RESOLUTION
No. 1021-14

A RESOLUTION DIRECTING THE SUSPENSION OF CERTAIN COUNTY FUNDS


PREVIOUSLY APPROPRIATED TO THE HAMILTON COUNTY DISTRICT
ATTORNEY GENERAL’S BUDGET AS SALARY SUPPLEMENTS PENDING
APPROPRIATE RESPONSES BY SAID DISTRICT ATTORNEY GENERAL.

WHEREAS, in adopting Hamilton County’s 2021-2022 fiscal year budget, this county
legislative body agreed to appropriate certain funds to supplement salaries of various members
of the Hamilton County District Attorney General’s staff, including assistant district attorneys
and investigators;

WHEREAS, such salary supplements included in the 2022 fiscal year budget were 1)
supplements for certain District Attorney General employees that are employed by the State
with salary supplements processed through the County payroll system (jointly-funded
employees); 2) supplements for certain District Attorney General employees that are employed
by the State with salary supplements processed through the State payroll system (supplemental
pay); and 3) salaries for 12 full-time District Attorney General employees and one part-time
District Attorney General employee that are employed by the County (County employees);

WHEREAS, as part of this county legislative body’s consideration for making said salary
supplement appropriations, during its public hearings verbal inquiries were made by the
members of this body as to those proposed personnel on the District Attorney’s staff who
would be receiving those County supplements, and their familial relationship to the District
Attorney General, to which the District Attorney responded that none of his immediate family
members who were employed in his said office were receiving a salary supplement from those
funds allocated to the District Attorney’s Office by Hamilton County;

WHEREAS, subsequent to the adoption of the 2021-2022 fiscal year budget which included
said appropriation to the District Attorney General’s Office, it has been publicly disclosed that
two (2) members of the District Attorney General’s immediate family, i.e. his wife and
brother-in-law, will be among those who will in fact have their respective salaries
supplemented by those funds so appropriated by this county legislative body;
WHEREAS, as a result of said public revelation, members of this county legislative body
have requested that the District Attorney General appear before this body to explain the
perceived discrepancy between the verbal response he has given to this body and the reported
facts as has been publicly disseminated; but said District Attorney General has failed to make
himself available for this body to so inquire of him as to said discrepancy;

WHEREAS, in the meantime said District Attorney General’s Office is receiving funds as
allocated by this county legislative body which are being used in a manner as not fully
disclosed to, and/or approved by, this body.

THEREFORE, BE IT RESOLVED BY THIS COUNTY LEGISLATIVE BODY IN


SESSION ASSEMBLED:

That those funds allocated in the Hamilton County 2021-2022 General Fund budget to the
Hamilton County District Attorney’s Office as a supplement to the salaries of various
members of the District Attorney General’s staff above described as category #3) shall be
suspended upon the passing of this resolution; and that said appropriation remain suspended
until the Hamilton County District Attorney General (1) appears before this county legislative
body to satisfactorily explain said discrepancy as to any of his immediate family members
having their respective salary supplemented by said Hamilton County appropriation, or (2)
said District Attorney General remove his wife and brother-in-law from among those
individuals on his staff whose salaries are being supplemented by said Hamilton County
appropriation.

BE IT FURTHER RESOLVED THAT THIS RESOLUTION TAKE EFFECT FROM


AND AFTER ITS PASSAGE, THE PUBLIC WELFARE REQUIRING IT.
