which was registered as
Execution no. 502/2008 &
1/09/2008, in the court of Sh.
Gurvinder pal Singh, ADJ,
Delhi. Therefore, payment
was made to some of decree
holders namely Parsoti &
Subhash on 17.04.2008 in
Execution No. 145 of 2007,
Goswara No. 2052/D. Later on
due to none appearance on
behalf of decree holders or
their counsel, this execution
was dismissed on 01.11.2011.
Thereafter these decree
holders on 18.10.2012 have
filed an application for
restoration of the above
execution. This Hon’ble Court
vide order dated 30.07.2013
has allowed the decree
 holders to withdraw the said
application and permitted to
insist fresh execution, if
permitted by law. Thereafter
some of decree holders
namely Ramji Lal (Deceased)
through his LRs. Have filed
fresh execution no. 41/2016
and payment was made on
09.11.2016. Hence, this
execution.
7. Amount of suit along with Market Value of the acquired
interest as per decree or any Land was fixed @ Rs. 80,64/-
other relief granted by the per bigha along with 12% p.a.
decree additional amount & 30%
solatium with interest under
section 28 of the L.A Act @
9% p.a. for the first year from
the date of dispossession and
thereafter @ 15% p.a. till the
date of tender of
enhancement, excluding the
period w.e.f 19.08.1977 to
15.02.2005.

 The Decree- Holders humble pray that the Hon’ble Reference court in
L.A.C No. 415 A of 2006 arise out of award of Land Acquisition Collector
was pleased to determine fixed the market value of the acquired land @
Rs. 8,064/- per bigha as against Rs. 1000/- per bigha. Thereby the
giving an enhancement @ Rs. 8,064/- per bigha, along with 12%
additional amount on the market value from the date of notification under
section 4 of the LA Act till the date of award or dispossession, whichever
is earlier, 30% solatium on the market value & interest under section 28
of LA Act @ 9% per annum for the first year from the date of tender of
the enhanced amount.

AFFIDAVIT
I, Hardeep Singh S/o Late Sh. Mahipal, aged about 40 years, R/o Chilla
Village Mayur Vihar Ph-1, Delhi- 110091, do solemnly affirms and declare
as under:-

1. That, the deponent is one of the decree holder in the above

execution and is competent to depose this affidavit, being swear of
the facts of the case.
2. That, in this execution, the decretal amount payable to decree
holders is free from all sorts of encumbrances such as stay, security
or any other order from any court or authority under law.
3. That, the deponent has not received any notice of such appeal
against the decree/ award in question from the Hon’ble Supreme
court of India/ High court of Delhi and from any other court or
authority under Law. As such there is no stay or security order
stand against the amount payable to the deponent, under the
decree/ judgment of which execution has been sought.
