This is responsive to your Office Action Paper No. [--], mailed on [---], 2004.

In the present office action, the Examiner rejects present Claims 1-11 for lacking

(1) A

Applicant respectfully asserts that the present invention is novel and inventive over
the cited references. Applicant requests that the Examiner consider the following
arguments:

General

At the outset, the Applicant wishes to explain in detail the difference between the
state of the art and the present invention.

It is well known in the state of the art to combine polypeptides with amphiphilic
compounds in general. However, such a combination is only the mere mixture of

the solubility of the polypeptide.

In contrast to this, and according to the present invention, an amphiphilic

compound is used for a completely different purpose. According to the invention,

Inventive Step Issue

From known literature, it can be concluded that the structure and characteristic
features of a formed complex or aggregate are completely dependent on the
preparation process and not on the final conditions.

The formation of the ionic complex of the current invention is restricted by certain
boundary conditions:

- XXX
- XXX

All these features were not known before the current invention.

Therefore, the current invention possesses an inventive step.

The Applicant respectfully submits that the present invention fulfills the
requirements of patentability under the Intellectual Property Code. The Applicant,
therefore, respectfully requests the Examiner to withdraw her objections.

We trust that this application will now be allowed.
