If you are aggrieved by the decision to refuse to issue a Certificate of Conformity for the weighing
instrument Serial Number ………………………………………. submitted by you for EC
verification on ……………………………………. you have a right to appeal.

You should lodge your appeal by writing in the first instance to Yorkshire and the Humber Verification
Service, Calibration Test Centre, Brudenell Way, Dane Park Road, Hull, HU6 9DX. Alternatively, you may
write to the International Section, National Weights and Measures Laboratory, Stanton Avenue, Teddington,
Middlesex, copying your letter to Yorkshire and the Humber Verification Service, as above.

The decision may be challenged, also by judicial review in certain circumstances. You should consider
taking legal advice before seeking judicial review.

In England and Wales, the procedures for judicial review are governed by the Rules of the Supreme
Court, in particular by Order 53. Application for leave to apply for judicial review must be made in
a document setting out the relief sought and the grounds upon which it is sought. The application
must be accompanied by an affidavit setting out the relevant factors and accompanied by copies of
relevant documents.

The application must be made promptly and in any event within three months from the date when grounds
for the application first arose (that is to say, from the date when notice of the decision complained of is
given to you) unless the court considers that there is a good reason for extending the period.

If leave is granted, the applicant must apply for judicial review in accordance with the Rules of Court. There
are time limits which must be observed.

In practice, the court is likely to uphold or quash the decision complained of or to require the person who
made the decision to reconsider it but not to substitute its own decision. In certain circumstances, it may
grant relief, including an award of damages.
