COMPROMISE DEED

This compromise Deed is made and entered into this 22nd October 2018
and between Ms. AABIDA W/o Sh. IQBAL S/o Sh. USHMAAN (here in
after called complainant in FIR No. 45 dated 19.01.2018 P.S
SURAJKUND, Faridabad District Faridabad (HR) U/Ss
147,149,323,304 IPC) which expression shall unless, the context does
not admit, includes its successors and assign Represented by herself the
party of First Part.

AND

The accused persons are individually referred to as a Party and

collectively ‘Parties’ and details of each party of the parties of Second Part
are given below and represented by himself.

Prior to, signatures on this Compromise Deed by all Parties, it is without

prejudice to each other and subject to contract and cannot later be relied
upon by either party of each part should and agreement not be reached.

WITNESSTH THAT:

1. Whereas, Second Parties of Second Part from Sr. No. 1 to 14 are

Accused and have been named in FIR No. 45 dated 19.01.2018 PS
SURAJKUND, Faridabad. The persons other than from Sr. No.01 to
14 who have not been named in FIR No. 45 may also be involved in
committing in this crime are also be feared and their involvement
 may also be named in submission of final Charge sheet of FIR No.45
in the titled case “ State V/s SARFUDDIN & Others”
2. Whereas the accused persons from serial no.01 to 14 are either
related or friend and are in doubt of culpable homicide of Minor
NEEDA has been committed as mentioned in FIR No. 45 dated
19.01.2018 in furtherance of the common intention to all, each of
such person are liable.
3. Whereas the Second Parties of Second Part from Sr. No. 1 to 14 and
others are in doubt directly and indirectly involved in culpable
homicide of Minor NEEDA D/o IQBAL S/o Sh. USHMAN, Resident of
House No. B-506, Village BADKAL, Faridabad, Haryana.
4. Whereas the husband of First Party of the First Part IQBAL has a
shop of Supplying of Building Materials, Dust, Bricks etc since 10
years who has been hurt, quarreled assaulted in the past many a
times by the Second Parties of the Second Part & all accused
persons. All have created hindrances, check and irruptions & tried
to close the shop of the First Part through adopting muscles powers
& as well as doing illegal acts against the First Party of the First Part
due to business rivals and jealously. There were other small
incidents have been happened in the past. The Second Parties of
Second Part has taken away the materials from the shop illegally &
forcefully. The First Party of the First Part being a poor and weak
person could not do anything even he could not register a Criminal
Complaint against the Second Parties of Second Part.
5. Whereas the Second Parties of the Second Part has threatened
many a times to the First Party of the First Part that the first Party
may close his shop & works and may vacant the place.
6. Whereas Second Parties of the Second Part has tried to produce
forged documents of their Ownership & purported these documents
is original pertaining to those lands which are being utilized by First
Part. In fact this land does not belong to Second Part. The Second
Part has purported these forged documents to harass the First Part.
7. Whereas the Second Part has excavated pits and Bunkers around
the shop of the First Part and on the day of incident, the second
part has also excavated the pits in front of the First Party of the
First Part. The Second Parties of the Second Part has parked JCB
Machine also. When First Party has tried to prevent the Second
Parties, all persons from Second Parties of the Second Part had
manhandled, hurt and assaulted the First Party of the First Part.
8. Whereas the First Party of the First Part had rushed to B. K. Civil
Hospital Faridabad but due to serious condition of Minor NEEDA D/o
 Ms. AABIDA had been referred to SAFDARJUNG, Hospital New Delhi.
But minor NEEDA had passed away on the way while going to
SAFDARJUNG Hospital at New Delhi near Toll Plaza of BADARPUR,
New Delhi. Thus, this is in doubt culpable homicide of Minor NEEDA
has been committed by Second Parties of Second Part the daughter
of First Party of the First Part.
9. Whereas there were continuous threatening calls on mobile & on
verbal also & through indirectly by others from the Second Parties
of the Second Part to the first Party of First Part either to withdraw
the complaint or ready to face the consequences.
10. Whereas the Second Parties of the second Part has influenced
Police through local Political Leaders and the investigation has not
been completed up to nine month and Investigation reports has not
been submitted in the Court. The police have neither arrested the
accused persons nor has it submitted its Charge Sheet. After the
intervention of the Court, the Police have submitted the Viscera and
Medical Report where in it has been revealed that Minor NEEDA the
daughter of the First Party was dead due to her HEAD INJURY and it
was sufficient cause of her death in ordinary course of nature.
11. Whereas the Second Parties of the Second Part collectively
indirectly or directly are in doubt that they are all involved & are
responsible for committing the crime of culpable homicide of minor
NEEDA the D/o First Party of the First part.
12. That after intervention of Honorable Court, the second Parties
of the Second Part has approached the Respectable persons of their
BERAADARI & they have requested that they are ready to accept
their Fault & would tender their unconditional forgiveness from the
First Parties of the First Part. There were three meeting were held in
different places. The Second Parties of the Second Part has
approached the first Party of First Part to lament their unintentional
fault, guilt, crime and sin in the presence of respectable members of
Public and PANCHYAAT. All accused persons in the Second Parties of
the Second Part have swear and have their given assurances to all
the PANCHYAAT Members in Public that they will not repeat this
crime in future.
13. Whereas during the pendency of the matter with the Police &
in the Honorable court, several opportunities for discussions,
deliberations and negotiations for a possible compromise were held
on merits. The Second Parties of the Second Part has requested
before the First Party of the First Part that they wanted to
 compromise the matter on merits from the reports of investigation
of Police as well as the orders from the Honorable Courts.
14. Whereas the Second Part has manifested its willingness to be
indemnified giving their individual Affidavits & sureties, assurances,
commitments, acceptances, conversant unconditionally and without
giving any mandatory benefit to the first part that they would be
bound honoring all terms and conditions which are incorporated in
this compromise cum agreement deed to avoid protracted litigation.
The respectable members of the society and other PANCHAYAT
Members are also in view that this matter may be decided in civilly
aspect in an amicable manner if Law permits as well as Consent of
both the Parts.

