DECISION BASED ON COMPROMISE AGREEMENT

Plaintiff filed this case against defendant for Collection of Sum of

Money (Small Claims) in the amount of P 159,471.31.

Defendant agrees on Plaintiff’s claims but prayed for the reduction

of the penalties and fines and the extension of the terms of payment.

Thus, the parties reached an amicable settlement and submitted to

the court a compromise agreement.

COMPROMISE AGREEMENT

PARTIES, during Judicial Dispute Resolution (JDR) on small

claims case, voluntarily and freely submit compromise agreement in their
desire to terminate their controversy under the following terms and
condition:

1. Defendants hereby acknowledge to pay her joint and several obligation

with Plaintiff as follows: Principal 98,579.01; Interest 56,962.30;
Litigation expenses 3,930.00 or in the total amount of ONE HUNDRED
FIFTY NINE THOUSAND SEVENTEEN PESOS & 71/100 (152,017.71)
computed as of June 15,2021;

2. Said Defendants bind and obligate herself to pay the aforesaid amount as
follows: At least P 500.00 every month or approximately 305 months term
starting September, 2021 and until fully paid whatever remaining balance.
Payment shall be done at the office of the Plaintiff which shall be
acknowledge and receipted by the latter;

3. Failure of the Defendant to pay two or more monthly installments, the

remaining balance shall become due and demandable and shall earn
interest of 13% per annum, and plaintiff may move for the execution of
Judgment;

4. That Plaintiff accepts the foregoing offer and mode of payment by the
defendant upon signing of this Compromise Agreement;
5.That parties jointly asked the court to approve their Compromise
Agreement and Judgment be rendered in accordance therewith.

It appearing that the agreement is not contrary to law, morals, good

customs, public morals and public policy, and pursuant to Article 2028
and 2037 of the Civil Code of the Philippines, the same is hereby
APPROVED and ADOPTED as the Decision of this Court.

The parties are hereby ordered to faithfully comply with the terms
and conditions of the agreement.
