Job Location: ADDITIONAL TERMS AND CONDITIONS The following additional terms and conditions apply to this order and to any subsequent add-on purchases by you relating to the same projecthome: 1. Timing, Lead times for Cabinetry are reasonable estimates based on guidance and lead times provided to us by our manufacturers. Upon request from you, we will request and report back to you with any updates, including shipment delay information, from the applicable manufacturer. We are not responsible for delays or issues that are outside our reasonable control, including, without limitation, weather or other natural or man-made disasters or situations that hinder the manufacture or transportation of the Cabinetry or delays resulting from ‘unanticipated increases in volume of orders and unexpected manufacturing interruptions/complications. 2. Taking Delivery. It is important to make arrangements to accept delivery of your order promptly upon notification from Lakeville of its arrival. You must take delivery no later than forty-five (45) days after we notify you that the order has arrived. If delivery has not been accepted within that forty-five (45) day period, payment of balance on the order is due and payable immediately. In addition, there will be a storage charge of S25 per day thereafter until delivery occurs. Manufacturer’s warranties generally do not apply to readily observable damages that have not been reported to them within ninety (90) days after the cabinetry has arrived at Lakeville. As used in this paragraph, taking or accepting delivery includes your picking up of the order from a Lakeville location. 3. Lakeville Responsibility and Limitations, (a) In the event of an error or damage to the Cabinetry or a clear error in the Lakeville design on which the Cabinetry order was based, our principal and primary obligation to you, after we are notified by you of the error or defect with reasonable detail and specificity (including the provision of photographs and inspection access to the project site, if we request them), is to use diligent and prompt efforts to correctly convey the situation to the applicable manufacturer and to cause the replacementicorrection components of the Cabinetry to be produced and provided to us by the manufacturer (and then delivered by us to you) within reasonable and customary time frames, or to have a professional furniture refinisher remedy certain surface issues at the Project site, in each case, at no additional charge to you from Lakeville (or such refinisher). Lakeville honors all manufacturer's warranty issues, but is not responsible for reimbursement of time or installation expenses, (b) IN NO EVENT SHALL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, OR INDIRECT DAMAGES ARISING FROM OR RELATING TO THIS AGREEMENT. REGARDLESS OF ANY NOTICE OF THE POSSIBILITY OF SUCH DAMAGES, EACH PARTY'S MAXIMUM LIABILITY TO THE OTHER FOR DIRECT DAMAGES CAUSED OR DIRECTLY RESULTING FROM SUCH PARTY'S NEGLIGENCE SHALL BE LIMITED TO ACTUALIESTABLISHED DIRECT DAMAGES AND SHALL NOT EXCEED.
