AFFIDAVIT

I, JUANITA A. NAMUHMUH, sixty (60) years old, Filipino citizen and

resident of Paypayan, Bocos, Banaue, Ifugao, after having been duly sworn to in
accordance with law, depose and state THAT:

1. My mother, Jacinta Kimmayong – Adchao, told me that the rice field located at
Ipayyaya, Poblacion, Banaue, Ifugao was given to her by her parents Mr.
Kimmayong Yogyog and Ms. Immaya Datong;

2. During my childhood, I used to help my mother clean the said rice field ready for
planting. The rice field was cultivated by our family even up to present;

3. Sometime in the later year of 1990s’, Mrs. Teresa Puddunan and Mrs. Teresa
Diagan came to our house and asked my mother that the said rice field will be
used as a collateral for the loan of my aunt Teresa Puddunan. The loan was not
paid by Teresa Puddunan;

4. They later told my mother that Mrs. Diagan will be erecting a concrete house so
that the interest of the loan will stop and when Juanita Adchao and her children
will pay the expenses of the building, the concrete house to be erected will be
owned by the family of Mrs. Juanita Kimmayong – Adchao;

5. At first, my mother disagreed. But Mrs. Puddunan and Mrs. Diagan persuaded her
so she later agreed to the proposals of my aunt and Mrs. Diagan with the
understanding that they will vacate the premises whenever the family of Mrs.
Juanita Kimmayong – Adchao will use the land upon payment of the expenses of
the building to be erected by Mrs. Diagan, which they also agreed;

6. Sometime in 2015, without our knowledge, Mrs. Judith Bulayungan returned the
expenses used to build the concrete house including the loan of my aunt from
Teresa Diagan;

7. My sister, Dominga Adchao, registered owner of the said lot, told Mrs. Teresa
Puddunan that she will return the money to Mrs. Judith Bulayngan. Unknowingly,
the daughter of Mrs. Teresa Puddunan returned the money of Judith Bulayungan;

8. Sometime in February 2021, my sister Dominga Adchao decided to return the

money to Teresa Puddunan so that she will now use the lot located at Ipayyaya,
Poblacion, Banaue, Ifugao. She told Mrs. Teresa Puddunan to stop improving the
area;

9. We were shocked that my aunt Teresa Puddunan deliberately refused to turn over
possession of the lot of my sister. With that, we brought the matter before the
Office of the Punong Barangay of Poblacion, Banaue, Ifugao. Despite the
agreement in the barangay that Mrs. Teresa Puddunan will stop improving the
building, she continues her illegal acts on improving the area;
 10. During our second (2nd) hearing at the Barangay Hall, an agreement was discussed
but Mrs. Teresa Puddunan wilfully refused to sign the amicable settlement on the
third (3rd) hearing;

11. I am executing this Affidavit to attest the truth of the foregoing and in support of
the claim Dominga Adchao and for all legal intents and purposes it may serve.

IN WITNESS WHEREOF, I hereby set my hand this __ day of August, 2021 at
