Republic vs Villasor

The Republic of the Philippines in a petition for

certiorari and prohibition challenges the validity of
the order issued by Judge Villasor,
A decision was rendered in favor of the private
respondents confirming the arbitration award and
was declared final and executory by Judge Vilasor, a
corresponding writ of execution was issued directing
the Sheriff to serve notice of garnishment with
several banks against the funds of the AFP.
RP argued that these deposits are public funds duly
appropriated and allocated for the payment of
pensions of retirees, pay and allowance of military
and civil personel and for maintenance and
operatins of AFP.
Hence, Judge acted with GAD amounting to lack of
jurisdiction which results to nullity of the issued
garnishment.

ISSUE: WON the issued garnishment is valid.

RULING: NO.