NOW, therefore, the Parties do hereby submit Covenants and

Witnesses due to pursuant and admitting the above, have arrived
on the compromise Deed is herein under, hereby agree with each
other they will observe, perform and convene the terms and
conditions as stated given.

1. That the Second Parties of the Second Part by their it’s own
independent and voluntarily, categorically expressed that the
incident happened on 18.01.2018 as mentioned in FIR No. 45 dated
19.01.2018 with deceased minor NEEDA D/o Ms. AABIDA W/o Sh.
IQBAL was unfortunate, unintentional & without the motive of
murdering her. All have felt about this misfortunate happening.
2. That both have assured & committed to each other that all these
types of incidents as mentioned above would never be repeated in
future. In case, if these types of incidents has ever been happened
inadvertently or willingly like quarrel, hurt, assault forced seizing,
retract occupying of the working by them or through any other
persons at the working place & on & nearby & at the shop of the
First Party of First Part, then Second Parties of Second Part would
wholly be all responsible & they all bear the entire consequences as
per remedies available to the First Parties of First Part. Both the
Parts will never interfere in day today of all commercial Business &
activities of the First Party of the First Part & in personal works,
matters and the personal life of First Part. Both the Parts would
never criticize & never spread rumors, tried insult, molest the ladies
of each Part.
3. That both the Parts would never claim for such a Place of working of
shop & place etc. where are they working of each others. In fact,
the whole Land of this Area has the Ownership of PWD. The Second
 Parties of Second Part has claimed that they have Ownership of this
Land. If it is proved legally by any Part of any ownership of the land
then both the Parts would have to honor the Legal Order & such
demarcated area of ownership which to be vacated by each Part &
has to be shifted elsewhere.
4. That both the Parts would never interfere & access in all commercial
and Personal matters of each others. Both the Parts would never
conspire against each others. Both the Parts would not pass any
derogatory comments, abuses and threatening in any manner or
any type sign against each others.
5. That both the Parts have accepted and agreed that they would
Honor and accept whatever the Investigation Report in the Charge
Sheet would be submitted by the Police PS SURAJKUND, Faridabad
in FIR No. 45 Dated 19.01.2018 & subsequent Orders and
Judgments passed by the Honorable Court.
6. That both the Parts mentioned in the Compromise Deed would have
every Right that they may either Challenge or accept such
Investigation Report of Police. Accordingly, both the Parties of both
Part would have their absolute rights either they may accept or not
accept the Final Report the Charge Sheet which would be submitted
by Haryana Police PS SURAJKUND, Faridabad in FIR No. 45 dated
19.01.2018. Further, both the Parts have their absolute rights that
they may file a case or Complaint against each Part in case any
Orders of the concerned court are in contrary with the interests of
each Part in the Higher Courts in India to redress their grievances.
7. That the Second Parties of the Second Part assured & accepted the
request of the First Parties of the First part that he would fill up all
the pitches and drains which was excavated by them & whatever its
costs of repairing for leveling of the Land, the whole expenditures
would be borne by the Second Parts and the whole digging area
would be filled up them at their own cost within a week time.
8. That both the Parts have also accepted and agreed they would not
