Art. 70. The spouses are jointly responsible for the support of the family.

The expenses for such support


and other conjugal obligations shall be paid from the community property and, in the absence thereof,
from the income or fruits of their separate properties. In case of insufficiency or absence of said income
or fruits, such obligations shall be satisfied from their separate properties. (111a)

Art. 72. When one of the spouses neglects his or her duties to the conjugal union or commits acts which
tend to bring danger, dishonor or injury to the other or to the family, the aggrieved party may apply to
the court for relief. (116a)

Argument, Dominic clearly neglected his duty as a husband and as a father. As from the facts stated that
for two years Tamara clearly provided the necessary expenses for support and conjugal obligations, and
an additional years for independently providing the same for the reason that Dominic was being
immature and way too prideful and selfish for his image and self intention/pleasure as a husband, not
giving care and much attention for her wife who works long hard days to satisfy the expenses, and
especially to raising their child who needs support for the basic necessities of living and to have a safe
and sound, a secure and warm home.

From the evidences gathered like for a household management and expenses that he threw a party at
his own expense and decision without giving consideration for the family, especially the child. Wherein
he acted independently without the consultation of his wife.

He is clearly is the zone to commit the acts under Article 72, for he commits dishonor or injury to the
other or to the family. And bring danger perhaps due to lack of financial expenses and such, may cause
future problems to the child to the family. Therefore Tamara shall file to the court for relief.
