Henceforth, these revised guidelines may be scrupulously followed by all the Institutes / Centres / Divisions of ICMR, while filling the project positions. This issues with the approval of the Competent Authority and shall be poerational from the date of issuance of ths letter. All the existing project staff may be redesignated accordingly, while revising the consolidated emoluments. ‘The additional expenditure, on the revision of emoluments, may be met out from the existing available total budget It has also been decided by the Competent Authority, to engage Administrative and DEO staff, through Public Sector Undertakings. GUIDELINES FOR ENGAGEMENT OF NON-INSTITUTIONAL PROJECT HUMAN RESOURCE POSITIONS, 2021 {SCIENTIFIC & TECHNICAL) In exercise of the powers conferred under Rule-6 of the Bye-laws of the Indian Council of Medical Research and in supersession of all the earlier Guidelines, to engage against Non-Institutional Project Human Resource Positions, on contract basis, except in respect of things done or committed to be done, before such supersession, the Director General, ICMR makes the following guidelines, namely; PART-I : PREAMBLE ICMR, in pursuit of its scientific research activities, carries out its own Intra-mural as well as Extra-mural, short-term research projects. Projects are also sponsored by other Government Departments, Universities, and Industrial Houses, Private Sector, National and International Organizations, etc. In some of the cases, project activities are also carried out at the premises of other organizations / institutions, across the country, termed as ‘Host Institutes’. In order to accomplish the project targets in time, capable Scientific, Technical and Administrative manpower is to be engaged in the projects. Thus, guidelines are required to be framed, to provide transparent procedures, to engage human resources for various positions in the projects. Amendments / modifications to the existing instructions are also carried out, to incorporate new elements, which are based on operational experience and situational analysis, including the few court cases of project staff, claiming regularization, against regular sanctioned posts. On the basis of funding arrangements, Research projects are broadly divided into two categories as under: i) ICMR funded intra/extra mural projects; and ii) Non-ICMR funded projects, including projects sponsored by other Government Departments, Universities, Industrial Houses, Private Sector, National and International Organizations eto. PAR CLASSIFICATIONS 4. Short Title & Commencement (a) These Guidelines shall be called “ICMR Guidelines for Engagement of Non- Institutional Project Human Resource Positions, 2021.” (b) They shall come into force from the date of implementation. (c) These Guidelines shall not apply to persons in permanent employment olaeqasier Page 1of8 2. Definitions (a) “Annexure” means, the Annexures appended to these guidelines; (b) “DG, ICMR" means, the Director General of Indian Council of Medical Research; (c) “Director” means, the Director/Director-in-Charge of the ICMR Institute/Centre; (d) “Government” means, the Department of Health Research of the Ministry of Health & Family Welfare, Government of India; (e) “Institutes / Centers" means, the permanent Institutes and Centers of the ICMR; (f) “Project Human Resource Position” means, any non-institutional project position included in the Annexure-I, for engagement purely on temporary contract basis; (g) “Scheduled Castes and Scheduled Tribes” have the same meaning as assigned to them in clause (24) and (25) respectively of Article 366 of the Constitution of India. (h) “Sr. DDG (A)" means, Senior Deputy Director General (Admin) of ICMR HArs, New Delhi (i) “PI” means, Project Principal Investigator / Guide / Mentor of the project. 3. Competent Authority Director General for ICMR HQrs, New Delhi and the Director or Director - Incharge of the respective ICMR Institute / Centre, shall be the Competent Authority, in respect of all Project Human Resource Positions. 4. Composition of the Non-Institutional Project Human Resource Positions The Composition of the non-institutional project human resource positions shall be, as specified in Annexure-|, annexed to these guidelines, 5. Tenure of Project The projects shall normally be sanctioned for three years or less, depending upon the objectives of the study. The projects will be renewed annually, depending upon the functional requirements of the study involved in the project. In exceptional conditions, if the desired targets could not be achieved during the initial sanctioned term of the project, for genuine unavoidable circumstances, the PI may seek permission of ICMR through Director/Director Incharge of the respective Institute/Centre, to continue the project. Not more than two years of extension, beyond the sanctioned term of three years of the project, shall be allowed. The maximum period of the project shall not be beyond five years, from the date of sanction, under any circumstances. 