interfere in the Sale, luring, threatening & influenced the customers
against each Part in day today business of the each other Part. Both
the Parts would never threaten the friends, relatives & customers of
each other Part in any case if any customer & purchaser may visit &
purchases the Material from both the Parts.
9. That both the Parties of both the Parts have assured and agreed to
each other that they would never excavated & dig the pitches and
drain near the place of Business Premises of each Part. Both the
 Parties of each Part would never Parked the Vehicles & create
hindrances & irruptions in front of the Business place of each Part.
10. That both the Parts have assured and agreed that they would
never threaten the life of any family members, friends & relatives of
each Part through any manner, acts & other whatsoever in any
form.
11. That the both the Parts have assured and agreed that they
would never spread rumors, Defamed & spoils the images of the
First Party of the First Part.
12. That both parties of both the Parts have agreed and assured
to each other that they would give honor and respect to each other
in Day, Today life of each other. Both the Part will live together with
love and both will maintain peace and good relationship henceforth.
13. That both the Parties of the both the Parts would not register
any false complaints, would not send any representations, never
use political influence, muscles powers in any manner against each
others.
14. That the Jurisdiction of this compromise deed in any,
interpretations, clarification & disputes if arises would be the District
Court Faridabad (HR).
15. That Parties hereto expressly agree & declare that have
arrived at this Compromise in Agreement in order to put an end to
existing & future Disputes between the Parties & with a view to
bring about Amity & Goodwill amongst them & about the Harmony
in the Families. The Parties hereto agree & declare that the terms of
the Compromise arrived at between them & recorded herein Fair &
Bonafide in the interest of all Parties.
16. That the two accused SAFI MOHD. & SARFUDDIN (Serial No.8
& 9) both are brothers & S/o Sh. SABDAL KHAN who are in named
in FIR No. 45 dated 19.01.2018 have assured & consented the
complainant from their own that they would be held responsible in
case the complainant & his family members are honest, innocent.
Both the persons, have assured that they would not threatened for
life & irruption in day today in discharging their business &
commercial activities of the First Party of the First Part. Both the
person has given their affidavits which are attached along with this
Comprise Deed. Both the Parts have assured that they would not
register any false complaint, case etc in future henceforth.
17. That Parties hereto signed & executed all such required
documents & this Deed on 22nd October 2018 which is recorded in
this Compromise Deed.
 18. UPON THE ECECUTION OF THIS COMPROMISE DEED, THE
AFFIDAVITS HAVE BEEN GIVEN BY EACH ACCUSED OF THE
SECOND PART ECECUTED BY THEM SHALL ABIDE BY THE ALL
TERMS & CONDITIONS MENTIONED THEREIN AS WELL AS THE
ACKNOWLEDGEMENT OF THE SAME.
19. BOTH THE PARTIES HAVE EXECUTED THIS COMPROMISE
DEED BY THEIR OWN WILL, VOLUNTARILY ACT & DEED & IN THEIR
MUTALLY AGREED TERMS WITHOUT ANY PRESSURE, CORCEION &
THREATENING FROM ANY OTHER PERSONS OR PARTIES.
20. BOTH THE PARTIES WARRANTS FURTHER THAT THEY DID SO
WITH THE FULL UNDERSTANDING OF ITS NATURE & ITS
CONSEQUENCES TO THE PRESENT CASE IN RESPECT OF FIR NO 45
DATED 19.01.2018 PS SURAJKUND FARIDABAD (HR).
21. In WIENESSES WHEREOF, the Parties hereto have set &
subscribed their respective hands either through their signatures or
their Thumb Impressions the DAY & the YEAR First hereinabove
written.
