Some highlights of our recent experience include advising:
Shell (Formerly BG) and Reliance
In multi-phased arbitration proceedings
commenced under the UNCITRAL
Rules against the Government of India relating
to disputes exceeding USD5 billion arising out
of two production sharing contracts, and also
advising them in related court proceedings.
Deutsche Bank
In its claim against Sri Lanka, under the
Germany-Sri Lanka bilateral investment treaty,
for interfering with obligations arising under an
oil hedging agreement between the bank and a
state-owned oil company. Deutsche Bank was
awarded its claim in full, plus interest and its full
legal costs, totalling around USD78m.
Baggerwerken Decloedt En Zoon NV
In an ICSID arbitration against the Republic of
the Philippines, arising out of the cancellation
of a EUR280m infrastructure project. This
was the first successful ICSID award obtained
against the Republic of the Philippines.
An Investment Bank and a Chinese Private
Equity Firm
In relation to a dispute arising from
an investment in a coal processing
company in China.
A Chinese Company
In an ICC arbitration in relation to the
termination of a USD1.2bn construction project
in Latin America.
An International Telecommunications
Company
In a SIAC arbitration arising out of a dispute
with an infrastructure provider in Myanmar.
A Global Insurance and Investment
Management Company
In an ICC arbitration in Hong Kong arising out
of a Sale and Purchase Agreement for the
shares in an Asian life insurance company.
A Major Japanese Contractor
In disputes relating to an EPC contract for
the construction of a power and desalination
plant in the UAE. The contractor’s claims were
valued at around USD200m and included
claims for additional time and money.
An International Oil & Gas Company
On potential arbitration proceedings relating
to joint venture and shareholder disputes
concerning two energy projects in Malaysia.
A Global Oil And Gas Exploration And
Production Company
On various disputes arising out of the
construction work on one of the world’s largest
ever LNG projects.
A Global Investment Bank
In court proceedings relating to its investment
in an infrastructure project in Bangalore,  India.
A Korean Contractor
In a USD125m UNCITRAL claim arising
out of the construction of a power plant
in Bangladesh.
A Taiwanese Technology Company
In an HKIAC claim against a Korean supplier
following a breach of supply agreement.
The Islamic Republic Of Pakistan
In an investment treaty arbitration arising
from the arrest by Pakistan of certain ships
belonging to Turkish power-ship company
Karkey Karadeniz, which valued its claim in
excess of USD2bn.
One of the World’s Largest Private
Equity Groups
In an HKIAC arbitration arising out of an
interest in a real estate fund.
A European Incorporated Ship Owner
In a SIAC arbitration commenced by a Korean
shipbuilding company for alleged wrongful
termination of a ship building contract valued at
approximately USD100m.
The Hong Kong Branch of an Indian Bank
In disputes arising from sums of approximately
USD0.5bn owed to it under letters of
undertaking issued by an Indian bank.
Nissan
In a claim against the Republic of India pursuant
to the 2011 Comprehensive Economic
Partnership Agreement between Japan and
India in connection to certain outstanding
investment incentive sums owed to Nissan by
the State Government of Tamil Nadu.
Two Global Energy Companies
In relation to disputes arising in relation to oil
blocks in a South East Asian State. The advice
relates to disputes involving both commercial
and investment treaty arbitrations, with the
amount in dispute exceeding USD1bn.
