PETITION FOR DIVORCE
This action is brought by the Petitioner, [PETITIONER_NAME], age [PETITIONER_AGE],

The undersigned Petitioner states, under oath, the following:
RESIDENCY
Petitioner has been a resident of and domiciled in the state of [STATE_NAME_1] for the
preceding [NUMBER_OF_MONTHS_1] months and in the County of [COUNTY_NAME_1]
for the preceding [NUMBER_OF_YEARS_1] years.
SERVICE OF PROCESS
The Respondent has agreed to file a Waiver of Service of Process in this cause and, therefore, no
service of process is necessary at this time.
JURISDICTION
The Court has proper jurisdiction to hear this cause. The Respondent has agreed to file an
Appearance in this cause. Neither party has ever been involved in any other domestic relations
proceeding involving the other party in this or any other jurisdiction.
MARRIAGE
The Petitioner and Respondent were married on [DATE_OF_MARRIAGE], in the state of
[STATE_MARRIED] and lived together as husband and wife until on or about the
[SEPARATION_DATE], at which time they separated and ceased to live together, and that they
have lived separate and apart without cohabitation ever since.

At the time this Agreement is being made, the Wife is currently expecting with an anticipated
due date of [ANTICIPATED_DUE_DATE]. All the terms and conditions with regards to
custody, child support and parenting time shall apply to this child upon his/her birth.
There were no children born or adopted during the marriage.
None of the children born or adopted during this marriage are under the age of eighteen (18)
years of age or are dependent on the parties for support.
GROUNDS FOR SEPARATION

Both parties attest that the marriage has become insupportable due to irreconcilable differences
which have eroded the marital relationship and thus prevents any reasonable expectation of
reconciliation.
AGREEMENT
This proceeding is uncontested. The Petitioner and Respondent have both signed a Marriage
Separation Agreement, dated [DATE_SIGNED].
The marital home, if any, has been divided as follows:
Neither party holds any interest in Real Estate.
The parties have already divided their interest in the marital home located at
[MARITAL_RESIDENCE_ADDRESS], [MARITIAL_RESIDENCE_CITY],

Both parties agree to sell and split the proceeds [PROCEEDS_SPLIT_PERCENTAGE] of the

By the terms of the Marriage Separation Agreement, both parties have settled all of the issues
relating to their marriage, including the division of all property, the disposition of all their bills
and obligations, the need for any alimony, maintenance or spousal support.
A Financial Statement has been prepared by each of the parties listing their respective income,
expenses, assets, and liabilities and the individual Financial Statements are attached and
incorporated by reference. The Marriage Separation Agreement and Financial Statements were
signed under no duress or force and without collusion.
CONSENT
The Respondent has agreed to file a Consent has agreed to file a Consent to the incorporation
and merger of said Marriage Separation Agreement into a DECREE OF DIVORCE in this case.
WAIVER

The Petitioner hereby waives any rights to findings of fact and conclusions of law, a record of
testimony, motion for a new trial, notice of entry of final judgment or decree, and the right to
appeal, but does not waive any rights to the future modification of any judgment or decree in this
cause.
The Petitioner respectively requests and prays:
That a Divorce be granted by the court dissolving and terminating forever the marriage between
the parties.
That all of the terms and conditions of the party’s Marriage Separation Agreement, which is
attached, be approved and be incorporated, merged into, and made part of a DECREE OF
DIVORCE and that the parties be ordered to comply with all terms and conditions of the
Marriage Separation Agreement.
That the court, award the parties any other further relief as may be just and equitable.

On the [DATE_OF_DECREE], a final hearing was held in this cause. The Petitioner was
present, in person. The Respondent waived issuance, service, and return of process and appeared
generally by an Appearance, Consent and Waiver duly filed and did not otherwise appear.
The Court, having examined the verified pleadings and heard the evidence and being fully
advised finds:
I. That all necessary residency requirements and prerequisites of law have been legally
satisfied;
II. That this Court has personal jurisdiction of the parties and the subject matter;
III. That all the material allegations, contents and information contain within the Complaint
are true; and
IV. That the parties have voluntarily waived findings of fact, conclusions of law, a record
testimony, motion for a new trial, notice of entry of final Judgment, and right to appeal,
but have not waived their rights to future modification of this Judgment.
THE COURT ORDERS, ADJUDGES, AND DECREES:

That the marriage of the Petitioner and Respondent is hereby dissolved and that they are hereby
divorced.
That all of the terms and provisions of the Marriage Separation Agreement between the parties
and dated [EFFECTIVE_DATE_3], which is attached and incorporated by reference, are hereby
approved and incorporated, merged into, and made part of this court order, and the parties are
ordered to comply with all terms and conditions of said Marriage Separation Agreement, but that
it shall survive this order.
That the party’s property and obligations shall be distributed and apportioned according to the
terms and conditions of said Marriage Separation Agreement.
