What is an Emergency?

Emergency is a situation where government has power to put


some policies that they are not permitted to do, and the
reason is for the safety and protection of the citizens of the
country.
Types of Emergencies
1. National emergency
This emergency is declared under article 352 and can
only proclaimed by the President after recommendation
of council of ministers.
In India National Emergency has been declared three
times:- 1962 Indo-China War, 1971 Indo-Pak War, 1975
declared by Indira Gandhi.
25 June 1975 was the darkest day of Indian Political
history because Indira Gandhi pressurized the
President to declare an emergency for her own good
and to be in the power because she won the elections
by mal practices and her opponent Rajnarayan filed a
case in Allahabad Court and the punishment was ban of
6 years of Indira Gandhi as a leader, so for getting away
from the punishment she declared Emergency and the
reason she gave for declaring emergency was ‘armed
rebellion’ because his opponent started a Nara
“Singhasan khali karo ki janta aati hai”, so she
manipulated this line and showed Rajnarayan as an
armed rebellion. Punished every leader that she
thought can be a problem to her leadership and sent
them to jail, including Rajnarayan.
DURATION – 2 years, and should be approved by special
majority.
Revoking Procedure- Lok Sabha passes a revolution by
simple majority then it is revoked by the President.
Centre gets – executive and legislative powers.

2. State Emergency
State emergency is same as National emergency but in
a specific state of a country, it is declared under article
356, proclaimed by president after the written
recommendation of Governer of the particular State.
DURATION- maximum 3 years.
This emergency can be revoked by the President on his
own.
3. Financial Emergency
Financial Emergency as situation where risk has arise to
financial stability or credit of India or of any part of the
country.

This emergency is declared under article 360,


proclaimed by the President. President directs the state
to take strict measures to resolve the issue.
DURATION can be indefinite and should be approved by
Lok sabha and Rajya sabha in every 2 months by simple
majority.
The revoking procedure is same as State Emergency.
