GUIDELINES ON THE STRICT IMPLEMENTATION OF SECTION 30, SECTION 32 AND
SECTION 30.5 OF DEPED ORDER NO. 88, SERIES OF 2010 AS AMENDED EFFECTIVE SY
2021-2022 ONWARDS
To Schools Division Superintendents
v Section 28 of DepEd Order No. 88, Series of 2010 as amended
provides that consistent with national educational policies, plans
and standards, the Regional Director concemed shall have the
authority, accountability and responsibilty for approving the
establishment of private pre-school, elementary and high schools
‘and learning centers.
2. The same was ao the pronouncement of the Flipino people in
tem 13(B), Chapter | of Republic Act 9155 entitled, Governance of
Basic Education Act of 2001.
3. On the other hand, Item 7(C) Chapter | of Republic Act 9155
provides that the schools division superintendent shall have the
authority, accountability and responsibility for supervising the
operations of all public and private pre-school, elementary and high
schools and leaming centers.
4, Section 30 of DepEd Order No. 88, Series of 2010 as amended
provides that request for opening of a new school or for the
operation of a new grade or year level in existing elementary and
secondary schools should be submitted to the Regional Office on or
before August 30 preceding the start of the school year when the
school/new course is supposed to operate.
5. Section 32 of DepEd Order No. 88, Series of 2010 as amended
provides that on or before February 1*! preceding the opening of the
school year, schools operating courses under a temporary permit
shall file an application for recognition of those courses on the first
‘and second level of instructions.
6. Section 30.5 of DepEd Order No. 88, Series of 2010 as amended
provides that private schools granted permission fo open courses in
the 1" and 2-4 level of instruction should file their application for

pemit to operate those courses with the Regional Office on or
before January 2°¢ preceding the opening of school year.
In view thereof, the attached guidelines shall be strictly
followed in case application for govemment permit or DepEd
recognition for Schoo! Year 2021-2022 and onwards will be filed after
the deadline of submission.
All schools division offices are hereby required to fumish copy of
this memorandum to all the private schools association within their
respective jurisdiction. Also, copy of this memorandum shall be
posted in the bulletin board of respective schools division office
immediately upon receipt hereof.

GUIDELINES ON THE STRICT IMPLEMENTATION OF SECTION 30,
SECTION 32 AND SECTION 30.5 OF DEPED ORDER NO. 88, SERIES OF 2010
1.Upon receipt of the application submitted after August 30
preceding the start of the school year (for new permit), January
1 preceding the opening of the school year (for renewal of
permit) or February 2 preceding of the opening of the school
year (for DepEd recognition), the schools division office shall
immediately inform the school that the application shall not be
acted upon having been submitted after the deadiine.
2. After which, the schools division superintendent shall assign the
Division Inspectorate Team for private schools and/or Attorney
Ill/Legal Coordinator who shall conduct an ocular inspection,
verification from the public or any other means to determine
whether the school is already adverlising or accepting
enrollees, conducting classes on courses not yet permitted or
exhibiting acts which misled the public to conclude that the
school has been permitted by the Department to operate as a
school.
3. The findings during the determination shall be embodied in a
report which will be submitted and referred to the Office of the
Regional Director - Legal Unit for proper disposition of the report.
4, Besides the findings, the history as to how the determination
came about shall also be indicated. Moreover, the pieces of
evidence such as pictures, videos, testimonies of persons
interview shall be attached to the report.
5. The report shall be disposed in accordance with the usual
procedure in administrative proceedings against private
schools.
