DFL 101 PRINCIPLES OF BUSINESS LAW

1. Mdosi a music promoter had planned to stage two big music concert and engaged a
number of eminent musicians. He had paid each musician 10% of the agreed fee at the
time the separate contracts were made. Five days before the first concert,

Diamond one of the eminent musician confirmed he could not attend because he was
marrying his third wife on that day.

Sauti soul were unable to attend because one of the band members had fallen ill with a
bad flu

Simple Steve refused to attend the concert because his fee was not large enough and had
accepted another gig to perform another concert in Uganda

Nameless who was also slated to perform could not do so as he had travelled to china one
week before the concert and days before the concert the government issued a directive
declaring that flights from and to China were banned due to Covid 19 and so he was
stuck in China.

Mdosi was concerned and fearing that the concert would be a failure decided to cancel
the concert.

Mdosi seeks your advice on her legal rights against the three musicians.

(a) Evaluate the scenario above and critically analyze the legal principles applicable
(b) Advise Mdosi on what to do concerning each musician (15 marks)

2. Mary bought a sewing machine from Mchina Co Ltd on hire-purchase. The hire-purchase
is Ksh. 60,000 payable within six months. So far she has paid Ksh.50, 000 and the
remaining debt is Ksh. 10,000.

However, due to Covid 19, she has had to close her business and is unable to pay the
balance.

Two days ago Chan one of the Mchina Co Ltd employee, entered her shop and
confiscated the sewing machine.

(a) Discuss the legal principles applicable in this case


(b) Advice Mary on the possible legal outcome of this case as provided under the
Hire-purchase Act. (15 marks)
