ASSIGNMENT FOR MODULE 2, PART 2

Laws on Obligation and Contract

QUESTION:

What are the essential requisites of an Obligation? Give an example to illustrate

them.

There are four essential requisite of an obligation. First is the active subject
or the creditor or obligee. The obligee is the person who requests the satisfaction
of an obligation. This person holds the right. Second is the passive subject or the
debtor or obligor. The obligor is the person who should satisfy their obligation to
the active subject. Third essential requisite of an obligation is the subject of the
obligation. This alludes to the conduct to be performed by the passive subject for
the active subject. Finally is the juridical or legal tie or the efficient cause. This
connection ties the parties to an obligation.

As an example, under a contract of sale, Melody agrees to deliver foods

worth Php 5,000 to Jeline. In the given example, Jeline is the active subject or the
obligee that will wait for the obligor to fulfill the obligation to her while Melody is
the passive subject or the obligor who will be fulfilling her obligation to Jeline. The
subject matter of the obligation is the delivery of foods while the juridical tie is
the contract made between Jeline and Melody.
