursement of grants
under the scheme as shall be decided by DBM, whichever is earlier, and shall thereafter be considered null and void and of no effect. In the event
of suspension or revocation of the registration of the Supplier prior to delivery, installation and commissioning of the SWH and return of the duly
filled and signed grant coupon to DBM, the grant coupon shall be deemed cancelled.
8. Upon expiry of the validity period of the grant coupon prior to delivery and installation of the SWH and return of the grant coupon to DBM to claim
the grant, any arrangement or deal/agreement or contract reached between the applicant and the Supplier in respect of the SWH shall be deemed
cancelled and be considered null and void and of no effect by DBM.
5. Disbursement
1. The DBM or any of its agents may visit the applicant’s principal residence to confirm delivery, installation and commissioning of the SWH, upon
submission of the duly filled and signed grant coupon by the Registered Supplier to the Bank to claim the grant.

2. The DBM shall disburse the grant upon receipt of the duly filled and signed grant coupon from the Supplier within the validity period of the grant
coupon and subject to:
(a) fulfillment of the terms and conditions of the grant and the grant coupon;
(b) submission by the Supplier to the applicant of the “Agreement between Supplier and Householders” and documentary evidence of warranty
provided as per 4 (5) above;
(c) delivery, installation and commissioning of the SWH is confirmed as per 5 (1) above; and
(d) availability of funds.
3. The DBM shall not proceed with disbursement of the grant for all cases where part or full payment of the grant has been made by the applicant to
the Supplier.

