DRIVER’S DUTIES

Driver’s Duties in Case of Accident


1. Stop Immediately
2. Show his driver’s license
3. Aid the victim

Drivers may leave the scene of the accident, if:


1. He is in imminent danger of being seriously harmed by any person or by persons by reason of the accident
2. If he reports the accident to the nearest officer of the law, or
3. If he has to summon a Physician or nurse to aid the victim

CONDUCTOR – responsible for the loading of number of passengers, freights or cargo inside the public
utility motor vehicle.

PASSENGER – Is a person being carried or conveyed in an automobile, truck, train, airplane or other
conveyances

PEDESTRIAN – A Person who goes to travel on foot or in a perambulator.

CARRIER

Is a person, corporation, firm or association engaged in the business of carrying or transporting passengers or
goods or both by land, water, or air for compensation, offering their services to the public.

TWO KINDS OF CARRIER


1. PRIVATE CARRIER – one available only to certain individual
2. COMMON CARRIER – one available to the general public

PASSENGERS SAFETY
 A common carrier is bound to carry the passenger safely as far as human care and foresight can provide
using the utmost diligence of very cautious persons, with due regards for all the circumstances
 UTMOST DILIGENCE – high degree of care is imperatively demanded by the precociousness of human
life by the consideration that every person must in every way be safeguarded against all injury.

COMMON CARRIER LIABILITY


1. Recklessness on the part of the driver
2. Recklessness on the part of the owner or operator
3. Common carrier liability as required by law cannot be dispensed with or lessened by stipulation, by posting
of notices, by statements on the tickets or otherwise.

PASSENGER’S DUTY
- The passenger must observe the diligence of a good father of the family to avoid injury to himself. He must
observe ordinary diligence.

NOT PASSENGER BUT GRANTED THE RIGHTS OF PASSENGER


 Newsboy allowed to peddle on the train or bus
 Concessionaires doing business aboard a train: dining and newsstand
 One who with the consent of the carrier’s employee rides in a dangerous place in the vehicle , roof or
running board

NOT CONSIDERED AS PASSENGER


 One who has not yet stepped on any part of the vehicle regardless of whether or not he has already
purchased a ticket
 One who has called a taxi but has not yet actually boarded on it
 One who has remains on a common carrier for an unreasonable length of time after he has been
affordable every safe opportunity to alight
 One who rides stealthily, that is without the knowledge on the part of the carrier that is already inside.
