The primary purpose of following requirements is to create a sense of community as well as allow for unique design solutions that result in varied interest throughout the community. Pursuant to the Declaration of Covenants, all exterior improvements you plan to make on your property (whether to your home or to your lot) MUST BE SUBMITTED AND APPROVED by the Architectural Committee PRIOR TO INSTALLATION, unless a specific “pre-approval” is listed in the following pages. The term “improvement” includes, but is not limited to, such items as landscaping, fencing, patios, decks, pools, hot tubs, play equipment, deck covers, gazebos, storage facilities/sheds, room additions, awnings, roofing, and painting. All reviews are made on their individual merit — approval or denial in one instance does not necessarily mean the same decision under a different set of circumstances. ‘These Design Guidelines supplement and are in addition to the requirements contained in the Bear Creek Meadows Declaration, all of which requirements stay in effect. The Architectural Committee and/or the Board have the right to amend, terminate, modify or replace these Design Guidelines from time to time, in whole or in part. Design Guidelines Wer. 1.0 Page 3 SUBMITTAL PROCEDURES 1, Please use a Design Review Request form provided to you from the Management Company to help you coordinate all information. If you need additional forms, visit www.msihoa,com under the Homeowner Services section to download a Design Review Request form or call and ask for more. Requests for approval can be mailed, e-mailed or faxed to the Management Company at the addresses listed below. The Management Company will forward your request to the appropriate Design Review Committee (DRC), track it through the process, and return written information to you regarding the Committee's decision. Suite 2-101 Centennial, CO 80112 Office: 720-974-4224 Fax: 720-974-4424 E-mail: Lspies@msihoa.com 2, Plans and specifications must be detailed and include the following: * Plot plan showing the location of the improvement(s) * Landscaping description — identify trees, shrubs, mulch areas, flower beds, vegetable plots, walkways, sheds, play equipment, etc. * Height, width, length, materials description, and color samples for any structures or equipment * Paint requests must include a mock up on the home for committee review * Please ensure that all documents are legible 3. PLAN AHEAD! The Design Review Committee strives to respond to requests quickly, however, the Committee may meet once per month a: needed. It may take up to 30 days after the complete submittal package is received for a response to be sent to you. Having the documents complete and legible will help avoid a request for additional information and delay an approval. 4. Decisions will be mailed to you in written format and will be one of four responses: © Approval ‘* Approval with conditions ‘© Request for additional information + Denial NOTE: Any improvement installed in a manner that is inconsistent with the pre-approved guidelines or approved Design Review Request, is subject to removal at the owner’s sole expense. The owner may also be subject to fines or other legal action. ** Homeowner is responsible for complying with all local and municipal codes before construction and install. Design Guidelines Ver, 1.0 Page 4 DeEsiGn GUIDELINE SUMMARY The Following is a list of improvements. This is not intended to be an all- inclusive list of possible submittal items. Any item not listed must be submitted for approval. I, PRE - APPROVED IMPROVEMENTS: Approval is not required for the items in this section as long as the following guidelines are followed pertaining to each section. Homeowner is responsible for complying with all local and municipal codes and acquire any requized permits. Ll + Must include a minimum of 49% turf and the other 61% must be a ‘combination of planting beds with mulch cover and landscape Backyard ‘material/hardscapes. No bare ditt is allowed. Landscape + Sprinkler systems + Landscape installed must not affect drainage or grade of lot. It must not interfere with drainage of adjacent lots. © Plant matorial that is pre-approved is on the attached appendix A: Pre- Approved Plant Material list, + Homeowner must review soils report, plot plan, builder's warranty and other pertinent documents for other restrictions and guidelines. + Allother backyard landscape must be submitted for approval. 