6 Age relaxation The crucial date to determine the age, shall be the last date of receipt of application. Age relaxation for SC/ST/OBC/PWD category of candidates, shall be given, in Ndey Sue Page 20f& accordance with the Government of India guidelines issued from time to time in this regard 7. Disqualification No person shall be eligible for engagement in any Non-Institutional Project Human Resource Position of ICMR; (a) Who has entered into or contracted a marriage, with a person having a spouse living; or (b) Who, having a spouse living, has entered into or contracted a marriage with any other person, Provided that the Competent Authority may, if satisfied, that such marriage is permissible, under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of these guidelines. 8. Reservation Roster: Reservation Roster should be maintained at Institute / Centre / Council level, as the case may be, as per the guidelines issued by DoPT/ICMR from time to time, for all outsourced non-institutional project human resource positions, as specified in ICMR Office Order No. 19/9/2014-SCT (Cell).Hq. dated 09-12-2014. 9. Power to relax Where the DG, ICMR is of the opinion that, it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing, relax any of the provisions of the guidelines, with reference to any class or category of person. 10. Saving Nothing in these guidelines shall affect reservations, relaxation of age limit and other concessions, required to be provided for candidates belonging to the Scheduled Castes, Scheduled Tribes and other special categories of persons like OBC, PWD, EWS etc., in accordance with the orders issued by the Government of India/ICMR, from time to time, in this regard. 11. Interpretation Where any doubt arises, as to the interpretation of any of the provisions of these guidelines, the matter shall be referred to the DG, ICMR, whose decision shall be final. 12. Repeal These guidelines, shall supersede, all the existing guidelines related to engage against Short-term non-institutional Project Human Resource Positions in ICMR Institutes / Centers / Hqrs., to the extent the existing guidelines are consistent with these guidelines. loa ya\o Page 3 0f 8 PART = III 1. Procedure to engage Project Human Resource Positions: The ICMR HG / Institute / Centre shall engage their project human resource positions, through an open advertisement, inviting applications from eligible candidates, published ina leading local newspaper and also on the website of the concerned Institute / Centre as well as on the website of ICMR HQ. Formats of advertisement, offer letter, Medical Fitness Certificate, Character Certificate, Joining Report, and other relevant documents are annexed as Annexure-II and Ill 2. Duration of Engagement: Engagement of project human resource position shall initially be made for one year or less, depending upon tenure of the project and functional requirements. Continuation / extension to the engagement of project human resource position for further period shall be considered after evaluation of performance, keeping in view of availability of funds, tenure of the project, functional requirements and approval of the Competent Authority. The maximum term of engagement of any Project Human Resource Position in any or multiple projects, with breaks or without breaks shall be five years only. The concerned Project Investigator, Division Head and Head of the host Institute shall personally be responsible and accountable for the continuation / extension given if any without prior concurrence of the Director General, ICMR to any project human resource position beyond five years either with or without breaks in any or multiple projects. The engagement of Project Human Resource Positions shall be made purely on temporary contract basis and co-terminus with the project. The persons holding Project Human Resource Position shall not have any claim on a regular post in ICMR or in any of its Institutes/Centers or in any Department of Government of India and their project term will not confer any right for further assignment or transfer to any other project or appointment/absorption in the funding agency or in ICMR. For this, a clear and binding undertaking must be obtained from the person as per proforma at Annexure-B(vi). 