6. Other conditions

1. The applicant shall not make any deposit, advance or part-payment to any Registered Supplier and/or enter into any agreement or arrangement
with any Registered Supplier for purchase/order/reservation of a SWH prior to completion of the application formalities, issue of grant coupon by
DBM, and selection of a SWH from a Registered Supplier and receipt of a quotation in respect of the selected SWH.
2. The applicant shall not enter into any arrangement or deal/agreement or contract with the Registered Supplier in respect of the SWH under SWH5
if the Registered Supplier does not have and cannot make provision to have the SWH in stock and ready for delivery and/or if the Registered
Supplier cannot deliver and install the SWH at the applicant’s residence within the validity period of the grant coupon.
3. The applicant shall promptly cancel any arrangement or deal/agreement or contract with the Registered Supplier in respect of the SWH under
SWH5 if the Registered Supplier fails to deliver and install the SWH at the applicant’s residence within the validity period of the grant coupon, and
shall promptly seek refund of any monies paid to the Registered Supplier as advance, deposit or part-payment or any other form in respect of the
SWH under SWH5.
4. The applicant shall not enter into any arrangement or agreement with any Registered Supplier which is against or which defeats or bypasses the
procedures set by DBM or any of its agents to operate SWH5.
5. The SWH must not have already been purchased by the applicant and/or delivered and/or installed and/or commissioned at the applicant’s
principal residence and the applicant shall not benefit of any grant for such SWH, as DBM shall not consider re-financing of a SWH which the
applicant has already purchased and/or which has already been delivered or installed or commissioned at the applicant’s principal residence.
6. The applicant shall not move the SWH to another residence/building without the prior approval of DBM.
7. The applicant shall not dispose of the SWH within 3 years as from the date of installation.
8. The DBM reserves the right to have the SWH purchased inspected by officers delegated by DBM at all reasonable times, and the applicant shall
promptly allow the delegated officers access to the applicant’s principal residence for the purpose of the inspection.
9. The applicant shall ensure that the Registered Supplier delivers a new SWH as per the specifications given in the quotation provided by the
Registered Supplier, and installs and commissions the SWH at the applicant’s residence within the validity period of the grant coupon.
10. The applicant shall insist that the Registered Supplier provides a warranty for a period of at least seven (7) years for the SWH equipment as a
whole, during which period the Registered Supplier shall:
(a) have to ensure that the SWH is in good operational order;
(b) as and when required, effect any repair/s which may become necessary at its (i.e the Registered Supplier’s) sole costs; and
(c) provide for the replacement of the SWH in the event the SWH becomes defective beyond repairs during the first year running from the date
the SWH has been duly installed and commissioned.
11. The applicant shall also insist that the Registered Supplier provides the applicant with:
(a) an “Agreement between Supplier and Householders” entered into between the Registered Supplier and the applicant immediately upon
delivery, installation and commissioning of the SWH;
(b) the English and/or French version operation manuals for the Make/Model of SWH installed, which include operation procedure, safety
precautions, maintenance schedule and warranty procedure;
(c) documentary evidence of warranty provided by the Registered Supplier to the applicant for a period of at least seven (7) years for the SWH
equipment as a whole immediately upon delivery, installation and commissioning of the SWH;
12. Should, following site visit effected at the applicant’s residence or otherwise, the applicant be found to have failed to respect the particulars and
criteria of SWH5 and terms and conditions of the grant, DBM shall withhold/cancel disbursement of the grant in favour of the Registered Supplier
and/or instruct the applicant to refund the grant if already disbursed and/or resort to any legal action against the applicant which it considers fit to
recover the grant disbursed.
13. DBM shall be at liberty to impose any penalty charges or fees on the applicant for failure to respect the particulars and criteria of SWH5 and terms
and conditions of the grant, and the applicant shall promptly pay same and take immediate necessary step/s for any rectifications required.
14. DBM may, at any time during the period of the implementation of SWH5 acting on its own deliberate judgment cancel the application of the
applicant for a grant under SWH5 and/or prosecute the applicant if the applicant fails to adhere and/or comply with any of the particulars and
criteria of SWH5 and any of the terms and conditions of the grant and/or more particularly, in the event the applicant:
(a) made false declaration or statement in its application for grant under SWH5 or makes false declaration or statement in the Agreement
between DBM and Householders under SWH5 and/or grant coupon returned to DBM to claim the grant; and/or
(b) submitted to DBM fake, falsified or forged documents in support of its application for grant under SWH5 or submits to DBM fake, falsified or
forged documents in support of the grant coupon returned to DBM to claim the grant; and/or
(c) fails to comply with any of the particulars and criteria of SWH5 and any of the terms and conditions of the grant; and/or
(d) breaches any of the particulars and criteria of SWH5 and any of the terms and conditions of the grant.
15. Upon cancellation of the application for grant of the applicant under SWH5 for any of the reasons set out at 6 (14) above:
(a) the applicant shall forfeit the grant under SWH5; and
(b) the applicant shall refund to DBM the grant disbursed under SWH5;
and DBM shall resort to any action which it considers fit to recover the grant disbursed under SWH5.
16. Any dispute between the applicant and the Registered Supplier shall be settled/remedied by the relevant body or authority, and DBM shall neither
be party to such dispute nor liable to either the applicant or the Registered Supplier with regard to any dispute which may arise between the
applicant and the Registered Supplier.
17. DBM shall not be liable to either the applicant and/or the Registered Supplier for any prejudice, loss, damage or cost incurred as a result of, or
arising from:
(a) any delay in the processing of the application; or
(b) the cancellation of the application by DBM; or
(c) the expiry of the validity period of the grant coupon issued by DBM prior to delivery and installation of the SWH and return of the grant
coupon by the Registered Supplier to DBM to claim the grant; or
(d) the suspension or revocation of the registration of the Registered Supplier under SWH5 by DBM; or
(e) the supply and installation by the Registered Supplier of the SWH which has been financed through a grant under SWH5; or
(f) any disagreement between the applicant and the Registered Supplier causing the latter to remove and take back the SWH installed at the
applicant’s residence and to refund the grant to DBM; or
(g) any delay resulting in the disbursement of grant by DBM; or
(h) forfeiture of the grant disbursed by DBM; or
7. Cancellation of application

1. The DBM shall outright cancel this application should the applicant (a) fail to produce all required supporting documents and complete the
application formalities within the given timeframe or sign the “Agreement between DBM and Householders under SWH5”; (b) fail to meet and/or
comply with the particulars and criteria of SWH5 and the requirements of any of the stipulated terms and conditions of the grant and the grant
coupon; (c) provide any false information/make any false declaration/submit any fake, falsified or forged document in respect of this application to
benefit of the grant; and (d) enter into any arrangement or agreement with any Registered Supplier which is against or which defeats or bypasses
the procedures set by DBM to operate the scheme.
2. The DBM shall reserve the rights to initiate legal proceedings against the applicant should (a) the applicant provide any false information/make
any false declaration/submit any fake, falsified or forged document in respect of this application to benefit of the grant; and (b) the applicant enter
into any arrangement or agreement with any Registered Supplier which is against or which defeats or bypasses the procedures set by DBM to
operate the scheme.