1.2 + Patios and decks that are less than 36 inches in height without railings with a maximum size of fewer than 300 square feet. Hot Tubs/spas on decks or patio more than 48 inches from the ground ‘must be submitted for approval. All other hot tub/spas must be submitted for approval All lighting, including any security type fixture, must be directed ‘downwards and the light “cone created must be contained within the property boundaries to avoid a glare source to neighboring Properties. Allother lighting must be submitted for approval. All lighting fixtures are to be architecturally compatible with the home ‘All other lighting must be submitted for approval. ‘The trampoline including safety netting must not exceed 12 feet in height from ground level, and is placed in back yard at least 5 feet from any property line. ‘All other trampolines must be submitted for approval. ‘The unit is ground-mounted and placed either at the rear of the house cr the side of the house if screened from street view by a fence. The unit should be located to minimize noise that may be disturbing to neighbors. Roof-mounted and window-mounted cooling or heating systems are not permitted Allother Air Conditioning units must be submitted for approval. Screer/Storm/Security deors: must be white, black, bronze, or match existing color of home. Entry doors: must be stained or painted a color that is compatible with trim and siding color of home, All other door styles or color must be submitted for approval. Replacement garage doors of the same style as originally installed. Garage doors are to be painted the same as the body or trim color of the home. All other changes in garage door styles must be submitted for approval. Painting of the exterior of the house if the exact color is used per the builder's paleite. All other painting changes must be submitted for approval. Contact Management Company for palotte information, ‘Same roof material and color is used. Allother roofing materials must be submitted for approval. Replacement windows with trim of the same color and style as originally installed does not require Design Review Committee approval. All changes in window styles or colors must be submitted for approval. Roflective glass is not permitted. Design Guidelines Ver, 1.0 Page 6 1.16 Satellite Dishes/Antennas Lz Decorations, Seasonal 1.18 Radon Mitigation. Provided the dish is less than 39" in diameter, they chould be placed on the side or rear of the home, not visible from street view. No other exterior radio antennas, television antennas or other antennas may be erected unless approved in writing by the Design Review Committee, Irmaterials are in good taste, not installed earlier than 48 days prior to the holiday, and are removed within 30 days following the holiday. All other Seasonal Decorations and yard decorations must be ‘submitted for approval, Radon systems must be kept tight to the side of the house and do not vary from local and municipality codes. Design Guidelines Ver. L0 age 7 II. IMPROVEMENTS REQUIRING APPROVAL Please see the submittal procedures on page 4. All items in this section or not otherwise mentioned require approval prior to installation, BE SAFE! IF YOU HAVE QUESTIONS, ASK FIRST! 21 + Allstructures, such as gazebos, storage sheds ox groonhouses will be evaluated on their individual mort, se, location on lot, and Accessory appearance. ‘Samples, photographs, materials Structures/Sheds description, and a plot plan showing the structure TO SCALE are required. Structures should be placed to avoid unreasonable influence into neighboring yards. + Any proposed shed shall meet the minimum following criteria: © Sheds may not exceed 8" in height and shall not be larger than 100 square feet. © Aminimum 3! setback from any property line is required. © Vertical landscape materials or other screening may be required to minimize the impact on adjoining properties. © The shed shall match the colors and materials of the home, and shall be maintained in a clean, neat, and attractive condition at all times. + Other restrictions may also be imposed, based on the Committee's ‘evaluation of the lot, grade, and visibility from the street or adjoining properties 22 + Im goneral, awnings that are retractable, neutral in color, and Awnings ‘constructed of cloth (as opposed to metal or plastic), are proferred. 2.3 ‘+ Submission required for decks that are more then 98 inches in height. Decks + Wood decks shall be left their natural color, or may be stained with redwood or cedar stain, or sealed with a clear sealer, or may be painted a color that is compatible with the color scheme of the home. ‘+ Wood-look materials must also be a color compatible with the color scheme of the home, Decks must appear to be an integral part of the residence. 