2. Rates of Emoluments: (a) In respect of ICMR funded projects, the consolidated emoluments payable to the project human resource positions shall be payable on a fixed monthly consolidated remuneration basis. No other allowance those are applicable to the, regular employees shall be admissible to the Project Human Resource Positions. (b) Benefits of Provident Fund, Pension Scheme, Leave Travel Concession, Medical claim, Staff Quarters and other facilities, applicable to the regular employees etc. are not admissible to the Project Human Resource Positions. Lea Kio \re% Page 40f 8 3. Leave Provisions: (a) CCS (Leave) Rules shall not be applicable to Project Human Resource Positions. (b) Paid Leave of absence may be allowed at the rate of 1.5 days for each completed month of engagement, or as prescribed by the Competent Authority from time to time. No other kind of leave shall be admissible. (c) Leave shall not be carried forward beyond one-year contract. Accumulation of leave beyond a calendar year shalll not be allowed. (d) On termination of the contract, they shall not be entitled to the benefit of encashment of un-availed portion of leave. (e) Matemity Leave, for female Project Human Resource, in terms of ICMR OM No.16/50/2015-Admn.I dated 11/02/2016. (f) In the event of leave without prior permission of PI / Guide / Head of Institute and / or any willful unauthorized absence, the contract shall be ceased automatically and the concerned person holding Project Human Resource Position will not be permitted to resume duty without prior permission of Head of the host Institute. 5. Travel Entitlement: Usually, the persons engaged on project human resource positions shall not go on official travel, outside their designated Institute / Centre / Hrs, However, if they have to travel, as per the project implementation requirements, then: (a) Project Human Resource Positions drawing monthly consolidated remuneration @ Rs. 35,000/- and above shall be entitled as follows: (i) Economy class by Air, by Indian Airlines only (ii) 2" AC class for journeys undertaken by rail. (iii) By road - Public AC Bus and Non-AC Taxi (iv) By sea/ river steamer etc. -First / A Cabin Class. (v) Reimbursement for hotel accommodation/guest house of up to Rs. 2,250/- per day / head. Reimbursement of non-AC taxi charges of up to Rs.330/- per day / head, for travel within the city. Reimbursement of food bills, not exceeding Rs.900/- per day / head. The claimant has to submit self-certified claim with supporting vouchers. Reimbursement will be restricted to the ceiling limit and actual expenditure, whichever is least. (b) Project Human Resource Positions drawing monthly consolidated remuneration less than 35,000/- and shall be entitled as follows: () 3 AC class for journeys by rail (ii) By road - Public AC Bus and Non-AC Taxi. (iii) By sea / river steamer etc. — First / A Cabin Class. (jv) Reimbursement for hotel accommodation/guest house of up to Rs. 1,250/- per day / head. Reimbursement of non-AC taxi charges of up to Rs.225/- Page 5 of 8 doy B\t ler per day / head, for travel within the city. Reimbursement of food bills not exceeding Rs.800/- per day / head. The claimant has to submit self- certified claim with supporting vouchers. Reimbursement will be restricted to the ceiling limit and actual expenditure, whichever is least. 6. Obligations of Project Human Resource Positions: (a) The Project Human Resource Position holders have to work full time for the project job assigned to them by their Pl/Guide and submit themselves to the disciplinary regulations of the host Institute / Centre / Division of ICMR, where they are working. Regular attendance of the Project Human Resource Position holders shall be ensured by the Project Investigator / Guide of the host Institute / Centre / Division of ICMR, by keeping an attendance register. (b) In case a Project Human Resource Position holder desires to appear for competitive examination, he/she would invariably seek permission from his/her Pl/Guide and inform ICMIR/ Director or Director In charge of the respective ICMR Institute / Centre about it. No Objection Certificate, which is applicable for the regular Government Employees for applying or attending interviews for outside employment shall not be given to Project Human Resource Positions holders. (c) The Project Human Resource Position holder shall not to take any assignment other than related to his/her project, paid or unpaid. However, if required, they may assist the host Institute in its academic work / other activities, as per guidelines of Pl / Guide / Head of the Institute, ensuring that the progress of their project is not hampered. (d) Once a person accepts the offer and joins the Project Human Resource Position, he/she must work for the initial tenure stipulated in his/her offer letter to avoid hindrances in achievements of original objectives of the study of the Project. (e) No person shall leave the Project Human Resource Position, without prior approval of his/her Pl/Guide and Head of the Institute. If he/she desires to leave the job, then he/she must submit his/her resignation through his/her P| / Guide, one month in advance, indicating specific reasons for not continuing the job. However, ICMR or the Institute, can terminate