• भारत का एक उपराष्ट्रपतत होगा।

• उपराष्ट्रपतत, राज्य सभा का पदे न सभापतत होगा और अन्य कोई लाभ
का पद धारण नह ीं करे गा :
• परीं तु जिस ककसी अवधध के दौरान उपराष्ट्रपतत , अनुच्छे द 65 के
अधीन राष्ट्रपतत के रूप में कायय करता है या राष्ट्रपतत के कॄत्यों का
तनवयहन करता है , उस अवधध के दौरान वह राज्य सभा के सभापतत के
पद के कतयव्यों का पालन नह ीं करे गा
• The Vice-President shall be ex officio Chairman of the Council of the
States and shall not hold any other office of profit:
• Provided that during any period when the Vice-President acts as
President or discharges the functions of the President under article 65,
he shall not perform the duties of the office of Chairman of the
Council of States
Art 69
• प्रत्येक उपराष्ट्रपतत अपना पद ग्रहण करने से पहले राष्ट्रपतत अथवा
उसके द्वारा इस तनममत्त तनयुक्त ककसी व्यजक्त के समक्ष
तनम्नमलखित प्ररूप में शपथ लेगा

Art 74
• राष्ट्रपतत को सहायता और सलाह दे ने के मलए एक मींत्रि-पररषद होगी
जिसका प्रधान, प्रधानमींिी होगा और राष्ट्रपतत अपने कृत्यों का प्रयोग
करने में ऐसी सलाह के अनुसार कायय करे गा:]
परीं तु राष्ट्रपतत मींत्रि-पररषद से ऐसी सलाह पर साधारणतया या
अन्यथा पन ु र्वयचार करने की अपेक्षा कर सकेगा और राष्ट्रपतत ऐसे
पन
ु र्वयचार के पश्चात द गई सलाह के अनुसार कायय करे गा।
• इस प्रश्न की ककसी न्यायालय में िाींच नह ीं की िाएगी कक क्या
मींत्रियों ने राष्ट्रपतत को कोई सलाह द , और यदद द तो क्या द ।
• There shall be a Council of Ministers with the Prime Minister at the
head to aid and advise the President who shall, in the exercise of his
functions, act in accordance with such advice: Provided that the
President may require the council of Ministers to reconsider such
advice, either generally or otherwise, and the President shall act in
accordance with the advice tendered after such reconsideration
Art 75
• The Prime Minister shall be appointed by the President and the other
Ministers shall be appointed by the President on the advice of the Prime
Minister
• The Minister shall hold office during the pleasure of the President
• The Council of Ministers shall be collectively responsible to the House of the
People
• Before a Minister enters upon his office, the President shall administer to
him the oaths of office and of secrecy according to the forms set out for the
purpose in the Third Schedule
• A Minister who for any period of six consecutive months is not a member of
either House of Parliament shall at the expiration of that period cease to be
a Minister
(1) प्रधानमींिी की तनयुजक्त राष्ट्रपतत करे गा और अन्य मींत्रियों की
तनयुजक्त राष्ट्रपतत, प्रधानमींिी की सलाह पर करे गा।
(2) मींिी, राष्ट्रपतत के प्रसादपयंत अपने पद धारण करेंगे।
(3) मींत्रि-पररषद लोकसभा के प्रतत सामदू हक रूप से उत्तरदायी होगी।
(4) ककसी मींिी द्वारा अपना पद ग्रहण करने से पहले, राष्ट्रपतत तीसर
अनुसच ू ी में इस प्रयोिन के मलए ददए गए प्रारूपों के अनुसार उसको पद
की और गोपनीयता की शपथ ददलाएगा।
(5) कोई मींिी, िो तनरीं तर छह मास की ककसी अवधध तक सींसद के
ककसी सदन का सदस्य नह ीं है , उस अवधध की समाजतत पर मींिी नह ीं
रहे गा।

• महान्यायवादी (अनच्
ु छे द 76)
(1) महान्यायवाद सवयप्रथम भारत सरकार का र्वधध अधधकार होता है .
(2) भारत का महान्यायवाद न तो सींसद का सदस्य होता है और न ह
मींत्रिमींडल का सदस्य होता है . लेककन वह ककसी भी सदन में अथवा उनकी
सममततयों में बोल सकता है , ककन्तु उससे मत दे ने का अधधकार नह ीं है .
(अनुच्छे द 88)
(3) महान्यायवाद की तनयुजक्त राष्ट्रपतत करता है.
(4) महान्यायवाद बनने के मलए वह अहय ताएीं होनी चादहए िो उच्चतम
न्यायालय के न्यायाधीश बनने के मलए होती हैं.
(5) महान्यायवाद को भारत के राज्य क्षेि के सभी न्यायालयों में सन
ु वाई
का अधधकार है .
• Article 76 of the constitution mentions that he/she is the highest law
officer of India. As a chief legal advisor to the government of India, he
advises the union government on all legal matters.
• President of India appoints a person who is qualified for the post
of Supreme Court Judge. There are the following qualifications:
1. He should be an Indian Citizen
2. He must have either completed 5 years in High Court of any Indian
state as a judge or 10 years in High Court as an advocate
3. He may be an eminent jurist too, in the eye of the President
