JUDICIAL AFFIDAVIT

I. PRELIMINARY STATEMENT

I, Jeremae Ceriaco, single, of legal age, Filipino, with residence

at La Salle Avenue, Capitolville Subdivision, Bacolod City, Negros
Occidental. I am the Geodetic Engineer, I state under oath as follows:

The person examining me is ATTY. T ROY BALICAS, with

address at Cor. Hilado St., Capitol Shopping Center, Bacolod City.
The examination is being held in the same address. I am answering
the questions fully conscious that I do so under oath and may face
criminal liability for false testimony and perjury.

II. OFFER

The testimony of Jeremae Ceriaco is to prove:

1. The identity of the real property subject matter of the case.

2. The existence and due execution of the survey plan.
3. The existence of the encroachment of the defendant’s
concrete wall in the land of the plaintiff.
4. The bases of the claim and prayers of the plaintiff.

III. JUDICIAL AFFIDAVIT PROPER

 1. Question (Q): Do you know why you are here
in court?
Answer (A): Yes. To have my testimony
perpetuated in relation to the Civil Case for Removal of
Illegal Structure.

2. Q: Please state your full name and personal

circumstances for the record?
A: I am Jeremae Ceriaco, of legal age, Filipino
and resident of La Salle Avenue, Capitolville Subdivision,
Bacolod City. I am a Geodetic Engineer with an office
located in 6th Lacson St., Bacolod City.

3. Q: After the survey what did you do?

A: I told Bebelan that I will make a survey plan
and plot the points to make them understand and to
clearly show the encroachment of the wall of the lot
beside her lot.

4. Q: Do you have proof of the survey plan you

are mentioning?
A: Yes sir. I have with me the survey plan I have
made with my signature affixed on it.

(Witness handed over the document to Atty.

Balicas and Atty. Balicas examined it.)

5. Q: I am marking this document as Exhibit

“A” and will be attached to this Judicial Affidavit to form part
of the evidence. Do you confirm my action?
A: Yes, sir.

6. Q: Do you have anything to add ma’am?

A: None sir.

7. Q: Do you want to modify or clarify

anything that you said in this interview?
A: No, Sir. That will be all.

13. Q. That will be all for now, Madam

cooperation.