the engagement, with immediate effect, by paying one month's notice pay. (f) The Project Human Resource Position holder shall not make any correspondence / communication / representation / grievance etc. directly to any higher authority, by- passing his/her PI / Guide / Head of the host Institute. This would include all forms of communication including through E-mails, public portals, etc. Strict action will be taken against those who would violate the proper channel of communication, by- passing the PI / Guide / Head of the Institute. aan Page 6 of 8 PART-IV: CONSTITUTION OF ASSESSMENT COMMITTEES 1, There shall be two levels of assessment. The first one shall be internal level for screening purpose and next level shall be evaluation by a Selection Committee, consisting of external / internal experts, possessing expertise in the relevant subject field. 2. Sr. DDG (A) at Headquarters office and the Director / Director-in-charge of Institute /Center shall constitute the Internal Screening Committee, consisting members at appropriate level, commensurate with the level to which the project position has been advertised, which shall scrutinize with reference to the eligibility criteria, as per these guidelines. The screening committee shall shortlist only those who fulfil the minimum eligibility criteria. 1] Chairperson | Nominee of the Sr. DDG (A) of the Director, not below Level-12 0 Project Investigator 2|Member —_| One internal expert from relevant area / Project Investigator, not below Level-10 7 3|Member | One representative from Administration not below Level-10 Member —_| One representative from Accounts not below Level-10 5 | Member | One representative from reserved category (SC / ST / OBC) not below Level-10 _ Note: Out of the above members, one each shall be female and minority community representative. 3. The Selection Committee will be constituted by the Sr. DDG (Admn) for ICMR Hars and the Director / Director-in-Charge for Institutes / Centers. The Institute / Centre shall call for applications, preferably online, without any enclosures, If the number of applications is less than 50, the Screening Committee shall scrutinize and shortlist the candidates for interview. If it is more than 50, written test of 50 questions shall be conducted. The qualifying mark shall not be less than 35, in any case. If more number of candidates qualify, the candidates for interview can be called by 1:5 ration up to 10 vacancies and beyond that 1:3 ratio. The question paper shall consist of 30 questions from the respective subject specialty, 10 for computer operating system / software proficiency and 5 each for general aptitude and awareness. . Quorum: In case Selection Committee members(s) nominated could not attend the meeting, due to justified reason, which is beyond their control, then Chairperson + three members, including one external expert, shall form the quorum. The recommendations of the Selection Committee along with minutes shall be sent for consideration and approval of Sr. DDG (A), ICMR, for HOrs and the Director / Director In charge for Institutes / Centres. Therefore, we are not committed to fill up all the advertised Project Human Resource Positions and the process is liable to be withdrawn / cancelled / modified at any time. 4. The rates of emoluments/stipend shown in this advertisement are project specific and may vary according to sanction of the funding agency of the Project 5. Cut-off date for age limit will be as on the date of last date for submission of applications. 6. Age relaxation will be as per the guidelines of ICMR 7. Persons already in regular time scale service under any Government Department / Organizations are not eligible to apply. 12. No TA/DA will be paid to attend interview / personal discussion and candidates have to arrange transport / accommodation themselves. 13. ICMR reserves rights to consider or reject any application / candidature. 14, Submission of wrong or false information during the process of selection shall disqualify the candidature at any stage 15. The persons engaged on Project Human Resource Positions will normally be posted at the study site; however, they can be posted to any other sites in the interest of research work. The persons engaged on Project Human Resource Positions shall not have any claim on a regular post in ICMR or in any of its Institutes/Centers or in any Department of Government of India and their project term with breaks or without breaks in any or multiple projects will not confer any right for further assignment or transfer to any other project or appointment / absorption / regularization of service in funding agency or in ICMR. Successful candidates will normally be engaged on Project Human Resource Position initially for a period of one year or less, depending upon the tenure of the Project and functional requirements.
