Statement of Claim
The Contractor has submitted a Claim for extension of the Time for the Completion of 101 days due
to

1) the National Confinement and Curfew order issue by the Government of Mauritius.

Project Manager’s Assessment of the extension of Time for Completion


i. The Contractor has deemed 52 days of additional time due to the National Confinement and
Curfew order issue by the Government of Mauritius from the 10 th of March 2021 to the 30th
April 2021.
ii. The Project Manager has proceeded with an assessment with information at hand and relevant
Government Notices.
Contractual basis of PM’s Decision
iii. The notification of Force Majeure by the Contractor is indeed a result of the impact of
COVID-19 outbreak on the works which falls within the definition of Compensation Events
as per Sub-Clause 41.1(l) of the contract in that it is:
 reason of civil commotion, strike or lockout affecting the trades employed upon
the Works…;
iv. The Contractor had notified the Project Manager (See Annex A) to have received Work
Access Permits on the first week of April which has been assumed to be the 11th April 2021.
v. In this view, the Project Manager concluded that the Contractor may be awarded for an
extension of Intended Completion Date by 33 calendar days at no additional cost.
