I, COL. JUANITO DE GUZMAN (RET), of legal age, with office

address at EU State Tower, 30 Quezon Avenue, Quezon City, after
having been duly sworn in accordance with law, depose and state
that:

1. I am the Vice-President for Operations of LOCKHEED

SECURITY AND INVESTIGATION AGENCY, INC. (the
“Corporation”) and I am duly authorized to represent the
Corporation in the instant case as evidenced by a Secretary’s
Certificate hereto attached;

2. I, on behalf of the Corporation, have caused the preparation

of the foregoing Pleading;

3. I have read and understood the contents thereof and the facts
stated therein are true and correct of my personal knowledge
and/or based on authentic records in my possession;

4. I attest to the authenticity of the annexes attached thereto;

5. I have not commenced any other action or proceeding

involving the same issues in the Supreme Court, the Court of
Appeals, or any other tribunal or agency; and

6. If I should thereafter learn that a similar action or proceeding

is filed or pending before the Supreme Court, the Court of
Appeals, the Court of Tax Appeals or any other tribunal or
agency, I undertake to report such fact within five (5) days
therefrom to this Honorable Court.
