1. Ms. Shweta lives in Ramnagar. She suspected commission of Rape late at night by three
unidentified persons in her neighbourhood. A few hours later, she witnessed the suspected
victim, a single girl living in the adjoining house weeping and speaking on the phone about
the incident to her friend. She narrated the entire episode to her husband who came back
from work the next morning. They pondered upon the consequences of reporting the
incident to the fellow villagers or the authority. They thought it was the girl’s personal
matter and that it might hurt her reputation. But ultimately the next day they couldn’t resist
reporting the same to the officer in charge of the police station as their conscience didn’t
permit to let the offenders go free. The officer refused to register an FIR. What is an FIR?
Suggest the remedies available to the informants. Discuss the evidentiary value of a delayed
FIR. Substantiate you answer with relevant provisions and cases. [5 Marks]

2. What is Arrest? Explain the procedure of arrest and powers of the arresting officer with the
help of legal provisions and leading cases. [5 Marks]
