1. That, the plaintiff above named is a financial institution providing financial services to its
customers having its local office at Mahindra Towers, Opp. HAL, Faizabad Road, Lucknow,
and main office at Sadhana House, 2nd. Floor, 570 P.B Marg, Worli, Mumbai.

2. That the plaintiff disbursed a loan amounting to Rs [ ] bearing Agreement No. [ ] to the
above named defendant.

3. That the aforementioned finance amount having total agreement value of Rs. {} was to be
paid by the defendant No.1 in [ ] months, each EMI amounting to Rs. [ ] per month.

4. That the defendant No.1 above named is a regular defaulter and due to his default in
payment of regular installments the defendant No.1 above named has come in the category
of delinquent customers and consequently the plaintiff above named has filed the present
suit before this Hon’ble Court to settle the dispute amicably.

5. That in pursuance of the services, the defendant No.1 has enjoyed the finance facility
provided by the plaintiff and has used the hypothecated vehicle [ ] and has defaulted in
payment of the installments incurring huge loss to the plaintiff and the total outstanding
liability/amount due towards above mentioned loan Agreement No. [] disbursed in the name
of above named defendant is Rs. [ ] only till date.

6. That the defendant No. 2 is the guarantor of the defendant No.1 and as such he is jointly and
severely liable for the outstanding liability from the defendant No.1 which includes actual
usage, that is the principal and the interest charged on the amount due.

7. That the plaintiff claims total sum of Rs. [ ] only (till [date] ) as outstanding liability from the
defendants which includes actual usage, that is the principal and the interest charged on the
amount due.
PRAYER
Wherefore, it is most respectfully prayed by the humble plaintiff the this Lok Adalat may
kindly be pleased to pass the judgment and decree against the defendant for the amount
mutually agreed upon with the defendant and further interest @ 12% from the date of this
suit to the date of realization.

The plaintiff is filing the present claim petition without prejudice to his right to recover the
loan amount through regular legal course of action to other legal and contractual rights of
our clients.
