A RESOLUTION SUPPORTING THE ESTABLISHMENT OF _________SCHOOL,

IN BRGY.___________, __________, CAVITE

WHEREAS, the Universal Declaration of Human Rights recognizes education

as a fundamental right necessary for the growth of an individual and the
development of society;

WHEREAS, Sec. 1, Article XIV, of the 1987 Constitution of the Philippines

provides, The State shall promote the right of all citizens to quality education at all
levels of education and shall take appropriate steps to make such education
accessible to all;

WHEREAS, Section 2 of the same article also states, “The State shall
establish and maintain a system of free public education in the elementary and high
school levels”;

WHEREAS, Republic Act No. 9155, otherwise known as “An Act Instituting a
Framework of Governance for Basic Education, Establishing Authority and
Accountability, Renaming the Department of Education, Culture, and Sports as the
Department of Education, and for Other Purpose,” requires the states to protect and
promote the right of all Filipinos to quality and accessible education by providing free
and compulsory education in the elementary level and free education in the high
school level;

WHEREAS, the Municipal Government of_______, under the leadership of

Hon. Mayor_________, purchased a ____ square meters lot and constructed a
_____ building intended for a public _____ school, in Brgy. ____, ____,
Cavite;Building #, _____________, Cavite, Philippines 41__.

WHEREAS,in the school year _______, the school caters to _____ pupils
(Kinder to Grade 6). From Brgy. ____, ____, Cavite and the nearby villages including

WHEREAS,the Department of Education, through DepEd Order No. 40, titled

“Establishment, Merging. Conversion and Naming /Renaming of the Public Schools,
and Separation of Public School Annexes in Basic Education,” requires a
Sangguniang Bayan Resolution supporting the establishment and naming of a
school, before it gives recognition to an independent public education institution;

WHEREAS, the present school shall be named as

_______________________ and shall be referred as such henceforth.

WHEREAS, in the establishment of____________school, the Municipal/City

Government of ______________ shall support the funding of the expenses of the
operations of the school through the Special Education Fund (SEF) until such time
the school Miscellaneous and Other Operating Expenses (MOOE) is made available
as mandated by the General Appropriations Act (GAA).

WHEREAS, the SECOND PARTY has requested the FIRST PARTY to use the said
parcel of land as the site for its school and learning facilities to which the FIRST PARTY has
agreed knowing that this will redound to the benefit of the community;
 NOW THEREFORE, for and in consideration of the premises, the FIRST PARTY
hereby grants the SECOND PARTY a USUFRUCT over the aforementioned parcel of land
under the following terms and conditions:

1. That the USUFRUCT rights shall remain enforce for perpetual use from the date
hereof;

2. That the parcel of land subject of this USUFRUCT shall be used by the SECOND
PARTY only for purpose of using the same for a school, learning center and its
related facilities.

IN WITNESS WHEREOF, the parties have hereunto signed this DEED OF

USUFRUCT on this _____ day of ____________, 20__ in the presence of witnesses.
 DEED OF DONATION

WHEREAS, the DONOR for his civic mindedness and affection for his fellowmen,
particularly the school children of ______________, the said DONOR by these presents,
transform and conveys by way of Donation unto the said DONEE the ____ parcel of land of
the above-described property with an area of _____________ square meters. Said parcel of
land of this donation is to be used as a school site.

WHEREAS, the DONEE hereby ACCEPTS as donation the _____ parcel of land
with an area of ______________ square meters of the above-described property. The
DONEE conveys the appreciation and gratitude of the community for the kindness and
liberality of the herein DONOR.

NOW THEREFORE, for and in consideration of the parcel of land subject of this
DONATION, it shall be used by the DONEE for the purpose of using the same for a school,
learning center and its related facilities.

WHEREFORE, this deed of donation and the above-described property shall be

included as annotation in the mother/original title of the parcel of land as donated to the
DONEE.

IN WITNESS WHEREOF, the DONOR and DONEE have hereunto signed this
DEED OF DONATION on this _____ day of ____________, 20__ in the presence of
witnesses.