2.4 ‘+ Must be of material to match either the deck or the home in both Deck Covers/Patio material and color. + Consideration must be given regarding line-of-sight views from Covers neighboring properties, 2.5 + Maximum height of below the top of the fence line. Suggested methods of containment are: Dog Kennels/ ©. Open rail fencing with weld wire (heavy gauge wire with Dog Houses 2x4" openings, also called “rabbit wire” or “grid wire", ot chicken wire), also PVC covered weld wire in white © Picket fencing with spaced installation, © Picket fencing with "shadow-box" installation, © “Invisible” below ground electronic containment systems. ‘+The maximum size of a dog house that may be installed without prior approval is 48" in height, width, and length. All other doghouses require approval prior to installation. ‘compatible with the home in material and color, and installed in the back yard only. Each submittal will be considered on its individual merit and intent. See also Accessory Structures. Any change to exterior porch or railing design on the front or back of the home, Replacement railings of the same style as originally installed doos not require Architectural Committee approval Approval is required for all types of swimming pools (except as noted below), whether in-ground or above ground. Appropriate permits must be obtained from the governing municipality and all safoty requirements met. Inflatable or lightweight wading pools and splash pools not exceeding 6 feet in diameter, placed in the back yard, may be used without prior approval Additions, expansion, or remodeling which will ater the exterior of, any residence must include detailed plans, specifications, dimensions, and location. Certifications from licensed engineers and/or architects may also be required and all appropriate city or county permits must be oblained, ‘Submission required for any expansion or widening of a driveway. Extensions to driveways may not exceed 3 feet in width om either side. Different material or design from the original concrete installed must be submitted for review. Replacing original conczete driveway does not require approval Parking in rear or side yards is not permitted. Approval is required when changing the exterior paint color of the home. Approval will take into consideration the color tone and brightness, architectural style, stone or brick accents, roofing colors, and compatibility with other colors. No adjacent properties shall be allowed to use the same color scheme, Color samples must be at least 8x10”, and marked clearly as to the areas in which they will be used. Exterior finishes must harmonize with the colors throughout the community. ‘Accent and “punch” colors, such as front doors or trim may be more pronounced, however in no case shall bright, neon, fluorescent, or primary tones be allowed. Approval is required prior to installation for any change to any exterior materials on the home. In general, those areas that were painted must remain painted, and those aroas with stone or brick must be left as stone or brick in their original colors and texture. ‘Alurainum or vinyl siding products are not permitted. Skylights must be installed as an integral design component of the roof, at the same pitch and angle of the existing roof. Design Guidelines Ver. LO Page 9 2.14 Solar Energy Devices 2.15 Swamp Coolers 2.16 Flags and Flagpoles 2.17 Retaining Walls 2.18 Decorations, Permanent 2.19 Weather Vanes 2.20 Landscaping Approval is required prior to installation, ‘All such devices must be integrated into the existing design of the home, and if roof mounted, shall be at the same pitch and angle of the existing roof. No exterior plumbing may be visible from the street or adjoining properties. [All such exterior cooling devicos shall be installed at ground level land shall be subject to the approval of the Architectural Committee. No exterior roof-mounted or window-mounted swamp coolers, evaporative coolers, or air-conditioning units are permitted. Penetration of siding for installation of cooling devices is not permitted, other than what may be required for service lines. See section 1.10: Air Conditioning for ground-mounted guidelines. Bracket holders are permitted without prior approval. Approval is required prior to installation for permanent freestanding flagpoles. Any retaining wall in excess of 36” in height must be accompanied, by a professional engineer's certificate of structural design. All designs should be consistent with the landscaping design of the home. Approval is required for any permanent items in the front yard, such as yard statuary, arbors, fountains, otc Weather vanes are not permitted except if placed in the backyarel ‘with @ height no greater than 6” Any reduction in sod for the front yard must be approved by the Design Review Committee Plant material that is pre-approved is on the attached appendix A: Pre-Approved Plant Material lst. Artificial grass must be submitted for approval to the Design Review Committee. Samples of artificial grass must be submitted to the committee. Design Guidelines Ver. 1.0 Page 10 Appendix A: PRE-APPROVED PLANT MATERIAL LIST The following plant material may be installed without prior approval from the Design Review Committee. +Sod + Perennials + Annuals + Shrub/Bushes + Fir Trees + Fruit Trees + Deciduous Trees with the exception of Poplar, cottonwood, and Russian olive trees.
