STATUATORY INTERPRETATION

The judges can only do what is permitted under the law. Whereas, when the panchayat is
deciding, they don’t look for what is given in the law but merely rely on what is morally right.
Diff. b/w Judicial decision and Political decision. There have been rape cases where the judges
ask the accused to marry the victim. That is against the law. That is a decision a judge can’t
take. The judge might give explanations to his judgement but that won’t justify his judgement.
How does the judge justify reaching this conclusion according to the provisions given in the
statute? This is a political decision and not a legal decision. Judges can’t be given unconditional
power.
